Court: Southampton park can't serve day laborers

A State Supreme Court judge told the Village of Southampton yesterday that it can't use a park on County Road 39 as an informal hiring site for day laborers because the move violates a state law designating the parcel as parkland.
"This matter is not about constitutional rights, such as the First Amendment to the United States Constitution, nor about immigration, legal or otherwise," said the order New York State Supreme Court Justice Jeffrey Arlen Spinner issued yesterday, adding that "the commercial nature of a hiring site is also clearly inconsistent and incompatible" with designated use of the park.
Southampton Town bought the 6-acre parcel and gave it to the village for free as part of a tax-funded open space preservation program that began in 1998. Neighbors of the park on Aldrich Lane sued the village and the Town of Southampton in March to block the operation, saying the hiring site was an improper use for the land.
The case attracted attention from both immigration advocates and anti-immigration groups who occasionally filled the seats in the Riverhead courtroom. Lawyers for the Latino advocacy group Puerto Rican Legal Defense and Education Fund argued alongside the village in May, contending that closing the site violated laborers' rights of free assembly.
But Anton Borovina, the lawyer who brought the suit on behalf of the owners of four properties near the site, said his case "was never about day laborers."
"This is about how a government is required to manage a park," he added, calling the judge's ruling "a home run for us."
Mayor Mark Epley said he was "disappointed" by a decision he said leaves him no decent options for handling the hazards presented by men dashing into traffic to flag down contractors for whom they hoped to work.
"I thought what I was doing was a commonsense approach," Epley said. "The only thing I did was put a hedge up around where they were already standing . . . That is what the American People are screaming to mornons like Epley. "Common sense." Epley wouldn't know common sense if it hit him in the face.
I'm sick and tired of elected officials aiding and abetting the illegal invaders when they were elected by American Citizens to protect the interests of American Citizens.
