NEW ALBANY, Ind. -- A Floyd County toddler suffered near-fatal abdominal injuries and his mother's boyfriend is charged with the crime.
Police said Juan Carlos Contreras-Juarez is an illegal alien and is charged with aggravated battery.
According to police, Contreras-Juarez was staying with the victim's mother when the incident happened.
The prosecutor's office described the 19-month-old's injuries as "extremely serious and disturbing in nature."
According to police documents, Heather Hutchins said her son, Ernesto Hernandez-Guzman Jr., was his "normal self" and had no "rash" when she left him in her boyfriend's care a week ago
Hutchins told investigators she left her Floyd County apartment for about 15 minutes on Jan. 7.
When she returned, her son was in bed for his nap.
According to police, Hutchins said that at around 7:30 p.m., she went into her son's bedroom and found him unresponsive, covered in vomit, and that he had a rash on his face, neck, and upper chest.
The boy was taken to Floyd Memorial Hospital by ambulance.
Dr. Tom Harris was the on-duty physician at Floyd Memorial. He told police the child had bruises all over his body and the rash was petechia, a condition that creates spots on the skin due to hemorrhaging.
The 19-month-old was then transported to Kosair Children's Hospital, where he was treated for serious internal injuries.
According to the report, Dr. Melissa Currie, head of Pediatric Forensics at Kosair told police that the boy's "injuries were caused by an intentional act of abuse and that this injury had to be inflicted by an adult."
Currie also said the toddler's injuries happened about six to 24 hours before he underwent surgery and that the injuries were, "likely caused by a punch or stomp to (his) abdomen."
Hutchins told police there were five other children at her apartment the day her son suffered his injuries, including her nephew, identified as SD.
In the court documents, SD told police "he saw Carlos punch EH in the stomach on Jan. 7."
In court Thursday afternoon, Contreras appeared for an initial hearing.
The judge asked for no outbursts from the victim's family and issued a no contact order.
Ernesto is in stable condition at Kosair Children's Hospital.
A cash bond for Contreras-Juarez has been set at $200,000.
The U.S. Immigration and Customs Enforcement has a hold on Contreras because he is an illegal alien so if he posts bond, he will be handed over the ICE office.
On Friday, Kosair upgraded the child's condition to fair.
