Spring Valley man acquitted in rape case

NEW CITY — A Spring Valley man was acquitted Wednesday on a first-degree rape charge related to an incident with a 12-year-old Bronx girl earlier this year.



The jury came back deadlocked on a statutory rape charge related to the same incident.



The accused, 21-year-old Alex Martinez Nazarigos, is a Guatemalan citizen and is being held in Rockland County jail on a federal detainer by U.S. Immigration and Customs Enforcement.



His retrial on the statutory rape charge is scheduled for Jan. 6. Had he been convicted of first-degree rape, Martinez Nazarigos would have faced a maximum of 25 years in prison. The statutory rape charge carries a maximum of four years.
