Not Changing H-1B Rules, Says US, In Big Relief For Indian Techies: 10 Points

The tweak in H-1B visa could lead to the deportation of 750,000 Indian
WASHINGTON: The US today said it was not considering any change in H1B visa rules that would force half the Indian workforce in the country to leave. The clarification came in the wake of media reports of a proposed tweak in the laws, which triggered strong opposition from Indians, advocacy groups and a section of US lawmakers. The tweak, the report had said, was meant as part of president Donald Trump's "Buy American, Hire American" initiative, which could lead to the deportation of 7,50,000 Indians, most of whom were working as techies.

1. The US Citizenship and Immigration Services today announced that it was not considering "a regulatory change that would force H-1B visa holders to leave the United States by changing interpretation of section certain language in Section 104C of the American Competitiveness in the 21st Century Act (AC21) statute that states that USCIS may grant the extensions".
2. "Even if it were, such a change would not likely result in these H-1B visa holders having to leave the United States because employers could request extensions in one-year increments under section 106(a)-(b) of AC21 instead," Jonathan Withington, Chief of Media Relations at the USCIS, said in a statement. He also denied the change had been made under any pressure.
3. The H1B is a non-immigrant visa that allows US companies to employ foreign workers in areas that need theoretical or technical expertise. Thousands of Indian and Chinese workers are employed under it every year.
4. The H1B visa is issued for three to six years to employers to hire a foreign worker. But visa holders who start the process to obtain green card can often renew their work visas indefinitely.
5. On New Year, a report by US-based news agency McClatchy's DC Bureau had said the change in rules would stop the abuse and misuse of H-1B visas and end the provision of granting extension for those who have applied for Green Card.
6. "The act currently allows the administration to extend the H-1B visas for thousands of immigrants, predominantly Indian immigrants, beyond the allowed two three-year terms if a green card is pending," the report said.
7. The report had triggered widespread opposition by both the industry and several US lawmakers. The NASSCOM or National Association of Software and Services Companies, a trade association of Indian information technology, had warned that any disruptive move on the visa front would be detrimental for both India and the US.
8. In October, Union finance minister Arun Jaitley raised the issue during his talks with US Treasury and Commerce Secretaries and asked them to appreciate the contributions of Indian professionals to the US economy.
9. More than 1 million H1-B visa holders in the US are waiting for green cards. Many of them are from India and have been waiting for more than a decade, said Leon Fresco, who served as senior official of the US Justice Department in the Obama administration who now represents H-1B workers.
10. During his election campaign, President Trump had promised to tighten H-1B and L-1 visa programmes as part of his policy to generate jobs for domestic population. Since he took office in January 2016, the Trump administration has been talking of reforms in the H-1B visa scheme.

I am beyond pissed off! First, amnesty to the DACA invaders and now this. The destruction of this country is now set in stone, all because of Traitor Trump!!!

They must stop issuing more H1B visas to "techies". Who in the world believes for a second that some computer hack from India is better than American information system analysts? They aren't. This is a charade, a farce, a lie. We know for a fact that American Workers are being FIRED and replaced with these workers. It's an onslaught against the American skilled worker. Not sure how we fix this, but fix it we must. Maybe what they were planning isn't the right way to do it, maybe they have to back up and find a different way to do it, but it must be done. Don't quit trying to fix this problem. Americans should not be in competition with foreign workers on our own soil.

Not only stop issuing more of them, but they also need to let the current ones expire and send all these job-stealers back to India.

YES!! Absolutely, let the ones issued expire and get them out of here so American Workers can be REHIRED to work for the companies they sweat blood and tears to build. If anyone knows or is related to one of our American Information Systems Analysts, programmers, and "techies", they know what I'm talking about. They work on those computers until they lose their eyesight, they sit in those chairs until they have back problems, their minds are totally obscured by the program, the language, the computer, because of the mental energy it takes, which keeps them away from family and normal interactions. OUR AMERICAN WORKERS built this gawd damn industry and made everyone in the world involved in the ownership and stocks rich as snot, and then we discard them like garbage and replace them with .... people from ..... India??!! ARE YOU KIDDING ME?? THIS is not the American Way, THIS is not "who we are".

Now stop this treason and put our AMERICAN WORKERS back in their jobs at their normal rate of pay and benefits and HIRE AMERICAN to fill new slots. You traitors aren't hiring "talent" from India, you're hiring cheap labor from India. You can't fool US. Americans are smarter than that.

Back up, find a new way to solve this problem and GET IT DONE.

I witnessed this happen firsthand to my coworkers. Their lives torn apart by greed. It wasn't only IT that had their jobs eliminated, it was any back office job. No job was really safe. The jobs that were eliminated in the U.S., magically reappeared in India. I cringe any time I read or hear the word India. And I despised having to work with them.

The harm done by this strange relationship with India on these visas is immeasurable. You know it started when Hillary Clinton ran for the Senate in New York. She escorted and set up that labor network firm from India, Tatia. I think that's the name of it. A little podunk outfit that started out with like 10 jobs in a little office suite ... yet it made the news as if it was some huge deal. I found it odd at the time. Well, the fix was in, it's now a huge company made rich stealing jobs from American IT Workers.

Americans need to make a promise to themselves: We will never again elect anyone to federal public office who graduated from Yale University.

USCIS Drops Proposed Policy Change to End H-1B Extensions

USCIS has reportedly reneged on a proposed “Buy American, Hire American” regulation that would have prevented H-1B visa extensions beyond the six-year limit and likely stopped more than 100,000 foreign workers with pending green card applications from keeping their H-1B visas beyond the allowed two three-year terms, creating job opportunities for higher-skilled Americans.
“The agency is considering a number of policy and regulatory changes to carry out the President’s Buy American, Hire American Executive Order, including a thorough review of employment based visa programs,” USCIS Chief of Media Relations, Jonathan Withington said Monday. “What we can say, however, is that USCIS is not considering a regulatory change that would force H-1B visa holders to leave the United States by changing our interpretation of section 104(c) of AC-21, which provides for H-1B extensions beyond the 6 year limit.
“Even if it were, such a change would not likely result in these H-1B visa holders having to leave the United States because employers could request extensions in one-year increments under section 106(a)-(b) of AC21 instead.”
The Trump administration was met with backlash from politicians and tech companies after reports over New Year’s weekend that it was reviewing the American Competitiveness in the 21st Century Act, which currently allows for the granting of extensions to H-1B visas holders, in order to determine whether or not the language of the provision can be reinterpreted to stop making the extensions.
The National Association of Software and Services Companies, Immigration Voice and Compete America reacted to the announcement by commissioning their lobbyists and members to protest the proposal in an attempt to keep foreign workers instead of hiring Americans.
Additionally, Reps. Kevin Yoder (R-Kans.) and Tulsi Gabbard (D-Hawaii) responded to the administration’s reviewing of the act in a letter expressing their disapproval. The U.S. Chamber of Commerce also opposed the proposed legislation, saying that it would be “tremendously bad policy,” to prevent H-1B visa extensions beyond the six-year limit.
USCIS denied claims that the decision came as a result of opposition and said that “any suggestion that USCIS changed its position because of pressure is absolutely false.”
