SARATOGA - An illegal immigrant is accused of what police are describing as a violent kidnapping and rape attempt.
It happened Tuesday morning around 3:45 in the area of Congress Street and South Franklin street in Saratoga.
Police say a 67 year old woman was waiting in the car for her husband to finish work when a man snuck up from behind and pulled her from the car.
They say he then dragged her along the sidewalk and tried to pull her into an unlit area while he punched and kicked her.
Someone heard her calls for help and called police.
The suspect Antonio Lopez-Bautista, 18, was arrested after a brief scuffle with officers.
Police say Bautista is an undocumented worker, employed by a Saratoga Springs restaurant.

On Tuesday, police in Saratoga Springs arrested Antonio Lopez-Bautista, 18, after he allegedly pulled a 67-year-old woman from her car and attempted to rape her. The attack occurred just before 4 a.m. as the victim sat waiting for husband.
Lopez-Bautista walked up behind the woman’s vehicle parked near the intersection of Congress and South Franklin Streets, opened the door and dragged her into a dark area. All the while, punching and kicking the woman, according to police.
Someone heard the woman’s cries for help and called 911.
By the time police arrived on the scene, the assailant was gone, but following a brief search, officers found the suspect hiding under some bushes.
The victim suffered cuts and bruises to her arms, face and neck. She was transported to Saratoga Hospital for treatment and later released.
Lopez-Bautista has been charged with second-degree attempted kidnapping, first-degree attempted rape, second-degree assault and criminal obstruction of breathing or blood circulation.
The Saratogian has reported that Lopez-Bautista has already been arraigned and Judge Jeffrey Wait ordered him held on $50,000 cash bail or $100,000 bond.
However, it was determined that Lopez-Bautista is in the country illegally and is currently being held at the Saratoga County Jail on an Immigration and Customs Enforcement detainer.

BALLSTON SPA -- A judge denied bail Wednesday for an illegal immigrant charged with attempting to kidnap a 67-year-old woman from a parked car and trying to rape her in Saratoga Springs.
Antonio Lopez Bautista, 18, pleaded not guilty Wednesday in Saratoga County Court to a nine-count indictment charging him with first- and second-degree robbery, first- and second-degree assault and first-degree sexual abuse, among other charges, in connection with the May 22 incident.
He could spend 25 years behind bars if convicted of the weightiest charges.
Police said he grabbed the woman at around 3:45 a.m., as she waited for her husband to get out of work. He dragged her across the sidewalk to an unlit area, punched and kicked her and attempted to rape her, police said.
A witness called police, who eventually found Bautista hiding in nearby bushes, police said at the time.
At Bautista’s arraignment, Judge Jerry Scarano denied bail at the request of prosecutors. District Attorney James Murphy said in a press release the federal government has a warrant out for Bautista, who would likely be taken into federal custody and possibly deported if released from the Saratoga County Jail.
Murphy said the past procedure was to deport illegal immigrants charged with crimes before their criminal cases were tried. That allowed them to escape punishment for their crimes, Murphy said.
If convicted, Bautista would be deported after serving his sentence, Murphy said.

Man Convicted of Sexual Assault
Written by Staff Report Friday, 07 June 2013 09:06

SARATOGA SPRINGS — Antonio Lopez Bautista, 20, was convicted by a jury last week of second degree kidnapping, first degree sexual abuse, second degree assault, all classified as violent felonies, as well as criminal obstruction of breathing for the assault on a Saratoga Springs woman just over a year ago. He could face up to 15 years in prison.
Bautista, who had lived at 10 Federal Street, Apt. 5, assaulted a woman waiting in her car for her husband, who was working at the time.
The brutal attack occurred behind the West Side Stadium Restaurant and Legends Cafe in the early morning hours of May 22. Bautista was seen in surveillance film from that night walking down the street and then ducking down into the brush to hide when the woman and her husband drove up. After the husband went in to work, Bautista snuck up to her vehicle and violently pulled her from the car, beating her about the head, neck and body, while she grasped the seatbelt in an attempt to prevent him from getting her out of the vehicle.
Bautista is shown overpowering her and dragging her more than 60 feet away from her car down Congress Street into a dark area where he removed her shirt and bra and pulled down her pants attempting to sexually assault her. The woman’s screams woke nearby neighbors who summoned police who responded immediately. Saratoga Springs Police Department officers apprehended him hiding near the scene minutes after the attack.
Bautista, who is an illegal immigrant, could receive a prison sentence of up to 15 years in state prison on the highest charge. Under the law, since the crimes occurred at the same time, the prison sentences must run concurrently. Sentencing has been scheduled for July 26 at 11 a.m.

11 Years in Prison for Man Convicted of West Side Sexual Assault

A 19-year-old man who sexually assaulted a 67-year-old woman last year was sentenced Monday in Saratoga County Court to serve 11 years in state prison.
Antonio L. Bautista, of South Federal Street, was found guilty by a jury in May of one misdemeanor count and four felony counts which included sexual abuse, assault, and attempted kidnapping, in connection with the May 2012 incident which occurred in the parking lot of the West Side Stadium Restaurant and Legends Cafe on Congress Street, just west of Broadway.
Bautista was additionally found to be in the country illegally and likely will be deported by U.S Immigration and Customs Enforcement after serving his sentence, said Saratoga County District Attorney James Murphy.
“If the law allowed it, this man should serve the rest of his life behind bars. He is violent, dangerous and evil,” said Murphy in a prepared statement. “He attacked a completely innocent woman in a parking lot who was minding her own business waiting for her husband.”
Authorities said Bautista overpowered the woman as she sat in her car waiting for her husband to finish work. He then dragged her more than sixty feet into a dark area of the parking lot, pulled off her clothes and attempted to sexually assault her before her screams alerted neighbors who called police.
Murphy said he was thankful for the bravery of the victim and the cooperation of the restaurant owners, whose parking lot camera captured the scene on video. -
