    Sex Offender Deportee to be Booted Without Charges in Arizona

    A previously deported sex offender was arrested in Arizona after he illegally re-entered the United States. The Salvadoran man will be deported without being prosecuted for illegal re-entry.

    Agents in the Tucson Sector working out of the Three Points Substation discovered a young man from El Salvador who had illegally re-entered the United Sates, according to information obtained by Breitbart Texas. He was discovered near the town of Topawa, Arizona, about 10 miles north of the Arizona/Mexico border. They took the man into custody.

    While conducting a background and records check on the man, Milton Omar Perez, agents discovered the man had been previously convicted of sexual assault in 2006. The incident occurred in Colorado Springs, Colorado, officials stated. Perez has been processed and turned over to Immigration and Customs Enforcement’s (ICE) Enforcement Removal Operations (ERO) agents where he will be formally deported.

    Breitbart Texas contacted Tucson Sector Border Patrol officials to determine why Perez was not being prosecuted for felony illegal re-entry by a convicted sex offender. The official, who wished to remain anonymous, told this writer that following Perez’ 2006 conviction his illegal status was discovered. ICE placed an immigration detainer on him and picked him up upon his release from prison.

    An immigration judge allowed Perez to voluntarily depart the United States. The official said that because he was not formally deported, he was not in violation of the felony illegal re-entry by a sex offender statute.

    If Perez returns to the United States again, following this “expedited removal,” he will be subject to arrest and prosecution for illegal re-entry as a sex offender.

    Breitbart Texas has reported extensively on illegal alien sex offenders who have been arrested in the U.S. following illegal re-entry. The arrest of previously deported illegal aliens who have re-entered the U.S. is a common occurrence by Border Patrol agents along our borders.

    My question (one that will never be answered) is, why didn't the immigration judge "formally" deport him? My goodness, this is a guy that just completed a prison sentence for a sexual offense. It would be interesting to know what his sexual offense was. It could have been the rape of a child for all we know.
