N.Y. - ICE agents arrest high schooler hours before prom

Michael P. McKinney and Jorge Fitz-Gibbon, The (Westchester County, N.Y.) Journal News 6:35 p.m. ET June 9, 2017

OSSINING, N.Y. — Federal immigration authorities took a 19-year-old high school student into custody hours before his senior prom.

Diego Ismael Puma Macancela, a citizen of Ecuador, was arrested at his cousin's Ossining home Thursday morning, according to Rachael Yong Yow, public affairs officer for U.S. Immigration and Customs Enforcement.

The agency said Puma Macancela is being held at a federal detention center pending deportation. His arrest comes in wake of a deportation order that an immigration judge signed Nov. 16.

His cousin, Gaby Macancela, said a frightened Puma Macancela came to her apartment Wednesday night after his mother's arrest. The following morning, she said they cowered in fear in one of the bedrooms when they heard agents banging on the door of her apartment.

“Wake up. The police are here again," she said Puma Macancela told her. "They’re coming for me.”

Her cousin eventually walked outside and was arrested, she said.

“He’s not a criminal. He didn’t do anything bad to nobody," she said. "He was just going to school, working. He was trying to make his dreams come true for him, for his family, for us. I don’t know why. He’s just a kid.”

Victoria Gearity, mayor of the Hudson River village of 25,000 residents about 30 miles north of Manhattan, said the student and his family believed he had been permitted to remain in the United States for several years while his case was reviewed. Gearity said the arrest played out in front of her.

"As people were heading out to work, and kids were walking to the bus stop, three federal agents were walking around the property of the house across the street from me," she said. "I spoke with one of the ICE officers. He was cordial and professional."

She criticized the agency for not notifying village police before the arrest.

"The Ossining Police Department has been at the forefront of community policing, and they have increased their outreach to the immigrant community in recent months," the mayor said. "But when people are scared, it's tough to distinguish between local law enforcement and federal immigration enforcement."

"And that means people are less likely to report crimes or help with investigations," she said. 2010 Census figures show that more than 2 out of 5 residents in this village of 25,000 residents identify themselves as Latino.

However, Yong Yow said village officials were made aware of the federal agency's actions.

"Contrary to a statement issued from the Ossining Mayor’s Office, local police received prior notification that ICE would be in the local area conducting targeted enforcement actions," she said in a statement.

Chief Kevin Sylvester of Ossining village police did not respond to immediate requests for comment.

Schools Superintendent Ray Sanchez said the district was notified Thursday.

"We understand from the family's legal counsel that an appeal will be filed to at least grant our student the ability to finish high school over the next several weeks as he was on course to do," Sanchez said in a statement Friday.

Executive Director Carola Bracco of Neighbors Link Community Law Practice, a Mount Kisco, N.Y.-based immigrants rights group, said Puma Macancela's family contacted her office shortly after the arrest.

“We’re working hard to see if there’s a way for him to stay in this country and graduate from high school. The community has really mobilized," Bracco said. "The family is absolutely heartbroken, not to mention the school community that is deeply impacted by this."

Supporters of the high school student started an online petition on his behalf. As of 6 p.m. Friday, it had almost 2,500 signees.

Ecuador is a nice country, they have good schools. He can finish up there. We don't have time to dilly dally around with graduation issues for illegal aliens.

He should have been deported on November 16th. That's plenty of dilly dallying around seems to me.

GET THESE PEOPLE OUT OF HERE. NO DILLY DALLYING.

ICE defends arrest of illegal immigrant just before his prom

    by Jack O'Brien | Jun 13, 2017, 12:34 PM

The acting director of Immigration and Customs Enforcement on Tuesday defended the agency's decision last week to arrest an illegal immigrant who was on the way to his prom.

ICE Acting Director Thomas D. Homan was asked at a House Appropriations Committee hearing about Diego Puma Macancela, a 19-year-old who was detained last week. Rep. Nita Lowey, D-N.Y., asked if it's an ICE policy to target students on the way to school or church.

"If you have a student who's walking to school waiting at a bus stop, you have someone waiting to arrest him?" Lowey asked.

Homan stated that ICE was unaware that it was the day of Manancela's prom, but he defended the actions taken because Manancela had an order of removal. He stated that because Manancela had entered the country illegally and had an outstanding order of removal, he should have been "looking over his shoulder."

"We're talking about somebody who had his due process and lost his case," Homan said. "There'd be no integrity in the system if we didn't uphold the rulings of a judge. This is a country of laws, we need to stand by the laws."

Homan did say that ICE does have policies in place dealing with apprehensions in sensitive locations as churches, schools, hospitals or public demonstrations like parades. Detainments and arrests can only occur at these locations if there are exigent circumstances, other law enforcement actions have led ICE there, or if prior approval has been given from a designated supervisor.

Homan said in response to a question from Lowey that so far this year, there have been no apprehensions at sensitive locations.

"As far I'm concerned, with the information available to me, nobody's been arrested at a school, nobody's been arrested at a hospital," Homan said. "Courthouses have a different policy. Courthouses are a place we should be arresting people."

Homan cited safety features at courthouses, like metal detectors and guards, as a preferable place for ICE to arrest undocumented aliens. But he added that ICE does not arrest witnesses or victims at trials, only "those who pose a public safety risk."

Homan disputed the media coverage surrounding arrests near churches or schools, stating that arrests in major cities usually occur in the vicinity of sensitive locations. Homan said this is a result of communities not allowing ICE to have access to county jails, and plans by illegal aliens to leave their homes infrequently.

"If I can't arrest them in the privacy and security of a jail, then I have to go to their homes or wait for them to leave their homes," Homan said. "It's a target enforcement operation. [ICE] knows who they're going to arrest and where they're going to arrest them. There's no sweeps, there's no neighborhood raids. That's not the way we operate."

Soros Lawyers Fail to Prevent Deportation of Alleged Illegal Immigrant Gang Member

    by JOHN BINDER
    23 Jun 2017
    White Plains, NY

An illegal immigrant teenager is set to be deported this week after being accused of having ties to foreign gangs in Ecuador, despite attempts by George Soros-funded lawyers to prevent the matter.

Diego Ismael Puma Macancela, 19, crossed the U.S.-Mexico Border in 2014. Macancela and his mother, Rosa Ines Macancela-Vazquez, were detained by U.S. Border Patrol originally.

The Macancela’s were released due to the Obama-era ‘Catch and Release’ program which allows illegal immigrants to remain in the U.S. as they await immigration hearings. The teen’s request for asylum in the U.S. was ultimately turned down in November 2016 after Immigration and Customs Enforcement (ICE) officials accused Macancela of being involved with gang activity in his native Ecuador.

Carola Bracco, a spokesperson for Neighbor’s Link, one of the organizations fighting Macancela’s deportation, denied the gang affiliation to USA Today, saying at the time “his stay of removal, and the basis for this denial is that they are accusing Diego of participating in a gang that he was actually fleeing from.”

Despite Macancela and his mother knowing the immigration terms back in 2014 when they illegally entered the U.S., the pair’s story was exploited by the open borders lobby as an example unfair deportation.

The New York Immigration Coalition, which tried to fight Macancela’s deportation, is funded by the left-wing billionaire George Soros’ Open Society Foundation.

A week before Macancela is set to be deported, open borders attorneys with the New York Immigration Coalition filed a petition asking the illegal immigrant teen be allowed to stay in the U.S. for a year. The request was ultimately denied.

As Breitbart Texas reported, Soros-funded organizations stepped into a number of recent illegal immigrant cases, attempting to hold-up deportations.

In the most recent case, a legal alum of Soros’ Open Society Foundation successfully evaded deportation for an illegal alien MS-13 gang member. The illegal alien will now be allowed to remain in the U.S.

Diego Puma twice filed unsuccessful petitions to block his planned deportations.

A Westchester County high school student who was detained by federal immigration officials hours before his senior prom was deported Friday, authorities said.

Diego Puma, 19, and his mother Rosa Macancela were shipped back to Ecuador three years after illegally arriving in the U.S. seeking refuge from horrific gang violence in their homeland.

In a statement, Immigration and Customs Enforcement said it booted out the pair “in accordance with their final orders of removal.”

Puma made national headlines after he was detained at his cousin’s Ossining home on June 8, the day of his senior prom.

The teen, who was juggling two jobs along with his school work, was hiding out at his relative’s house because ICE agents had arrested his mother the day before.

The mother and son were sent to detention facilities in Louisiana on Monday.

Good riddance to both. Bring the hammer down ICE. Illegal immigration into the US has to end and those here illegally must be removed, no exceptions, no excuses, no mercy.
