Rep. Lamar Smith reintroduced today the Legal Workforce Act, H.R. 3711. The bill would require all employers to use E-Verify within two years, fulfilling NumbersUSA's top enforcement priority.

"Nearly 20 million Americans are unemployed or underemployed," Rep. Smith said in a statement.

"Meanwhile, seven million people are working in the United States illegally. By expanding the E-Verify system to all U.S. employers, this bill will ensure that jobs only go to legal workers."

"A recent poll showed that 70 percent of voters support legislation that makes it illegal for businesses in the U.S. to hire illegal immigrants."

While the bill would require all employers to use E-Verify within two years, Ag employers will have 30 months before they have to start using E-Verify for field workers.

The Legal Workforce Act:

• Repeals I-9 System: Repeals the current paper-based I-9 system and replaces it with a completely electronic work eligibility check, bringing the process into the 21st century.
• Gradual Phase-In: Phases-in mandatory E-Verify participation for new hires in six month increments beginning on the date of enactment. Within six months of enactment, businesses having more than 10,000 employees are required to use E-Verify. Within 12 months of enactment, businesses having 500 to 9,999 employees are required to use E-Verify. Eighteen months after enactment, businesses having 20 to 499 employees must use E-Verify. And 24 months after enactment, businesses having 1 to 19 employees must use E-Verify.
• Agriculture: Requires that employees performing "agricultural labor or services" are only subject to an E-Verify check within 30 months of the date of enactment.
• States as Partners: Preempts duplicative state laws mandating E-Verify use but retains the ability of states and localities to condition business licenses on the requirement that the employer use E-Verify in good faith under federal law. In addition, the bill allows states to enforce the federal E-Verify requirement and incentives them to do so by letting them keep the fines they recover from employers who violate the law.
• Protects Against Identity Theft: The bill allows individuals to lock their Social Security number (SSN) so that it can't be used by another person to get a job. It also allows parents or legal guardians to lock the SSN of their minor child. And if a SSN shows unusual multiple use, DHS is required to lock the SSN and alert the owner that their personal information may have been compromised.
• Safe Harbor: Grants employers safe harbor from prosecution if they use the E-Verify program in good faith, and through no fault of theirs, receive an incorrect eligibility confirmation.

Yes, and where is Trump the “brilliant” political strategists on this issue. You know the guy with all the devilishly clever plans to end illegal immigration by talking about it and caving in whenever he is challenged about it.

Even though constitutional experts have told us the courts have no authority to rule on immigration policy and Trump said so himself, still he obeyed the 9^th. Circuit Court when it put a hold on his ban on importing Muslims from terrorists hot spots. Why? Oh the Supreme Court gave him a tiny bit of what he wanted pending further review -- big deal, how very judicious of them.

The court order is illegal. Get it, illegal? He can lawfully ignore it. He does not need court permission to enforce his partial ban on some Muslims. By yielding to illegal court rulings he is helping to establish legal precedent that future courts will refer to and use to expand judicial power into areas where it has never been before.

Trump is proving a disaster on immigration. What is his problem? It looks like we will have to drag him kicking and screaming to do more than talk about immigration.

Get on the phone to the White House and hound him forever to veto any DACA amnesty or any other amnesty and sign an executive order making e-verify mandatory — now!

Again, I've tried to find out just what e-Verify does. If, as two employers told me, it verifies a SS# is valid - that is nothing but a loophole.

Unless it verifies it is a valid, issued by the US government, backed by a valid birth certificate, and can prove it is/was issued to the person presenting it - it's nothing.

Many SS# are valid - they are stolen. They were once issued to a real citizen. Some of them may be deceased, but it doesn't matter, they are 'valid'. Some are living, working people. Tell me how the government doesn't know when that happens. They do.

Again, this may be just another Texas politician talking tough because he knows he is covered - that it means nothing.

E-verify certainly beats the hell out of the alternative, which is nothing.

If it allows politicians as this one to pretend to the people this program actually does something, so by making it mandatory, it is a solution. It isn't. It just let's these employers get away with what they are doing.

An alternative, which won't happen, is to expand e-Verify is to actually make it weed out illegals and fake ID, and to force them to not only screen new applicants, but to check all present employees.

That might help.

New statistics on E-Verify suggest that keeping illegal aliens out of U.S. jobs is a goal increasingly within reach.

The Center for Immigration Studies has made available updated Department of Homeland Security numbers that make plain the effectiveness and growing use of the federal electronic system, through which employers can distinguish illegal aliens from legitimate job applicants.

Though its use still is voluntary at the federal level and required by only 12 states, E-Verify:

• Is now being used for one in four new hires nationwide, up from one in 19 in 2007
• Has already handled as many queries in 2009 as it did in all of 2008, twice as many as it did in 2007 -- and at the current rate will handle nearly 12.3 million inquiries by year's end

• Is in use at more than 511,000 work sites, up from 400,000 in January, with almost 135,000 employers participating.

And more than 96 percent of E-Verify uses automatically confirm a legitimate applicant's job eligibility in seconds. That's a good yardstick of accuracy because E-Verify's approximately 4 percent non-confirmation rate closely mirrors the percentage of illegal aliens in the U.S. work force.

E-Verify still has work to do in reducing "false positives." But the system clearly is working well. The more employers who use it, the better off the U.S. -- and its citizens seeking work -- will be.

I had lost my SS card and didn't carry one for many years. I knew my number, but it's only been fairly recently everyone wanted your SS#. It truly 'wasn't for identification purposes' as it is now.

We were thinking of moving to another state when my husband retired from a company. I decided I might need an actual card. I walked into the SS office in that state, gave them my SS#. In about a minute or two, the lady said, 'yes. you name is so and so, you born born on such and such date, your Mother was so and so, your Father was so and so, you were born in such and such town and state, your Mother was a housewife, your Father worked at such and such job and you are a caucasian female.

Now if they can get that information that quickly, the company could look at the person presenting the card and weed out a lot of people that way. If, however, it only states the card is a 'valid number', it really does nothing to prove the presenter's ownership of the number.

I don't how much good E-Verify will do, but it will do some, maybe even a lot. I support it because it's easy, it's fast and better than the totally stupid and ineffective I-9 form. What a joke that turned out to be.

E-Verify was originally established in 1997 as the Basic Pilot Program to prevent undocumented immigrants and other people violated immigration laws from obtaining employment illegally in the United States. In August 2007, DHS secretary Michael Chertoff and Commerce secretary Carlos Gutierrez announced several steps to expand employment eligibility verification. They started by requiring all federal contractors and vendors to use E-Verify. The Internet-based program is free and maintained by the United States government. Some states have passed legislation making it mandatory for certain businesses, other states require all employers use E-Verify.

E-Verify compares information from an employee's Employment Eligibility Verification Form I-9 to data from U.S. government records. If the information matches, that employee is eligible to work in the United States. Only if you use E-Verify and most companies don't. Why have the I-9 if you have E-Verify?

The I-9 is the source of the info the employer has to enter into the E-verify system.

And the I-9 is the paper copy that has to be kept on file as proof later on.

Just my take and consider it.

This government has for a long time and in many ways found a way to flim-flam the American people when we get riled up and demand action.

If it's welfare, they will find the least egregious case and a person who really needs it, but their 'papers aren't in order', throw them off welfare. They make sure to have the news media there to smear it all over the country.

If it's illegals, they will find a most sympathetic case and do the same.

They do this a couple of times, and the news media keeps it alive with all manner of interviews with activists and politicians, and suddenly things cool down and it's business as usual.

OR

They pass some law that is just a workaround. It usually sounds really good, and makes people think it does something. In reality, it's nothing - but if the government and news media pushes hard enough, we will decide maybe it does 'something'.

I believe that is what e-verify is.

Why then do we think this program does anything? With some teeth it might, and I'm thinking most people think it has teeth.

Again, if you have something in place that allows employers to hide behind, use to say they are 'complying', but it does nothing - then it's worse than nothing. If we realize we have nothing, then we might continue to push for something to be done. If, however, we swallow they are doing 'at least something', we stop.

Think about it, has the government done anything - anything to fix the illegal problem? The answer is no - so why would we accept this as any kind of aid to combating it?

We need to know our government is going to do nothing. They are fighting us tooth and toenail and have been for three decades. Anything they do will be against us and for the illegals/employers.

It's reverse discrimination what's going on. It's illegal special treatment and favoritism to accommodate criminal elements, criminal organizations, drug dealers, cartels, all foreign enterprises.

The biggest criminals are the politicians who have protected and supported this for over three decades and the employers who hire them.

Atrium Companies, the owner of Champion Windows and Advanced Containment Systems, agreed to settle a case with Immigration & Customs Enforcement (ICE) for $2 million as a result of a pattern and practice of hiring illegal aliens.

An I-9 audit, conducted by ICE – Homeland Security Investigations (HSI) in February 2011, revealed 269 of Champion’s 451-person workforce consisted of undocumented aliens. Many employees’ I-9 documentation had numerous “egregiously suspect” errors, such as misspellings of agency names and/or containing the words “novelty item.” In November 2009, Thereafter, at the request of the government, all of the undocumented aliens were terminated from Champion by the end of April 2011.

The ICE HSI investigation also revealed that, since acquiring Champion, management at Atrium had become aware of the possibility of large numbers of undocumented aliens being employed at Champion’s Houston factory.

A follow-up audit conducted by ICE HSI of Atrium Companies’ remaining 12 subsidiaries in May 2011 revealed that about 8.3 percent of the parent company’s 3,382 employees (excluding Champion employees) were undocumented aliens. All of these workers were terminated within a matter of weeks.

Atrium received multiple notices from the Social Security Administration (SSA) known as “no-match letters,” which indicated employee names and Social Security numbers did not match SSA records. The companies failed to take any corrective measures, resulting in the continued employment of the undocumented aliens.

The ICE announcement reported that since December 2010, Atrium Companies has revised its immigration compliance procedures to include new policies concerning the proper completion, retention and auditing of I-9 forms and for responding to SSA no match letters. Under the terms of the agreement, Atrium Companies must also hire a full-time chief compliance officer and continue to consult with immigration counsel in order to ensure the legality of its workforce.

Despite President Trump's tough talk on immigration, his administration does not appear so far to have been as aggressive as President Obama's when it comes to investigating businesses suspected of employing workers in the U.S. illegally. The number of investigations completed under Trump does not seem to have kept up with the pace under his predecessor. The federal immigration agency denies there is a slowdown.

Employees are supposed to fill out an I-9 form when hired, certifying that they can legally work in this country. Immigration and Customs Enforcement conducts I-9 audits of a business when it receives information indicating that the firm may be employing unauthorized workers, according to the agency.

An analysis of ICE I-9 audit data found that from 2010-2016, federal agents completed an average of 2,095 audits per year, or 175 per month.

From last October through the end of June, which includes the first five months of the Trump administration, the agency completed 420 I-9 audits – an average of 47 per month.

An ICE official said the agency is currently on pace to complete about the same number of audits as in previous years, implying that there are a lot of open investigations that will be completed between now and October.

When asked to provide the numbers for completed audits at the end of June 2015 and June 2016. ICE said it could not immediately provide that information.

Polo Morales, political director of the Coalition for Humane Immigrant Rights of Los Angeles, said he wouldn't be surprised if ICE completes fewer I-9 audits under Trump.

I-9 audits were common during the Obama administration, he said, characterizing them as "silent raids," because business owners simply turned over documents.

Morales noted that under Trump, ICE has shifted its focus to field operations at homes, apartment buildings, popular lunch spots and near schools. By prioritizing these more labor intensive operations, the agency may have fewer people to conduct I-9 audits, he said.

Yeah, that could be true, Trump's priorities have been different, he's going after the gangs, criminals, visa-overstays, welfare frauds, immigration document violators, drug runners, multiple misdemeanors, and other types of people. They desperately need more ICE agents.
