    Feds argue ending DACA was within Trump administration’s rights

    The feds argued Thursday that they shouldn’t be forced to disclose the behind-the-scenes deliberations that led to President Trump’s decision to end a program that protects young immigrants known as dreamers.

    Various states, including New York, and individual dreamers are arguing in lawsuits that the September end to Deferred Action for Childhood Arrivals (DACA) is illegal.

    Justice Department lawyers say the Trump administration was within its rights to wind down the program that shielded about 800,000 young people who arrived in the U.S. as children from deportation.

    Thursday’s arguments before a panel of Second Circuit judges spotlighted just one component of the legal battle: how much evidence and discovery material lawyers for DACA recipients and the states' coalition should be able to access.

    Justice Department lawyer Hashim Mooppan said the government shouldn't have to turn over "deliberative materials" and argued records related solely to facts are irrelevant.

    "Discovery is categorically and wholly improper in a case like this," he said.

    Anisha Dasgupta, a prosecutor with the New York State Attorney General's Office, said it’s not their goal to root around internal deliberations. But announcements of DACA's demise made mention of costs and burdens, she said — "some of that is going to be factual."

    The feds are also fighting over the potential release of DACA documents in a separate case that's in front of the Supreme Court. On Thursday, the Second Circuit judges asked if they should continue delaying a decision until the high court rules.

    Lawyers for the plaintiffs said there are different issues at play in the cases.

    The Second Circuit judges made no immediate ruling after hearing the arguments.

    Trust me Americans, these DACA people are not worth the cost or consequences of them continuing to be here any more than any other illegal alien. Their situation is not our fault, their predicament is not our problem, their futures are not our responsibility. They need to go, all of them, with their parents and every other illegal alien in the US.
