According to a federal plea agreement, 50-year-old Linda Avila, an illegal alien, and unindicted co-conspirators, who were also illegal aliens, were involved in a criminal conspiracy in which they filed false income tax returns using forms they got from other illegal aliens in Virginia. The ringleader Avila altered the IRS' W-2 Forms illegal covered up the names, social security numbers, and addresses on the forms and entered the names and addresses onto the fraudulent documents and sent them to the IRS declaring numerous tax refunds. The conspiracy entailed the illegal alien migrant workers keeping a small fee and giving most of the cash to Avila.
Avila and her co-conspirators used post office box numbers and residential addresses to which she had access in order to acquire the refund checks. Once she got the federal refund checks, she provided stolen or fraudulent IDs to her co-conspirators so they could cash the checks. When the U.S. Attorney obtained an arrest warrant for Avila as well as search warrants, they were executed by the IRS and FBI at her Delaware home. The federal agents discovered and seized about 17 boxes of fraudulent tax records, as well as templates for fraudulent W-2 forms and identification documents on her personal computer.
The boxes of records seized contained more than 1,700 tax returns filed which were filed for six years, beginning in 2008 through 2014, for the tax years 2004 through 2013. The total amount stolen from the IRS -- based on the fraudulent returns examined by agents -- was $7.2 million.
A Norfolk federal grand jury on July 25, 2014, handed down an indictment against Avila on the charges of conspiracy to make false tax claims, false tax claims made against the United States and mail fraud. She will be sentenced by Judge Raymond A. Jackson of the Eastern District of Virginia on February 17, 2015 and she is facing 30 years in federal prison.
"What we do know for sure is that a few days after Avila pleaded guilty for operating this scheme involving illegal aliens swindling the U.S. government -- and American taxpayers -- our commander-in-chief announced with great fanfare said that he was sparing 5 million illegal immigrants from deportation. Their presence in the U.S. alone constitutes a violation of our laws, yet the president rewarded them with amnesty," stated officials with Judicial Watch. "Obama actually acknowledged this during his recent speech in Las Vegas where he celebrated the new order with his allies in the powerful open borders movement."
Obama himself admitted that illegal aliens are lawbreakers: “The truth is, undocumented workers broke our immigration laws,” Obama said. “They didn’t follow the rules in terms of how they were supposed to come.” He also noted, "As Americans, we believe in fairness –- the idea that if we work hard and play by the rules, we can get ahead." The truth is Obama's plan is not fair to people who play by the rules to come to America and" many of those millions of illegal aliens are "gaming the system,said former police investigator Manuel Cardoza, a Latino-American law-enforcement veteran.
