Previously deported Honduran man charged with illegally re-entering the U.S.

LOUISVILLE, KY - A federal grand jury in Louisville returned an indictment Tuesday against a Honduran national on charges of illegally re-entering the United States. The indictment resulted from an investigation conducted by U.S. Immigration and Customs Enforcement (ICE).

Danilo Fausto Chacon-Chapas, 40, was indicted Sept. 7 in the Western District of Kentucky. According to the indictment, Chacon-Chapas was encountered in the United States in January after having been previously deported. He had not obtained the consent of the Attorney General of the United States and the Department of Homeland Security to re-apply for admission back into the United States.

Chacon-Chapas was initially arrested by the Louisville Metro Police Department (LMPD) for criminal possession of a forged instrument, leaving the scene of an accident, operating a motor vehicle under the influence, failure to maintain insurance, no operator license and alcohol intoxication. Upon his arrest, a records check revealed that Chacon-Chapas had an extensive criminal history, and that he had been deported on June 15, 2006, to Honduras.

In the event of a conviction, the maximum potential penalties are 20 years imprisonment and a $250,000 fine. Chacon-Chapas faces deportation after serving any prison sentence imposed.

The case is being prosecuted by Assistant U. S. Attorney, Daniel P. Kinnicutt, Western District of Kentucky.
