    City's Immigration Laws Blocked Again

    Pennsylvania Case Had Gone to the Supreme Court



    A Pennsylvania city that inspired dozens of other localities to draft laws cracking down on illegal immigrants has been barred from enforcing its own ordinances by a federal appeals court, the third such decision in a week.

    The Third Circuit Court of Appeals in Philadelphia ruled Friday that Hazleton, Pa., ordinances passed in 2006 usurped the federal government's authority over immigration enforcement. Earlier in the week, the Fifth and Fourth Circuit Courts of Appeals issued decisions in Texas and South Carolina against city and state anti-illegal-immigration laws.

    The Hazleton ordinances sought to deny licenses to businesses that hire undocumented immigrants and fine landlords who rent to them. They were emulated by several states and cities that have spent millions defending similar laws in court.

    The Hazleton laws were struck down by a U.S. court in 2007. The appeals court upheld that ruling three years later. The U.S. Supreme Court returned the case for review in 2011, after it upheld similar Arizona laws. On Friday, the appeals court reaffirmed its decision. "We again conclude that both the employment and housing provisions of the Hazleton ordinances are pre-empted by federal immigration law.

    Accordingly, we will again affirm the District Court's order enjoining enforcement of these provisions," said the ruling.

    The American Civil Liberties Union, which joined with others in challenging the ordinances, said the ruling should end the legal battle. "This has always been a thinly veiled effort by a city to change immigration laws and fortunately the court once again saw through it," said Witold Walczak, legal director of the American Civil Liberties Union of Pennsylvania.

    The case may not be over, however. Mayor Joseph Yannuzzi said the city would continue to fight in court with the help of donations to pay for legal fees. Hazleton can ask for a hearing before the entire Third Circuit Court. If that fails, it can again ask the U.S. Supreme Court to hear an appeal.

    In 2006, then-Mayor Lou Barletta, now a Republican member of the U.S. House, blamed undocumented immigrants for crime and said they overburdened hospitals, schools and law enforcement in the working-class city in northeastern Pennsylvania.

    The ordinance struck down in the Dallas suburb of Farmers Branch would have required prospective renters to declare they were legal residents and subject landlords to possible criminal penalties if they leased to someone in the country illegally. The South Carolina law would have made it a crime for undocumented immigrants to "shelter" themselves from detection and for others to help them.

    These people need to just stop hiring them. They need to quit spending their money to support criminals. This is money being sent out of the USA, Money being spent in foreign countries, not in the local economy, stop frequenting places that hire them, stop using companies that hire them, temp services that hire them. If they are trying to get them out of the area, they need to support the community first. I have started doing this in my community. I don't care if it is a dishwasher i won't eat there. We paid a thousand more to have a roof put on because the crew that came to make an estimate couldn't speak English. I had a neighbor that fired a crew building his house because they didn't hire local American unemployed workers first. If it could catch on they will eventually leave the area federal government or not.

    But the federal government doesn't enforce their own immigration laws so many areas feel compelled to try to do something! Round and round it goes.....

    How much of this crap are we supposed to tolerate. How long will REAL Americans allow the black robed former hippie despots to push honest people's faces into their excrement and do nothing?

    I am really concerned that soon the honest citizens will finally explode into violent activity. People can only contain their anger for a limited time. The pressure builds until something bursts. I fear this; I worry for this country; it is government arrogant abuse of power like this that creates the conditions for violent revolution. This is the kind of thing that started the American Revolutionary War in 1775. God help us all of us if the average American (as opposed to kiddie Marxists with their let's play revolutionary) finally reacts in the only way these despot pukes seem understand, if the exploited, deceived, abused, manipulated and looted average citizen rises up, it will be horrible and it is this miserable excuse of a government will have caused it.

    I hear talk that I try to discourage; I am opposed to violence, but this government is creating a powder keg. We must stop them now to avoid something really ugly.
