SHENANDOAH - An unidentified man is in Schuylkill County Prison after the Shenandoah Police charged him with raping a 13-year-old girl at his home Thursday night.

The man, who speaks no English, was arrested as John Doe on charges of one felony count each of rape, statutory sexual assault; one misdemeanor count each of indecent exposure and corruption of minors; three felony counts of aggravated indecent assault and three misdemeanor counts of indecent assault.

Through an interpreter the man was arraigned Friday morning by Magisterial District Judge Anthony J. Kilker, Shenandoah, who set bail at $500,000 straight cash and remanded him to prison. Kilker scheduled the man's preliminary hearing for 10 a.m. Sept. 30.

At the start of the arraignment, the man identified himself as Ivan Rodriguez but Shenandoah Police Patrolman Jason R. Hayes, the arresting officer, told Kilker that the man previously said that name is false.

"We can't confirm his name at this point so we're going to go with John Doe," Kilker said.

When asked if he could post bail, the man told the court "I am a poor person I cannot afford this bail, I came to this country to work.

"'I'd like to get a lawyer and get out of this mess," he said.

Hayes charged the man, believed to be age 19, with raping the girl at his 234 W. Coal St. home around 7 p.m.

After receiving the report of a sexual assault, Hayes said he spoke to the girl at a Pottsville hospital where she said she was raped by a Hispanic man she knew as Iban.

The girl said she went to the 200 block of West Coal Street to meet and talk to Iban but after talking a short time he took her by the hand and pulled her into his home, Hayes said in his affidavit of probable cause. Inside the home the girl said Iban gave her a drink and later two white pills that she took willingly even though she did not know what type of pills they were.

Hayes said the girl told him that shortly after taking the pills she became "groggy and light-headed" and that Iban carried her to an upstairs bedroom, locked the door and raped her for about 15 or 20 minutes.

When the effects of the pills began to wear off, the girl said she got enough energy to hit the man in the head causing him to strike his head off of a wall, Hayes said.

Hayes said the girl then was able to grab her clothing and run from the home.

After speaking with the girl, Hayes said he found the man at the Redner's Warehouse Marker where he worked and took him into custody there.

During an interview, Hayes said the man could not provide any identification and told him that the name Ivan Rodriguez was fictitious and used only for his employment.

Hayes also said the man said his birth date was Sept. 22, 1989, but that could not be confirmed.

This is why we need mandatory E-verify for all employers. This area has a double digit unemployment rate.

FYI, Officer Jason Hayes is the long-time live-in boyfriend of Brandon Piekarsky's mother. Brandon was one of the teenagers charged as an adult in the non-hate crime accidental self-defense death of Luis Ramirez last summer.

God bless him for still doing his job without fear.
The flag flies at half-mast out of grief for the death of my beautiful, formerly-free America. May God have mercy on your souls.
