    Hermilo Moralez, the 19-year-old being held in last week's death of his Pearland classmate, is in the country illegally, an immigration official confirmed Monday.

    "At the time of his arrest, he did not have a valid status here in the United States," said Greg Palmore, a Houston spokesman for U.S. Immigration and Customs Enforcement.

    Moralez, a citizen of Belize, was charged on Thursday with murder along with several lesser charges in the death of Josh Wilkerson, 18. Both were students at Pearland ISD's Pace Center.

    Immigration officials on Friday placed a federal hold on Moralez, which meant he could not be released on bail.

    "We put detainers on the individuals to ensure that before they are released we have the chance to interview them," Palmore said. "ICE officers have had a chance to interview him and determine he did not have a valid status here in the United States."

    Moralez is being held in the Brazoria County jail.

    Wilkerson's funeral and burial were Monday.

    Parker says city's ranking a real crime
    Study places Houston among most dangerous in the country

    Mayor Annise Parker lashed out at an controversial annual study released Monday that placed Houston among the most dangerous cities in the United States with a population of 500,000 or higher.

    "Crime Rankings 2010-2011," published by CQ Press, ranks Houston's crime as ninth-highest for big cities nationwide, placing it on a list with the likes of Detroit and Columbus, Ohio., although the city has less than half the crimes per capita of those atop the rankings. Violent crime in Houston fell 8 percent during the first half of this year and was on a pace to reach the lowest rate since 2000, records show.

    Parker said the data released by CQ Press are flawed because the publisher allows different cities to avoid counting certain crimes. New York does not count any robberies of property less than $1,000, she said, and Chicago frequently is not included in the list because it does not follow the standards requested by the FBI, which compiles the statistics.

    "Everybody likes to do rankings of cities, and when we like the results of the rankings, we put them on our websites and when we don't like the results, we critique them," Parker said. "It can create a false sense of security or an impression that a particular city has a bad crime situation, and it can have real consequences in terms of economic impact on that city."

    Misleading statistics

    Parker, who said she decided to speak out on the issue because of her role as chair of the U.S. Conference of Mayors' Criminal and Social Justice Committee, said the statistics also can be misleading because they use some arbitrary boundaries to define cities and metropolitan areas.

    The American Society of Criminology, and the FBI, which discourages the use of rankings in comparing different cities on the very website that makes the crime data widely available, agree with Parker.

    Not everyone, however, seems to mind the rankings. Sugar Land, for example, now can claim the mantle of "Safest City in Texas" because of them. The Houston suburb, with its estimated 81,000 residents, was 389th out of 400 cities that made the list, putting it in company with Orem, Utah, and Troy, Mich.

    "It helps our community," said Steve Griffith, Sugar Land's assistant city manager over public safety. "We take a lot of pride in that. I would expect that our Realtors are aware of that. As people are looking for a place to live, they want communities with great schools that are safe."
    Rankings defended

    Ben Krasney, a spokesman for CQ Press, defended the use of rankings, saying it provides context that can help people evaluate what the crime rate in their city means.

    In St. Louis, for instance, the murder rate is about 40 per 100,000, eight times the national average, he said. Anyone in St. Louis could use that data to conclude that the murder rate is quite high, Krasney said.

    "The cities that are on this list have crime rates per population that are several times the national average," he said. "So, they have a crime problem. ... Regardless of how you feel about the fact that this information is out there, the numbers are the numbers."

    CQ Press calculates crime rate rankings by comparing the rate of murder, rape, robbery, aggravated assault, burglary and motor vehicle theft with national averages.

    Cities with positive ratings register higher than the national average and negative scores are lower.

    This year, Houston registers only slightly higher than Dallas, and the reverse was true last year. San Antonio and Austin appear far lower on the list.

    A Brazoria County jury convicted Hermilo Moralez, 21, for the 2010 murder of Pearland teen Josh Wilkerson and sentenced him to life in prison Tuesday (Jan. 29).

    Wilkerson disappeared on Nov. 16, 2010 after offering his former classmate a ride home from school. Moralez, an illegal immigrant from Belize, later confessed to the murder and led police to his beaten and burned body in a remote field near Pearland.

    Moralez will eligible for parole in 30 thirty years.

    Moralez’ lead defense attorney Crespin Linton said he was disappointed with the trial outcome.

    “I wish the jury would have taken our client’s mental illness more into effect when they decided the sentence. I don’t think they took that into enough consideration along with his age,” he said when contacted by The Journal. “They could have accomplished the same thing with a 30-year sence. It would have taken him out of action for many years until he grows older.”

    Brazoria County District Attorney Jeri Yenne said she felt the sentence was justified.

    “I believe the penalty was appropriate and represented absolute justice. The jury did what was right,” she said when contacted by The Journal. “This was a vicious, brutal crime. In my mind as I believe the evidence showed, Josh was basically lured to a location and murdered. He was killed in a horrible way and there was a lot of suffering connected with his death.

    “This murder caused destruction on the family members’ lives and it also affect the entire community,” she said. “Our children need to be able to go to school and come home safely.”

    During the trial, it was revealed Moralez had been previously arrested as a result of stalking his ex-girlfriend. He was jailed on charges of harassment by Brazoria County Sheriff Department Deputies on May 30, 2010, less than five months before the murder.

    Yenni said it was unclear whyofficials from U.S. Immigrations and Customs Enforcement (ICE) didn’t identify him as an illegal immigrant and deport him at that time.

    “I understand that we do process a lot of illegal aliens here in Brazoria County and there are many people who are deported by U.S. Immigration and Customs Enforcement (ICE) and there are some who are not. I don’t know what was reviewed related to his immigration status at the time,” she said. “To my knowledge, ICE reviews the rosters at the jail on a fairly regular basis.”

    Yenni also praised the police officers who worked on the murder case.
    “The Pearland Police Department did a fine job locating Joshua Wilkerson. They did an excellent documenting the investigation. They recorded over 16 hours of interaction,” she said. “They went to great lengths to bring about justice for the Wilkerson family and it is important for every citizen to know that the police would do the same for them. The citizens of Pearland can be very proud of their police department. They’ve got great police protection.”
