NY student charged with threatening to 'shoot all' at school (update)

    Updated 12:59 pm, Saturday, February 24, 2018

ROCHESTER, N.Y. (AP) — A Rochester student accused of threatening online to shoot up a high school that she didn't attend has been arrested.

Abigail Hernandez pleaded not guilty Wednesday to making a terroristic threat, online court records show. Her lawyers' office was closed and not accepting phone messages Saturday, and no telephone number could immediately be found for her home.

Hernandez, 21, is in federal immigration custody, according to city officials. Deputy Mayor Cedric Alexander says Hernandez had obtained Deferred Action for Childhood Arrivals status. It allows some people brought to the U.S. illegally as children to stay.

A Feb. 15 comment on East High School's Facebook page vowed the commenter would come the next morning and "shoot all ya," ending with a vulgarity, authorities said.

"The threat referenced the shooting and sympathy of the school shooter in Parkland, Florida," Alexander said. The Feb. 14 attack in Parkland killed 17 people.

Although the comment wasn't in Hernandez's name, investigators traced it to her, authorities said. Police found a shotgun in Hernandez's home when they arrested her Tuesday, Alexander said.

It's unclear what school Hernandez has been attending. East High School Superintendent Shaun Nelms said she wasn't currently a student at his school but did attend another in the city. Rochester Police Deputy Chief La'Ron Singletary said he was unsure why East High was the target of the threat.

Nelms said in a letter to parents that he couldn't comment on the investigation but thanked police for their work.

Police: Undocumented Rochester student threatens East High on Facebook

A student with a shotgun made a terrorist threat against East High School on social media, according to Rochester police.

Abigail Hernandez, 21, is charged with making a terroristic threat, a felony. She is currently in the Buffalo Federal Detention Center in Batavia because she is an undocumented immigrant, Rochester Deputy Mayor Cedric Alexander said.

Police said, "The initial threat came from an anonymous Facebook account, which our investigators had to track down and determine the author of the Facebook account.” Hernandez allegedly made the threat at 5:08 p.m. Feb. 15, stating, "I’m coming tomorrow morning and I’m going to shoot all of ya bitches.”

The alleged threat was posted to the East High Facebook page. It has since been taken down.

Hernandez was arrested at home at 8:15 p.m. Feb. 20 after she made a "credible threat" against the school, Alexander said. Police recovered a shotgun in her home. "The threat referenced a shooting and sympathy with the school shooting in Parkland, Florida," Alexander said.

Hernandez is a student in the Rochester City School District, but she is not a student at East. Authorities declined to say where she is enrolled. Rochester Police Deputy Chief La'Ron Singletary said he was unsure why Hernandez allegedly threatened East High. He said a City School District member alerted police to the threat.

Hernandez was arraigned in Rochester City Court and bail was set at $15,000. Through an automated system called eJusticeNY, ICE determined Hernandez was an undocumented immigrant, Alexander said. Hernandez had "status under the DACA (Deferred Action for Childhood Arrivals) program," he added.

According to its website, "eJusticeNY is a browser-based application designed to give users from qualified agencies a single point of access to computerized information within and beyond New York state."

Singletary didn't reveal where Hernandez is from or how long she has been in the United States.

We remain very grateful to the Rochester Police Department for their partnership and for keeping us well informed throughout the investigation.
I would like to clarify information: The suspect is not a current East scholar, she attends another Rochester City School. Safety1st

Hernandez was transferred to federal custody. Federal authorities have taken over the case, police said.

The Rochester arrest is emblematic of a recent rise of threats on social media to schools across the country.

A Pennsylvania school district has closed schools for a third consecutive day as police continue to investigate threats made against students and staff.

The Central York School District canceled classes Friday following a series of threats on social media. Harrisburg schools and the Dauphin County Technical School also canceled classes on Friday due to similar threats circulating on social media.

Authorities have not provided specifics about the threats in each district, citing the ongoing investigations. Other schools in Pennsylvania have also received various threats via social media but have remained open.

The threats come in the wake of Valentine's Day shooting at a Florida high school that killed 17 people.

In a letter to parents, East High School Superintendent Shaun Nelms wrote, "Sadly, in wake of the recent Parkland, Florida tragedy, schools across the country have been grappling with social media threats intended to instill fear and anxiety."

He continued, "We remain very grateful to the Rochester Police Department for their partnership and for keeping us well informed throughout the entire process. Their presence on campus last week and their guidance on how to best keep staff and students safe during this efficient, successful police investigation, reiterates their ongoing support."

Additional resources were directed toward the school during the investigation, Singletary said. He said precautions were in place. "We're always evaluating any type of safety situation in regards to the schools," he said. "We're always in constant contact with the schools."

Alexander applauded the quick and decisive actions of the Rochester Police Department. He said the community, police department, and school district worked collaboratively here. Alexander said, "I just want to reiterate if you see something, say something, so we in law enforcement can act. That is exactly what occurred here in this incident."

Interesting how Rochester police could track her down when she didn't even use her real name while the FBI couldn't track down Cruz on YouTube who did. I don't think we're getting the straight story from the FBI. No surprise I guess, they've been having trouble with the truth for quite awhile now.

When I was in school at our school, you had to be out before you turned 20 so no one older than 19 was on campus as a student. You couldn't come to school pregnant either. You had to drop-out. We had to wear dresses or skirts, no shorts or slacks for girls. Boys had to wear jeans or saocks, button up shirts and all shirt tails had to be tucked in their jeans or slacks.

I think all taxpayer funded public schools need to wear a uniform of Khaki Pants, Tennis Shoes and Polo Shirt the schools choice of color.

Get this policy in place and overhaul the curriculum, bring back the Trades in Grades 9-12 and prepare these kids for the real world and get a job.

All illegal aliens needs to be removed from our schools, they cost us BILLIONS and should not be on our soil. Our schools are overcrowded and in disrepair. Stop giving them the freebies and they will stop coming here! These countries need to step up and take care of their own people.

We need to get rid of the trash wear and complaining about wearing the Flag on a shirt, no head scarfs and no religious fighting over what they wear. They do not like it then go pay for private school and wear what you want. If you want to wear religious garb...the go enroll in church schools.

We need to get back to EDUCATION, that is what our taxpayer dollars are paying for.

This country and these schools are so out of control it is sickening!

Rochester woman set for mental evaluation following shooting threat at high school

Jayla Jackson, Rochester Democrat Chronicle USA TODAY Network Published 11:43 a.m. ET July 23, 2018 | Updated 12:03 p.m. ET July 23, 2018

A Rochester woman who admitted to making terroristic threats against East High School earlier this year appeared in court Monday to be sentenced, but her attorney requested she go through a mental health evaluation instead.

In making the request, Michael Geraci, who represents Abigail Hernandez, said that there has been a "decline in her mental health" ever since Hernandez was remanded by federal officials.

Sentencing for Hernandez was rescheduled for August and results of the evaluation will determine her fate.

In February, Hernandez posted on Facebook and threatened to shoot students at East High School. She was arrested on multiple felony terrorism charges.

The 21-year-old special education student was charged in March with two counts of making a terroristic threat. She was a student at Edison Tech High School at the time and graduated while still incarcerated, last month.

She pleaded guilty to third-degree falsely reporting an incident, a misdemeanor, on June 27 in Monroe County Court. While in court, she acknowledged making two threatening Facebook posts against East High in Rochester as her stepfather and numerous other supporters looked on.

Hernandez was taken into custody by agents of Immigration and Customs Enforcement shortly after being released from the Monroe County Jail.

Hernandez is an undocumented immigrant who was brought to the United States from Mexico by her mother at age 3.

Removal proceedings were initiated shortly after her arrest and Hernandez was held for almost a month at the Buffalo Federal Detention Center in Batavia.

While Hernandez's parents have offered no specifics about her disability, they say she has special needs and is very dependent on her family.

Hernandez is scheduled to appear back in court at 9:30 a.m. Aug. 14.
