    Rep. Lamar Smith reintroduced today the Legal Workforce Act, H.R. 3711. The bill would require all employers to use E-Verify within two years, fulfilling NumbersUSA's top enforcement priority.


    "Nearly 20 million Americans are unemployed or underemployed," Rep. Smith said in a statement.

    "Meanwhile, seven million people are working in the United States illegally. By expanding the E-Verify system to all U.S. employers, this bill will ensure that jobs only go to legal workers."


    "A recent poll showed that 70 percent of voters support legislation that makes it illegal for businesses in the U.S. to hire illegal immigrants."


    While the bill would require all employers to use E-Verify within two years, Ag employers will have 30 months before they have to start using E-Verify for field workers.


    The Legal Workforce Act:


    • Repeals I-9 System: Repeals the current paper-based I-9 system and replaces it with a completely electronic work eligibility check, bringing the process into the 21st century.
    • Gradual Phase-In: Phases-in mandatory E-Verify participation for new hires in six month increments beginning on the date of enactment. Within six months of enactment, businesses having more than 10,000 employees are required to use E-Verify. Within 12 months of enactment, businesses having 500 to 9,999 employees are required to use E-Verify. Eighteen months after enactment, businesses having 20 to 499 employees must use E-Verify. And 24 months after enactment, businesses having 1 to 19 employees must use E-Verify.
    • Agriculture: Requires that employees performing "agricultural labor or services" are only subject to an E-Verify check within 30 months of the date of enactment.
    • States as Partners: Preempts duplicative state laws mandating E-Verify use but retains the ability of states and localities to condition business licenses on the requirement that the employer use E-Verify in good faith under federal law. In addition, the bill allows states to enforce the federal E-Verify requirement and incentives them to do so by letting them keep the fines they recover from employers who violate the law.
    • Protects Against Identity Theft: The bill allows individuals to lock their Social Security number (SSN) so that it can't be used by another person to get a job. It also allows parents or legal guardians to lock the SSN of their minor child. And if a SSN shows unusual multiple use, DHS is required to lock the SSN and alert the owner that their personal information may have been compromised.
    • Safe Harbor: Grants employers safe harbor from prosecution if they use the E-Verify program in good faith, and through no fault of theirs, receive an incorrect eligibility confirmation.

    Yes, and where is Trump the “brilliant” political strategists on this issue. You know the guy with all the devilishly clever plans to end illegal immigration by talking about it and caving in whenever he is challenged about it.

    Even though constitutional experts have told us the courts have no authority to rule on immigration policy and Trump said so himself, still he obeyed the 9th. Circuit Court when it put a hold on his ban on importing Muslims from terrorists hot spots. Why? Oh the Supreme Court gave him a tiny bit of what he wanted pending further review -- big deal, how very judicious of them.

    The court order is illegal. Get it, illegal? He can lawfully ignore it. He does not need court permission to enforce his partial ban on some Muslims. By yielding to illegal court rulings he is helping to establish legal precedent that future courts will refer to and use to expand judicial power into areas where it has never been before.

    Trump is proving a disaster on immigration. What is his problem? It looks like we will have to drag him kicking and screaming to do more than talk about immigration.

    Get on the phone to the White House and hound him forever to veto any DACA amnesty or any other amnesty and sign an executive order making e-verify mandatory — now!

    Again, I've tried to find out just what e-Verify does. If, as two employers told me, it verifies a SS# is valid - that is nothing but a loophole.

    Unless it verifies it is a valid, issued by the US government, backed by a valid birth certificate, and can prove it is/was issued to the person presenting it - it's nothing.

    Many SS# are valid - they are stolen. They were once issued to a real citizen. Some of them may be deceased, but it doesn't matter, they are 'valid'. Some are living, working people. Tell me how the government doesn't know when that happens. They do.

    Again, this may be just another Texas politician talking tough because he knows he is covered - that it means nothing.

    If it simply gives the law breaking employers a pass, or way around doing anything, I don't see it.

    If it allows politicians as this one to pretend to the people this program actually does something, so by making it mandatory, it is a solution. It isn't. It just let's these employers get away with what they are doing.

    An alternative, which won't happen, is to expand e-Verify is to actually make it weed out illegals and fake ID, and to force them to not only screen new applicants, but to check all present employees.

    That might help.

    So, I think it is worse than nothing, because it is really nothing, but our politician have people thinking it is something.

    New statistics on E-Verify suggest that keeping illegal aliens out of U.S. jobs is a goal increasingly within reach.

    The Center for Immigration Studies has made available updated Department of Homeland Security numbers that make plain the effectiveness and growing use of the federal electronic system, through which employers can distinguish illegal aliens from legitimate job applicants.

    Though its use still is voluntary at the federal level and required by only 12 states, E-Verify:

    • Is now being used for one in four new hires nationwide, up from one in 19 in 2007
    • Has already handled as many queries in 2009 as it did in all of 2008, twice as many as it did in 2007 -- and at the current rate will handle nearly 12.3 million inquiries by year's end

    • Is in use at more than 511,000 work sites, up from 400,000 in January, with almost 135,000 employers participating.

    And more than 96 percent of E-Verify uses automatically confirm a legitimate applicant's job eligibility in seconds. That's a good yardstick of accuracy because E-Verify's approximately 4 percent non-confirmation rate closely mirrors the percentage of illegal aliens in the U.S. work force.

    E-Verify still has work to do in reducing "false positives." But the system clearly is working well. The more employers who use it, the better off the U.S. -- and its citizens seeking work -- will be.
