    AB 2076 would prohibit CA from using E-Verify - urge a NO

    Sacramento, Calif. -- The California Senate Committee on Labor and Industrial Relations voted today to send AB 2076-Fuentes to the full Senate for a floor vote that could happen as soon as tomorrow.

    AB 2076 would prohibit California state government and city and county governments from using E-Verify, the Department of Homeland Security’s electronic employment verification system (formerly known as the Basic Pilot Program) to determined work eligibility. The bill passed in the Assembly on May 29th, 43-31.

    Assemblyman Felipe Fuentes D-39 cited the error rate and discrimination as two reasons for opposing the use of E-Verify. Senator Mark Wyland R-38, who voted against the bill, pointed out that the initial tests of E-Verify showed an error rate of 5.1% and second attempts to verity showed the error rate was 0.7%.

    If the Senate passes AB2076, which is likely, it will be sent to Governor Schwarzenegger to sign or veto.

    Testimony to the Committee

    Thank you Madam Chair, I am Rick Oltman, National Media Director for CAPS, the Californians for Population Stabilization and we oppose AB2076.

    A few weeks ago President Bush signed an Executive Order calling for all contractors with the federal government to use the Electronic Employment Verification system, formerly known as the Basic Pilot Program and now called E-Verify, to ensure that their workers have the right to work in America.

    This is only right. When our tax dollars pay wages, those wages should be paid to American workers, defined as American citizens or legal immigrants with a work visa.

    Similarly, California taxpayers should not be paying the wages of illegal aliens working for the state as state employees or employees of contractors with the state of California.

    Using E-Verify is the logical way to easily ensure that workers have the right to work in our country and state.

    E-Verify probably does contain some errors as the bill analysis says. Secretary of Department of Homeland Security, Michael Chertoff claims it is 99.5% accurate. But, even if it is less accurate, time is given to allow the error to be corrected.

    Most errors involve transposing the numbers of a social security number, or failing to change your name after getting married.

    But, let’s not kid ourselves. AB2076 is about protecting illegal alien workers who would be indentified by E-Verify.

    AB2076 is a slap in the face to American workers. It is an insult to legal immigrants who waited in line and came to our country the right way.

    This bill, should it become law, would protect law breakers…all of them felons.

    This body should not be passing laws that help felons evade detection. And, it sends a message to the world that our immigration laws will be ignored by California state government.

    In summary, AB2076 is, with all due respect to Assemblyman Fuentes, a disgrace and not worthy of the California legislature.

    Should this get to Arnold's desk, the rest of the country really needs to help California with a deluge of emails, calls, and faxes. It worked before regarding the California Dream Act.

Arnold has a lot going on with these fires but his automated phone system to vote yes or no on a bill is easy. Please send the phone numbers to them also. Do the work for them. Give them the AB 2076 number. All they have to do is call.
