Judge dismissed from immigrant's suit

Jefferson County District Judge Robert Cahill has been dismissed as a defendant in a lawsuit filed on behalf of an illegal immigrant who claimed the judge and the City of Hoover conspired to deprive her of her constitutional rights.
Cahill was dismissed with prejudice Monday, meaning the claim can't be refiled against him, by U.S. District Judge Karon Bowdre, who cited judicial immunity in her ruling. The lawsuit, filed Dec. 28 on behalf of Anel Mancera-Ramirez, continues against Hoover and its police chief, Nick Derzis.
Bowdre also consolidated the Mancera-Ramirez case with another lawsuit filed in April on behalf of another immigrant who said Hoover police violated his civil rights through a pattern designed to oppress and intimidate immigrants in the city.
That case, filed on behalf of Eric Sandoval-Ortiz, named the city, Hoover Police Department, Derzis and officers Clint Blackmon, Jehad Al Dakka, Lee Tibbets and Dale Holsombeck. It did not name Cahill.
Sandoval-Ortiz claims the officers made him lead them to his Hoover apartment after a traffic stop and the apartment was searched without a warrant.
Mancera-Ramirez was charged with second-degree criminal possession of a forged instrument, a felony, following a May 2005 car accident in Hoover. She was taken to the Jefferson County Jail and placed under a no-bond order signed by Cahill.
Mancera-Ramirez, who does not speak English, stayed in jail for more than 20 days, spending most of that time in a cell with convicted inmates who did not speak Spanish, the suit says.
According to the suit, Mancera-Ramirez felt isolated and intimidated, and she pleaded guilty to the charge, leading to her deportation.
The suit cites the no-bond order as a component in an "unconstitutional scheme" aimed at ridding Hoover of Hispanic immigrants. Faced with the no-bond order and the prospect of an indefinite jail stay, the immigrants plead guilty, a move the suit calls coercion.
In her ruling, Bowdre said Cahill is "fully protected by judicial immunity. The acts of granting bail, denying bail and issuing no-bond orders are normal judicial functions for an Alabama district court judge."
Efforts to reach Cahill were unsuccessful.

HOOVER, Ala. (AP) — A federal judge has dismissed two lawsuits filed by Hispanics who alleged Hoover police violated their rights and the city did not admit wrongdoing, though its mayor signed a pledge that Hispanics would be treated fairly in Hoover.
U.S. District Judge Karon Bowdre dismissed the cases last week at the request of the city and the plaintiffs, lawyers for both sides told The Birmingham News in a Tuesday story.
Hoover City Attorney Mark Boardman said the city agreed in mediation to "cooperate with the plaintiffs' attorney to promote a sense of community awareness and fairness."
Boardman said the city did not agree to any specific policy changes or admit wrongdoing because of the lawsuits, filed in 2005 and 2006 by Anel Mancero-Ramirez and Eric Sandoval-Ortiz.
Hoover Mayor Tony Petelos said he signed a statement as part of the mediation that the city would be fair in its treatment of Hispanics and the city agreed to pay about $50,000 to cover some legal fees and expenses for the plaintiffs.
Attorney George Huddleston III, who represented the plaintiffs, said he believes the type of abuses that he said led to the lawsuits have stopped.
Mancero-Ramirez filed the first lawsuit in December 2005. Mancero-Ramirez claimed Hoover police searched her purse without a warrant after a traffic accident in May 2005.
The lawsuit alleged she was arrested and held without bond for possession of a forged instrument. She pleaded guilty and was released to federal agents and was deported to Mexico, according to the lawsuit.
Mancero-Ramirez claimed the city deprived her of her rights "for the purpose of brutally and disgracefully removing her from their community." In April 2006, Sandoval-Ortiz filed a lawsuit alleging that Hoover police violated his constitutional rights after he was stopped for traffic violations in February 2006.
Sandoval-Ortiz claimed he was forced to lead officers to his residence, which he alleged was searched without a warrant. He claimed that items found in the search led to a charge of felony obstruction of justice.
He later pleaded guilty to a misdemeanor charge of giving a false name and was sentenced to 12 months probation, according to the lawsuit. Sandoval-Ortiz claimed the police violated his rights to due process and equal protection, as well as guarantees against unreasonable searches and seizures.
U.S. Magistrate Judge John Ott suggested the two sides enter mediation after it appeared the cases could drag on for years, Huddleston said. Hoover police Capt. Jim Coker said there have been no changes in police policy as a result of the lawsuits.
"Our policy is to treat everybody fairly," Coker said.

I guess not all illegal invaders are living in "fear" and some have even found ways to come out from "under the shadows." La Raza should be made aware that filing lawsuits when your an illegal is a liberating and enpowering experience!

ILLEGAL ALIENS DO NOT HAVE CIVIL RIGHTS.
The Constitution grants Civil Rights to Americans. DUH!!!!!!!!!!!!!
Any judge that gets stupid and grants an illegal alien civil rights should be disbarred and an immediate judicial review called. Trust me, many will rise up and prevent that from ever happening.
