Prosecutor seeks new bail rules for immigrants

NEWARK — Morris County Prosecutor Robert Bianchi is asking New Jersey's Supreme Court to change the way it sets bail for immigrants facing criminal charges while they're due to be deported.




Bianchi says bail should be set higher in such cases to close what he says is a
loophole that allows someone to post bail, be released into federal immigration custody, and opt to be deported before facing charges.


Bianchi's request stems from the case of a Honduran immigrant who made bail, and was deported before facing sexual molestation charges.


Immigration officials say the case was an isolated mistake.
