    PHILADELPHIA – A federal appeals court has vacated its ruling that declared a northeastern Pennsylvania city's illegal immigration law to be unconstitutional, setting the stage for a new round of arguments.

    The move by the Philadelphia-based 3rd U.S. Circuit Court of Appeals last Friday, reported by the Standard-Speaker, was expected after the U.S. Supreme Court ordered it to take another look at Hazleton's Illegal Immigration Relief Act.

    The appeals court had blocked Hazleton from enforcing regulations that would deny permits to business that hire illegal immigrants and fine landlords who rent to them, saying they usurped the federal government's exclusive power to regulate immigration.

    The Supreme Court threw out the appeals court ruling in June after the justices upheld a similar employer-sanctions law in Arizona.

    Officials in Hazleton have argued that illegal immigrants brought drugs, crime and gangs to the city of about 25,000, overwhelming police, schools and hospitals. The city's 2006 Illegal Immigration Relief Act inspired similar laws around the country, including the one in Arizona.

    A companion measure would require prospective tenants to register with City Hall and pay for a rental permit.

    The laws have never been enforced. Hispanic groups and illegal immigrants sued to overturn the measures, and a federal judge struck them down following a trial in 2007.

    Friday's order from the 3rd Circuit does not mean that Hazleton can begin implementing the laws. The district court's ruling remains in force.

    Appeals court to revisit statute as a result of Supreme Court ruling in Arizona case.

    A federal appeals court has set aside its decision invalidating Hazleton's controversial anti-illegal immigration law and will consider new arguments in light of a U.S. Supreme Court decision upholding a similar law in Arizona.

    The move comes nearly two months after the Supreme Court ordered the Philadelphia-based 3rd U.S. Circuit Court of Appeals to revisit its decision striking down Hazleton's ordinance, which punished businesses and landlords for hiring or renting to illegal immigrants.

    The court's order means its September decision finding the law unconstitutional no longer applies and sets the stage for attorneys to make new arguments. The court could potentially reach the opposite conclusion, allowing the city to enforce the law.

    Philadelphia (Philadelphia, Pennsylvania) Hazleton Mayor Joe Yannuzzi said he is ecstatic about the 3rd Circuit's decision to vacate its earlier decision and is confident the city will prevail in the wake of the Arizona case.

    "I'm glad it's being reviewed. We were convinced from the beginning that it was constitutional," Yannuzzi said.

    But both Yannuzzi and Allentown attorney David Vaida, who helped challenge the law, said it's difficult to say how the court will rule.

    "It is, in my view, totally impossible to predict what will happen," Vaida said.

    The 3rd Circuit ruled last September that the Hazleton's law infringed on the federal government's exclusive jurisdiction over immigration issues. But in May, the Supreme Court upheld an Arizona law that uses the same loophole in a federal law as Hazleton's to require businesses to verify employees' immigration status.

    Both the Arizona and Hazleton laws take advantage of a narrow exception in the federal Immigration Reform and Control Act, which restricts states' ability to fight the employment of illegal immigrants. The federal law prohibits states from imposing penalties on businesses that employ illegal immigrants except through licensing or permitting requirements.

    Vaida said there are significant differences between the Arizona law and Hazleton's ordinance.

    The Arizona law requires businesses to check the immigration status of new hires using a federal online database or face revocation of their business licenses. Critics called the sanctions the "business death penalty."

    The Hazleton law also requires landlords to verify the identity and immigration status of tenants. And it doesn't distinguish between businesses and casual employers, Vaida said.

    We see this brazen negligence to uphold the United States Constitution Over and Over and Over Again ..

    If it is now to the point that United States local governments are FORCED into passing laws to reinforce already existing laws that protect Americans from foreign invasion and then only to have them declared INVALID by some free-lance State or District judge, this country has absolutely no hope of surviving.

    The USSC simply telling these quisling judges to "revisit" these outright UNLAWFUL rulings tells us how utterly CONFUSED and TWISTED our legal system has been allowed to deteriorate into.

    In any other time in our history, the OBVIOUS ruling would have been to OVERRULE the offending judge and uphold the now desecrated U.S. Constitution, Article IV, Section 4 that guarantees Americans from being invaded.

    Not only do we now live in a police state, we also now live in a country where the very basest of institutional legal principles can be thrown out instantly for the sake of political correctness.
