Republicans move to force DACA vote in defiance of Ryan

House GOP moderates are defying Speaker Paul Ryan and trying to force a vote codifying Obama-era protections for young undocumented immigrants on the House floor.

Reps. Carlos Curbelo of Florida,Will Hurd of Texas, and Jeff Denham and David Valadao of California filed a discharge petition Wednesday that would trigger a series of votes on different immigration bills if 218 members sign on. If every Democrat supports the idea, which sources said is likely, 20 Republicans would have to break ranks and join them to trigger the votes.

Two sources intimately involved in the effort say at least 15 Republicans are ready to join. This week they picked up a significant GOP voice on immigration, Rep. Mario Diaz-Balart of Florida, who had been working hand-in-hand with Ryan and the White House on immigration.

Diaz-Balart has wanted Congress to codify Deferred Action for Childhood Arrivals but had been unwilling to go against the speaker until now. His support is likely to sway other centrist Republicans frustrated by the lack of action on Dreamers to sign the petition.

GOP leaders, meanwhile, are working behind the scenes to shut it down. Ryan has personally spoken with many of the centrist Republicans involved in the matter, according to one GOP leadership source. Staff have also made calls.

GOP leaders say now is not the time to get caught up in a controversial immigration fight that divides the party and the nation in the middle of an election year. They would prefer that the courts rule on DACA before Congress takes action.

The Supreme Court is expected to rule this fall on President Donald Trump’s decision to end the program earlier this year.

The discharge petition would trigger votes on Democratic, Republican and bipartisan fixes to DACA, with a “queen-of-the-Hill” approach. That means the proposal getting the highest number of votes over 218 would be adopted by the House. If there is a tie, the last legislation voted on would be adopted.

One of the proposals receiving a vote would be House Judiciary Committee Chairman Bob Goodlatte’s (R-Va.) conservative DACA fix that would curb legal immigration and crack down on sanctuary cities and child migrants, in addition to building a border wall and beefing up enforcement. The plan, which would also require employers to verify the legal status of employees, is more restrictive than the White House plan, and some Republicans would oppose it.

Other bills that would receive a vote include the Democrats’ favored Dream Act, which would codify the program and provide a pathway to citizenship for young adults who migrated to the United States as children. In addition, two bipartisan bills that include additional border security in exchange for DACA protections would also be taken up.

Washington (CNN)A group of Republicans are making good on their threat to attempt to force an immigration floor vote in the House -- potentially paving the way for a showdown among proposals to save the Deferred Action for Childhood Arrivals program.

The lawmakers on Tuesday signed what's known as a discharge petition -- a procedural maneuver that can bring legislation to the House floor if it is signed by a majority of House members regardless of whether it has moved through committee, as is traditionally the case for most legislation. If the petition were to pick up enough supporters, it would set up a floor debate on four different immigration measures as early as June.

The move is unusual for members of the majority party, who are effectively going around House Speaker Paul Ryan to set up a vote on legislation that GOP leadership has refused to call to the floor for a vote. Still, the members insist they are making an effort to be deferential to leadership, by leaving one bill open to the speaker's choosing.

Texas lawsuit brings DACA déjà vu


The effort is being spearheaded by three moderate Republicans who have long been vocal about trying to save DACA, a program that protected young undocumented immigrants who came to the US as children -- Reps. Will Hurd of Texas, Jeff Denham of California, and Carlos Curbelo of Florida. Curbelo officially introduced the petition Wednesday morning.

In an exclusive interview with CNN, the three moderates said the goal was to have a long overdue immigration debate without a predetermined outcome.

"This institution should be driven by courage, not by cowardice, and the goal should not be to suppress members from pursuing their legislative goals, it should be to empower each member, and that's what we're trying to do," Curbelo said. "The goal is to empower each member of the House, including the speaker, to advance the solution that each member believes is the best one for this challenge and to try to gain supporters for that solution. So this is not in defiance of anyone."

The petition has more than a dozen Republicans on it already, Denham said, and while the members would not reveal their list of supporters in advance, they did note the signatories come from across the ideological spectrum. Some more conservative members of the House could back the effort because it would allow a vote on a hardline immigration measure they've supported, and circumvent what conservatives often complain is overly restrictive procedural controls by leadership.

"I think you'll see many different caucuses throughout the House that are engaged in this debate that are focused on different solutions," Denham said. "I think it's our job.

Congress needs to do its job and be held accountable."

President Donald Trump sought to end the executive program put in place under the Obama administration last September, but a collection of court rulings have found Trump's action likely does not pass legal muster, and kept the program largely in place. A group of red states recently sued in a different court to try to have the program itself declared unconstitutional.

Lawmakers have sought to pass legislation that would enshrine the program in law, which would address critics who say it goes beyond the authority of the executive branch. But efforts to protect it in Congress have been unsuccessful.

7 states sue to end DACA, potentially jumbling its legal future


It remains unclear if the new effort will pick up enough support to force a House showdown. While it starts with a number of Republicans in support, it would still need to roughly double the number of GOP members signing on and pick up all Democrats in the House. Effective discharge petitions have been rare in House history, though not unheard of.

Democrats have insisted on a path to citizenship for DACA recipients and have opposed measures that they say are too aggressive or punitive to immigrants in return, though they have agreed to $25 billion in border security funding. Most Republicans have been split about a path to citizenship, and have insisted any such deal must include cuts to legal immigration and hardline measures to target illegal immigration, as well.

The discharge petition would support what's known as a "queen-of-the-hill" rule, which would bring four competing immigration-related bills to the floor for debate and a vote.

Denham and Hurd had previously announced the rule had the support of 50 Republicans and 190 Democrats, more than 20 members over the threshold for a majority of the House, but it's unclear if all of them will back the petition.

DACA left out of omnibus, limbo continues


Denham, Hurd and Curbelo's move Tuesday would pave the way for a floor vote on a hardline bill from Republican Reps. Bob Goodlatte, Mike McCaul and others that does not include a path to citizenship; a creation of a program like DACA without any border security measures from Democrats; a bill Ryan would offer; and a bipartisan bill from Hurd and California Rep. Pete Aguilar that would pair a path to citizenship with a direction to the administration to gain "operational control" of the border by the best means available. The rule also allows for the authors of the bills to change them, and the members expected all of the proposals would evolve before a floor vote -- especially to include language that would appropriate billions for border security.

GOP leadership has agreed to whip the Goodlatte bill, but it has failed to gain the support of enough Republicans to make it viable to pass the House. The President has backed Goodlatte's legislation and rejected all the other proposals put forth besides his own hardline plan. The reserved spot for the speaker could be any bill of his choosing.

The "queen-of-the-hill" procedure would mimic an exercise in the Senate earlier this year, when votes on four competing immigration proposals ended with none reaching the number of votes necessary to move forward, including the President's plan.

"This debate is too important not to have," said Hurd, who has roughly one-third of the entire southern border as part of his district, more than any other single member. "Let's have this debate on the House floor and let everybody bring their ideas to the forefront."

GOP moderates say they’ll force House votes on immigration

Republican lawmakers with moderate views on immigration defied party leaders and took steps Wednesday toward forcing election-year House votes on the issue, and a leader of the group said they had enough support to succeed.

The legislators want the House to vote on four bills including a bipartisan compromise, a conservative proposal and a liberal plan. Many of them face potentially competitive re-election races in November in congressional districts with large numbers of Hispanic, suburban or other voters with pro-immigration views.

With the bipartisan compromise considered likeliest to prevail, House Speaker Paul Ryan, R-Wis., has opposed permitting the votes and is expected to try to persuade GOP lawmakers to not sign on. Ryan has tried unsuccessfully to round up enough support for the conservative alternative and has said he doesn’t want votes on immigration legislation that President Donald Trump won’t sign.

But under the little-used procedure, if 218 House members — a majority of the chamber’s full membership — sign a so-called discharge petition, Ryan could not prevent a vote on whether the chamber should consider the immigration bills. The group filed the petition Wednesday and began collecting signatures.

The move comes nearly three months after efforts to pass immigration legislation collapsed in the Senate and never even reached a vote in the House. Trump initially suggested a willingness to bargain on the issue but turned down several compromise offers.

“Congress hasn’t done its job. So I’m going to force the issue,” Rep. Jeff Denham, R-Calif., a leader of the effort to force immigration votes, said in an interview. Another leader of the group, Rep. Carlos Curbelo, R-Fla., whose South Florida district is about three-fourths Hispanic, was first to sign.

In a meeting Tuesday with Ryan, Denham said he told the speaker he had the backing he needs. Under House rules, the earliest the chamber would vote on the group’s proposal is late June.

Asked about the moderates’ effort, Ryan spokeswoman AshLee Strong said, “We continue to work with our members to find a solution that can both pass the House and get the president’s signature.”

Denham introduced his proposal in March and has 248 co-sponsors, including virtually all Democrats and more than 50 Republicans. Ryan could well convince some Republicans to not sign the petition, but No. 2 House Democratic Leader Steny Hoyer of Maryland said in a brief interview that he expected Democrats to sign on.

Democrats have pushed this year to protect from deportation hundreds of thousands of young immigrants who’ve been shielded by the Deferred Action for Childhood Arrivals program, or DACA. That program lets immigrants brought to the U.S. illegally as children stay in the country for two-year, renewable periods.

Trump ended DACA, created under President Barack Obama, in March, though federal judges have kept it functioning during legal battles expected to last months.

A conservative House bill would let DACA’s “Dreamer” recipients stay in the U.S. temporarily, but also reduce legal immigration, allow construction of Trump’s proposed border wall with Mexico and crack down on “sanctuary cities” that don’t cooperate with federal immigration authorities.

The liberal “Dream Act” would give Dreamers a chance at citizenship.
The bipartisan compromise by Reps. Will Hurd, R-Texas, and Pete Aguilar, D-Calif., would offer a way for Dreamers to remain in the U.S. legally but not offer citizenship. It would take steps toward toughening border security but not specifically authorize Trump’s wall.

As the fourth bill, Ryan would be allowed to offer any plan he wants.

GOP lawmakers back discharge petition to force immigration votes

Fifteen House Republicans have signed on to a discharge petition filed Wednesday that is intended to force votes on a series of immigration measures — including legislation to protect so-called Dreamers.

The discharge petition, which is intended to force legislation from a committee, would lead to a floor vote if a majority of House members sign on to it.

Democrats have been pressing for an immigration vote in the House and would be expected to back the petition. If all House Democrats sign it, it would need 25 Republican signatories to force a vote.

GOP Rep. Carlos Curbelo (Fla.) filed the motion, and was quickly joined by Republican Reps. Jeff Denham (Calif.), Will Hurd (Texas), Mario Díaz Balart (Fla.) and David Valadao (Calif.) as initial sponsors.

All five are in competitive races this year. The Cook Political Report lists Curbelo's and Denham's races as tossups.

By midafternoon, 15 Republicans had signed the petition.

Reps. Ileana Ros-Lehtinen (Fla.) — who is retiring at the end of the year — and Mia Love (Utah) were the first new signatories.

They were followed by Reps. Charlie Dent (Pa.), Fred Upton (R-Mich.), Dave Reichert (Wash.), Mike Coffman (Colo.), Chris Collins (N.Y.), John Faso(N.Y.), Mark Amodei (Nev.) and Elise Stefanik (R-N.Y.).

Republicans who support immigration reform have grown increasingly frustrated at leadership over inaction on the issue, and the filing of the petition is an attempt to go around leadership to force a vote on the floor.

The discharge petition would specifically force a vote on a "Queen of the Hill" rule that would lead to votes on a series of competing immigration proposals. Which ever measure won the most votes would be the legislation approved by the House.

Speaker Paul Ryan (R-Wis.) and Majority Leader Rep. Kevin McCarthy (R-Calif.) dismissed the Queen of the Hill proposal when it was presented. That proposal garnered 248 co-sponsors, including 52 Republicans.

If the discharge petition does get 218 votes — per House rules, a discharge needs a majority of total membership regardless of vacancies — seven legislative days would have to pass before a floor vote.

The House would then vote on the measure on either the second or fourth Monday of the month. No House votes are scheduled on a second or fourth Monday until July 23.

In rejecting the earlier push for a vote, Ryan has stuck to a promise he made to immigration hard-liners not to call a vote on the issue unless half the Republican Conference supports the measure.

The four proposals are all meant as a legislative replacements for the Deferred Action for Childhood Arrivals (DACA) program, which President Trump rescinded in September.
Under DACA, around 690,000 Dreamers — immigrants who arrived in the country illegally as minors — were protected from deportation and allowed to work and go to school in the United States.

The Queen of the Hill rule that the GOP lawmakers have been pursuing would have the House choose between a hard-line proposal by Rep. Bob Goodlatte (R-Va.); the DREAM Act, a proposal that would give a path to citizenship to 1.8 million Dreamers; the USA Act, a measure that would pair the Dream Act with $25 billion in border security funding; and a yet-unnamed proposal of Ryan's choosing.

Trump originally gave Congress until March 5 to find a replacement for DACA, but courts blocked Trump's rescission, extending the program and, for the time being, rendering the deadline moot.

The “discharge petition” effort by 17 GOP House legislators to pass a no-strings ‘DACA’ amnesty is either politically insane or high-risk, pre-election fakery, says pro-American immigration reformers.

Whatever the purpose, the GOP leadership and President Donald Trump needs to shut down the amnesty before the GOP’s business-first wing can betray the GOP ‘s voters, said Mark Krikorian, director of the Center for Immigration Studies. “It seems to me they should be making clear to these guys that anybody who signs this will be cut off from [party funds] … [and told] ‘You’re dead to us,” he added.

In just one day, 17 GOP members have signed the discharge petition. If the vote count reaches 25 GOP legislators, then Democratic leaders can add all 193 Democrats to the signature list — and use the 218 votes to bypass the House’s GOP leadership to schedule a floor vote and then the passage of a no-strings amnesty.

The amnesty would likely include 3 million younger illegals who claim they were brought to the United States as children. But the amnesty would also allow the illegals to become citizens — and to then bring in their parents and foreign relatives into the country via unreformed chain-migration laws. Over the next 15 years or so, the discharge petition could deliver another 15 million Democratic-aligned voters into the United States, at a multi-trillion dollar cost to taxpayers and businesses.

The Washington Post reported that “several Democrats familiar with the thinking of party leaders said they expect virtually all House Democrats to join the petition once enough Republicans sign on.”

“There is a small group of so-called Republicans in the House who are willing to destroy the Republican Party in a delusional attempt to safeguard their own seats,” said Rosemary Jenks, policy director at NumbersUSA, which advocates for lower immigration. “It is lunacy, absolute lunacy,” she said, adding:

"How is assisting a big fat amnesty with zero enforcement — while we are in the middle of a border crisis! — will help them get reelected? … They are delusional."

"It is a slap in the face to [GOP] leadership, assuming that leadership does not want to pass a big fat amnesty and that is not a very safe assumption"

The leading advocates of the petition are facing tough elections in districts with many Latinos. They are Florida Rep. Carlos Curbelo, Texas Rep. Will Hurd, and California Rep. Jeff Denham.

Numerous polls show that GOP 2018 voters are strongly opposed to a no-strings amnesty that would lower wages and raise immigrant inflows. Those polls also show that immigration is a much higher priority for the GOP voters than other issues, such as the preserving the tax cuts.

The discharge petition may be just pre-election fakery, says Krikorian. “It could be the whole thing is fake,“ designed to not reach 25 signatures but just to boost a handful of endangered or retiring GOP legislators, he said. But if it is a fake, the discharge petition is a risky effort by the GOP leaders to help their endangered GOP legislators crawl over the finish line in November, he said, adding:

"If they have this in hand, and this is just for show without a prospect of it [getting 25 signatures and then] passing, I could live with that."

"But that is kind of risky… [because] maybe people will take the absence of objection from leadership as some kind of approval signal, so I would hope to see some critique of this [House Speaker Paul] Ryan or [Majority Leader Kevin] McCarthy.”

McCarthy is expected to take over the GOP leadership soon from Ryan, who is retiring.

The at-risk GOP candidates “are getting huge money from leadership PACs all kinds of Republican apparatus, and that money could be cut off in a heartbeat” said Jenks. “We are not seeing any kind of leadership [intervention] at all – where is Kevin McCarthy?”

By late Wednesday, the petition has been signed by 17 GOP legislators, well short of the 25 signatures that are needed by the Democratic leadership to force the amnesty vote.

WASHINGTON (Reuters) - A breakaway group of Republicans in the U.S. House of Representatives defied their leaders on Wednesday in an attempt to force bipartisan action on legislation protecting young illegal ‘Dreamer’ immigrants from deportation.



The rare move, by lawmakers who largely represent districts with significant Hispanic populations or are supportive of pro-immigration business interests, could potentially break a congressional stalemate on immigration.
It could trigger a House debate in June or July on four bills designed to replace the Deferred Action for Childhood Arrivals (DACA) program, which has protected some 800,000 people brought illegally to the United States as children, mainly from Mexico and Central America.
President Donald Trump wants DACA to end and has moved to clamp down on both illegal and legal immigration. The issue is already prominent in some November congressional election campaigns.

The Republican rebels include moderates and lawmakers whose districts have big Hispanic populations, such as Carlos Curbelo of Florida, Will Hurd of Texas and Mike Coffman of Colorado. Several face tough re-election bids.
However, many conservative voters are squarely behind Trump’s get-tough stance on immigration, making it potentially risky for Republican lawmakers representing such districts to join any insurgency forcing legislative action on DACA.

Last September, Trump said he was terminating DACA, a program set up in 2012 by former Democratic President Barack Obama. Courts are reviewing the termination.
Moves in Congress to replace DACA with legislation allowing DACA participants, known as Dreamers, to live and work legally in the United States collapsed in the Senate in February.

The Republican rebels are attempting to get a majority of House members to sign a petition that would force debate and votes on four DACA replacement bills. The one getting the most votes and at least a majority of the House would go to the Senate.

House backers of the insurgency said that if they can pull off the legislative feat, enough senators would vote for a bipartisan bill to ensure passage. Trump has proven to be erratic and many lawmakers have given up predicting whether he would sign or veto legislation.

Republican Representative Jeff Denham, a leader of the new effort, told reporters he and other rebels would prevail. The number of Republicans involved so far totals 17 of 236 House Republicans. Assuming all 193 House Democrats sign on, Denham would need another eight Republicans to advance legislation.

The effort is supported by Republican-friendly business interests, including the U.S. Chamber of Commerce, which encouraged the insurgency in a public statement.
House Speaker Paul Ryan has expressed support for doing some sort of “DACA fix” but has refused to stage votes on any bill.

Among the measures that could be debated is one that would protect Dreamers, while adding border security measures, although not the southwest border wall Trump demands.

Another would protect Dreamers from deportation and put them on a path to citizenship. A third would provide some protections, but would reduce legal immigration. A fourth bill would be one of Ryan’s choosing.
