Official hopes to use racketeering law to recoup immigration costs

09:47 AM MDT on Sunday, July 10, 2005
    Associated Press

BOISE -- Canyon County Commissioners are considering suing local businesses that hire illegal aliens.

The commissioners hired Chicago attorney Howard Foster to advise them on the matter. Foster recently advised them to sue under the federal Racketeering Influenced and Corrupt Organizations Act, commonly called the RICO Act.

Commissioner Robert Vasquez won't say if or when the commission will file a lawsuit. But he says the county is losing money providing jail services, medical services and school to illegal aliens and that they wouldn't be in the region if they weren't finding jobs.

But legal experts around the country are watching to see what happens.

If Canyon County goes forward, it could be the first government in the nation to sue businesses under the RICO Act.

Steven Camarota with the Center for Immigration Studies in Washington, D.C. says that if Canyon County goes forward and wins, it could prompt an avalanche of similar lawsuits nationwide.
