The government accountability group Judicial Watch is calling on the Federal Election Commission to investigate the Democratic National Committee for hiring an illegal immigrant to work on the 2016 presidential election.

The conservative group announced Wednesday that it had filed a complaint with the FEC about the DNC’s decision to “knowingly” hire an illegal immigrant when federal law prohibits foreign nationals from participating in election-related, decision making activities.

Judicial Watch’s complaint is based on media reports about Cindy Nava.

According to a June 8 article in The Washington Post, Nava, an illegal immigrant from Mexico who has applied for Obama’s Deferred Action for Childhood Arrivals program, is “working with the party’s political operatives to craft policy platforms, research and broaden her political skills on social media at the national level.”

Judicial Watch argues that Nava’s employment with the DNC amounts to an unlawful contribution to a political campaign by a foreign national and grants her the prohibited ability to influence DNC decision making in 2016 elections. They also note that it is unlawful to hire an illegal immigrant.

“The act of hiring her is, in and of itself, an illegal act,” the group’s complaint reads. “These actions are particularly egregious because the DNC flagrantly promotes their illegal activities, lawlessness, and disrespect for the rule of law.”

The Judicial Watch is calling for a “full, formal investigation” into Nava’s employment with the DNC.

“No wonder this nation has a border and an illegal alien crisis. Not only do we have a major political party knowingly employing an illegal alien, but also openly boasting about it to the nation’s press,” Judicial Watch President Tom Fitton said in a statement.

“The DNC should be held accountable by the FEC for hiring an illegal alien in violation of both federal immigration and election laws. Frankly, the Justice Department and the Department of Homeland Security should also take appropriate law enforcement action,” he added.

Judicial Watch, the watchdog on federal government, is calling on the Federal Election Commission to investigate the employment by the Democratic National Committee of an illegal alien in potential violation of federal rules and regulations.

At issue are claims in the Washington Post that the DNC hired Cindy Nava “with full knowledge of what DNC chair Rep. Debbie Wasserman Schultz, D-Fla., termed Nava’s ‘undocumented status,’” Judicial Watch said.

“The news report details that ‘despite not yet attaining legal status, Nava is working for the Democratic National Committee as one of the crop of fellows from around the country helping the party organize ahead of a presidential election that President Obama predicted would feature immigration as a major issue,’” Judicial Watch said in an announcement Wednesday.

The DNC’s website lists only one fellowship, which offers participants “the chance to work substantively at the DNC on all aspects of women’s outreach from finance to political to communications and beyond,’” Judicial Watch said.

However, Judicial Watch said, the Code of Federal Regulations states, “A foreign national shall not direct, dictate, control, or directly or indirectly participate in the decision-making process of any person, such as a … political committee … with regard to such person’s federal or non-federal election-related activities, such as decisions concerning the making of contributions, donations, expenditures, or disbursements in connection with elections for any federal, state or local office or decisions concerning the administration of a political committee.”

Judicial Watch President Tom Fitton said it’s no wonder the U.S. has a border crisis.

“Not only do we have a major political party knowingly employing an illegal alien, but also openly boasting about it to the nation’s press,” he said.

“The DNC should be held accountable by the FEC for hiring an illegal alien in violation of both federal immigration and election laws. Frankly, the Justice Department and the Department of Homeland Security should also take appropriate law enforcement action.”

A WND request to the DNC for comment did not generate a response.

The Judicial Watch complaint to the FEC charges:

*“The Democratic National Committee knowingly hired a foreign national to assist, directly or indirectly, in setting the committee’s public policy agenda for its candidates, the national committee, and its associated organizations.”
*And the U.S. has banned non-citizens from election-related activities for longer than 50 years, a practice that has been affirmed by the U.S. Supreme Court.
*“On its face, the DNC’s decision to hire Ms. Nava is in direct violation of this provision. The FEC should investigate this matter further to determine the full extent of Ms. Nava’s responsibilities, her relationship to the policy making team, and her effect on the 2016 DNC election strategy.”
*That makes the DNC in willful violation of federal law.

Judicial Watch’s letter, addressed to the office of general counsel at the FEC in Washington, explained, “For all intents and purposes, Ms. Nava continues to remain within the United States without lawful status or presence.”

Citing the ban on foreigners, Judicial Watch said Nava’s employment “is in direct violation of this regulation and the empowering statutes.”

“Ms. Nava’s work, at minimum, is valued at$10.50 per hour worked. So, the sum of hours worked by Ms. Nava multiplied by this rate is a contribution to the DNC according to these regulations,” Judicial Watch said.

“This is, unquestionably and unambiguously, value under the empowering statute as interpreted by the FEC regulations.”

It cited a long list of similar precedents banning foreigners from participation.

“If one accepts as true Ms. Nava’s and the DNC’s statements to media outlets, Ms. Nava is helping the DNC craft its political message and communications to women, Hispanics and others. Her message is being communicated to these people groups in order [to] achieve political success in the 2016 presidential, congressional, gubernatorial and local elections.

“As the legal history of this provision makes unambiguous[ly] clear, this is a clear violation of federal law.”

An investigation, Judicial Watch said, “would shed light on Ms. Nava’s responsibilities in relationship to the DNC’s political purpose.”

“It would reveal whether the public statements by the DNC and Ms. Nava – that places Ms. Nava as a political adviser helping to craft the DNC’s 2016 political message – is political fluff designed to embolden a political base or an egregious and flagrant violation of federal election law.”

Judicial Watch said an appropriate next step would be “a full, formal investigation into the employment of Cindy Nava by the Democratic national Committee beginning in May or June 2015.”

The people in the DNC who hired the illegal alien should be arrested and prosecuted.
