Proud to support the rule of law and immigration (Rep. Lamar Smith)

By Rep. Lamar Smith (R-Texas) - 10/26/10 06:00 AM ET

For the second time this month, Rep. Luis Gutierrez (D-Illinois) has criticized the position of most Republicans and many Americans for favoring enforcement of immigration laws. Rep. Gutierrez uses one of the Democrats’ favorite assertions—that those of us who support enforcement are anti-immigrant. This argument is both ignorant and insulting.

Some Democrats in Congress could benefit from a refresher course on the founding principles of America—namely the rule of law. America is a nation that values and promotes freedom and the inherent rights of all mankind. However, America also is a nation that has established laws and guidelines to promote the common good of our society.

In other words, we are a nation of right and wrong. And part of the role of government is to promote policies that reward those who follow the law and punish those who break it.

Republicans support the rule of law because we believe it is important to have a fair and just government. We believe that immigrants who want to come to the United States and pursue the American dream should do so legally. That’s why America admits more than one million legal immigrants each year, far more than any other country in the world.

But in order to maintain a generous flow of legal immigration, we must prohibit illegal immigration. We should promote a fair immigration system that rewards those who follow the law and punishes those who do not.

Democrats resort to name-calling when it comes to the immigration debate because their position is unpopular. Democrats want to reward lawbreakers by granting amnesty to the millions of illegal immigrants already in the U.S.

But giving amnesty to illegal immigrants undermines those who have waited in line to come here legally. What incentive do they have to continue the legal process? Why bother coming to the U.S. legally if illegal immigrants are going to be rewarded?

The Democrats’ position creates an incentive for more illegal immigration. We’ve seen it before. The 1986 amnesty legalized an estimated three million illegal immigrants.

Rather than putting an end to illegal immigration, the mass amnesty only encouraged more. There are now estimated 12 million illegal immigrants in the U.S.

So after criticizing my pro-enforcement position, Mr. Gutierrez asks if you are like me when it comes to immigration. My answer to him is that millions of Americans believe in the fairness of the rule of law. And they’re tired of seeing their government officials ignore the very laws they have been elected to enforce.

Americans who are pro-immigration enforcement are not anti-immigrant. The assertions of Mr. Gutierrez and other Democrats are an insult to all Americans who believe that the laws of the land should be respected.

Refusing to secure the border has led to out-of-control illegal immigration. Last year alone, an estimated one million people succeeded in entering the United States illegally. That’s roughly the population of cities like Dallas, San Francisco, or Detroit.

Refusing to promote worksite enforcement has led to millions of Americans being out of work, while an estimated seven million illegal immigrants are in the workforce. Worksite enforcement could help make those much-needed jobs available for U.S. citizen and legal immigrant workers. But under President Barack Obama, worksite enforcement administrative arrests are down 77 percent.

In a week, the American people will decide if they want more of the same failed immigration policies and lax enforcement or if they want a government that promotes the fair and just enforcement of all laws.

My hope is that the millions of pro-immigration and pro-enforcement Americans come to the polls and stand up for the rule of law.
