    ALBUQUERQUE, N.M. - A woman spoke out recently after she lost her unborn child during a car accident, and police said the man who caused it is a repeat drunken driver.

    Aileen Smith documented her growing baby bump with pictures, and glowed during each one. But she never thought 27 weeks would be the last time she would snap one.

    "We buried Demetri two days before my 26th birthday," she said.
    State police dash cam video captured the tragic scene on June 10. It was a car crash that officials said could have been prevented.

    Court records show the driver who was arrested, Ramon Hernandez, is a repeat DWI offender.

    Investigators said Hernandez admitted he had a few beers when he sped onto Interstate 25 in San Miguel County, and crashed into pregnant Aileen Smith, her husband, Zach.

    Doctors did an emergency C-section to try to save her child, but he died.

    Aileen shared a heartbreaking picture of the first and only time she held him. It shows her in her hospital bed, looking off-camera at her husband, and crying. She is cradling Demetri, who was wrapped in a blanket and had a bonnet on his head. He was already dead in that picture. She never saw him alive.

    "Demetri lived for about a minute, I was told," she said. "Died of a massive head injury and blood on the brain."

    Another picture shows her husband, Zach, saying a prayer for Demetri before handing his little body over to the Office of the Medical Investigator.

    The Smiths live in Colorado Springs, Colo., and were on their way to San Diego, C

    "It's just an incredibly lonely feeling," Smith explained. "You know, you can feel so supported by all your friends and family, and yet just feel so alone inside because that thing you were hoping for is gone."

    Aileen Smith's due date was Sept. 5.

    Hernandez remains in jail on a $25,000 cash only bond. State police said he is also on an immigration status hold. MVD confirmed that he has four prior DWI convictions.

    Hernandez hasn't had a license for more than a decade, and it is currently suspended because of unpaid traffic tickets.

    He was originally charged with injury to a pregnant woman, but because Demetri lived briefly outside the womb, Hernandez is now charged with Homicide by Vehicle DWI.

    Other charges include great bodily harm by vehicle, driving under the influence of intoxicating liquor or drugs (4th or subsequent offense), reckless driving, driving while license is suspended or revoked, and driving on roadways laned for traffic.

    DWI alien kills another child, I'm starting to lean towards the death penaty. Do judges/legislatirs think that a drunk is going to quit drinking or driving while intoxifcated because they were caught once or twice?

    He should have been deported the first damned time. No, just let him go until he kills someone. That poor family never even got to know their precious child. They will surely spend the rest of their lives wondering what if?

    We have many illegal drunken drivers who had previous arrests and deportations. Instead of the MSM shoving illegal rights down our throats at every turn, how about we keep shoving stories like this and repeat them over and over again. Over and over we have had to hear the same old 'They are only here to make a better life' crap. Illegals KILL innocent citizens. Thousands of citizens are losing their lives and government doesn't care. If it ever happens to one of their loved ones, will they care then?

    The government doesn't care. The illegal certainly doesn't care. Well we do!!!!!

    The MSM is very busy writing sob stories for illegal aliens and they rarely cover the US citizen collateral damage of illegal immigration. It seems that this Albuquerque TV station did and they deserve kudos. The look on the anchor's face when she says he was arrested 4 times previously is priceless.

    Thank the lobbying group the National Association of Hispanic Journalists, NAHJ for in my opinion, much of the skewed coverage of the news and the endless illegal sob stories. This group's mission , through their intern program, is to make sure that there are Hispanic reporters in every major news outlet, to tell the Hispanic side. So, we have people employed to pump out the biased reporting band they are considered not by ability but by ethnic heritage.

    Look it up!

    Another death that would have been prevented in America if our own government did even a bare minumum of immigration and border enforcement. This illegal alien was given the green light to break our laws and roam free until someone was killed and the chances are high this baby is not the only person this illegal alien has killed, robbed, raped, or assualted in some way or another.

    The death of this child lays at the hands of Bush and Obama and every politician, activist, and group that supports the illegal alien invasion of America.

    Illegal alien charged with killing baby in 5th DUI arrest

    Las Vegas, NM - On June 10, Zach and Aileen Smith were traveling along Interstate 25 in San Miguel County when a car driven by Ramon Hernandez, 43, collided with their vehicle.

    Aileen Smith suffered severe contusions to her midsection as well as a broken sternum. She was seven months pregnant with the couple's first child.

    She was taken to Christus St. Vincent Regional Medical Center in Santa Fe where doctors performed a C-section in an attempt to save the baby.

    Unfortunately, the injuries to the unborn child were too severe and he died only minutes after being delivered.

    "There was nothing they could do," Smith told The Albuquerque Journal. "I woke up from surgery and was reaching out asking for my son, and the nurse leaned over and told me that he had passed.

    The Smiths named the boy after Aileen's grandfather, Demetri.

    The baby died from a massive head injury and blood on the brain, according to a coroner's report.

    The couple briefly held the lifeless body of their child before the autopsy. His funeral was held only two days before Aileen's 26th birthday.

    Hernandez has been charged with homicide by vehicle DUI, great bodily harm by vehicle, driving under the influence, reckless driving, driving while license is suspended or revoked, and driving on roadways laned for traffic.

    The illegal alien has pleaded not guilty.

    According to the New Mexico State Motor Vehicle Division, Hernandez was convicted of DUI twice in 2000, once in 2003 and once again in 2004. He was driving on a revoked license at the time of the fatal crash.

    His license was reportedly suspended due to unpaid traffic tickets.

    Hernandez is currently being held on a $25,000 cash-only bond as well as an Immigration and Customs Enforcement detainer.

    New Mexico is one of a handful of states which issues driver's licenses to those here illegally.

    This is one of the saddest stories I have encountered. The pictures are heartbreaking and it didn't have to happen. It is another story of yet one more drunk illegal that has crawled into this country, pointed a car and killed someone, this time it was a tiny almost born, baby.

    It is not OK for citizens to be considered collateral damage for the good of Mexico. JMO

    Alleged DWI Claims Tiny Life

    They are powerful images. One is of an anguished young mother lying in a hospital bed holding her lifeless baby. The other is of the father, saying a prayer over the tiny boy just before handing him over to the Office of the Medical Examiner.

    It was the only time Zach and Aileen Smith held their son, whom they named Dimitri after Aileen’s grandfather.

    The child was born by Caesarean section in a Santa Fe hospital in an effort to save him, just hours after the Smiths were involved in a crash with an alleged drunk driver on June 10 on Interstate 25 in San Miguel County. Aileen was seven months pregnant at the time.

    Ramon Hernandez, 43, of Las Vegas — who has at least four prior DWI convictions — appeared in court on Tuesday on charges of multiple offenses.

    He was originally charged with felony DWI and causing injury to a pregnant woman. The latter charge was amended a few days later to vehicular homicide.

    “That’s the key issue that will have to be dealt with,” said Las Vegas, N.M., District Attorney Richard Flores. “Initially, the charge was injury to a pregnant woman, but subsequent to the accident, the baby was born, lived for about a minute and then died from his injuries.

    “The charges were amended after we conducted preliminary research and found case law that we believe allowed us to charge him with vehicular homicide.”

    State Motor Vehicle Division records show that Hernandez was convicted of DWI twice in 2000, once in 2003 and again in 2004. His driver’s license was revoked when the June crash took place.

    Flores said Hernandez was also being detained over immigration concerns.

    Hernandez pleaded innocent to charges in baby Dimitri’s death during the arraignment hearing in district court on Tuesday. He is in jail under a $25,000 cash bond.

    His attorney, Ben Andrew Mondragon, was in court Wednesday and did not return phone messages.

    The Smiths were devastated by the loss of their child.

    “It sets us back as a family in every way — emotionally, physically and financially,” said Aileen Smith during a phone interview Tuesday.

    The Smiths were traveling from their home in Colorado Springs to their native San Diego to attend a baby shower.

    “It was a big deal,” Aileen said. “This was the first child in my family since I was born, and the first child in Zach’s family. People were coming from all over.”

    The trip came to an end when Hernandez merged onto I-25.

    “We were going down 25 when a Pontiac came onto the freeway,” Aileen explained. “He merged, and we pulled completely across our lane, but he came in front of us and we T-boned him.”

    Although their Suzuki Grand Vitara remained upright, Aileen suffered contusions to her abdomen and a broken sternum. She was taken to Christus St. Vincent Regional Medical Center in Santa Fe, and doctors decided to perform a C-section in an effort to save the unborn child.

    “There was nothing they could do,” Aileen said. “I woke up from surgery and was reaching out asking for my son, and the nurse leaned over and told me that he had passed.”


    Aileen Smith, seven months pregnant, and her husband, Zach, were riding in this vehicle when it was involved in a collision with an alleged drunken driver in June near Las Vegas, N.M. The baby was born by C-section afterward but died quickly.


    The coroner determined that baby Dimitri died from massive head injuries and bleeding on the brain.

    Naturally, the Smiths are angry — not just over the needless loss of their child, but because of the circumstances.

    “I lived in Santa Fe for a year, and I knew the drunken driving laws were lax back then,” said Zach, who attended St. John’s College. “I come from California, where if you have a third DWI, they put you away.”

    Aileen finds it hard to understand how — if Hernandez has immigration issues — he “can be in this country for that long … and have so many offenses and still be allowed in the country,” she said. “It’s a terrible failure of the system.”

    Both said they would do what they can to advocate that the laws be changed in New Mexico, so the tragedy that hit their family won’t happen to anyone else.

    “This is the death of our son,” Aileen said. “We’ll follow this case completely through and do our best to see that justice is brought to Dimitri.”

    Flores said he would do the same.

    “It’s a tragic event, but we’re prepared to move forward and prosecute this case,” he said.
