Student leader in South Texas faces deportation
Published 06:30 p.m., Wednesday, May 25, 2011 BROWNSVILLE, Texas (AP) — A student leader close to graduating from a South Texas university could be deported to Mexico for entering the U.S. illegally when he was a teenager.
Jose Arturo Guerra, a senior at the University of Texas at Brownsville and president of the student government association, was scheduled to have an immigration hearing Wednesday.
"I don't see why they would educate people here in the United Sates and spend like thousands and thousands of dollars and then just send them back," Guerra, 21, told the San Antonio Express-News.
His attorney, Jaime Diez, did not immediately respond to an interview request from The Associated Press on Wednesday.
Diez told the Express-News that Guerra came to the U.S. in 2003 on a visitor visa that expired two years later. Diez said Guerra's father wouldn't help renew the visa after Guerra went back to Mexico to visit.
Guerra decided to sneak back into the U.S. He was caught the first time, but not the second at age 15.
"For them to say that someone that is 15 can do something that the whole state of Texas would not recognize is crazy," Diez told the newspaper.
In December, Guerra tried to legalize his status through his mother's marriage to a U.S. citizen. That's when immigration officials learned he was in the U.S. illegally.
Diez told the Express-News the case comes down to allegations that Guerra claimed to be a U.S citizen when he was detained on a first attempt to cross the border. That could forever keep him from becoming a U.S. citizen.
An Immigration and Customs Enforcement spokeswoman told the Associated Press "ICE Enforcement Removal Operations cannot provide any details regarding the case of Jose Guerra since his case remains active in litigation".
Guerra is part of a generation of illegal immigrants who've lived almost a decade fearing deportation while also hoping Congress passes the Development, Relief and Education for Alien Minors (DREAM) Act. The legislation would create a way to obtain citizenship for students who came to the U.S. illegally before they were 16 years old.
The DREAM Act was passed by the U.S. House at the end of 2010 but failed to gather the necessary votes in the Senate. It has since been reintroduced after President Barack Obama called for a comprehensive immigration reform. Now, with Republicans controlling the House, its chances of passing are believed to be slimmer.
If deported, Guerra would be sent back to Ciudad Victoria, Mexico, where his father lives with a wife and family Guerra hardly knows.
The student, whose major is management and international business, has gained support from university officials and others.
"The plight of these bright, young students that are prepared to become productive contributors to our society has become a human tragedy," the university's president, Juliet Garcia, wrote to the newspaper when asked about Guerra's case.

Send him back to his home country with the education he stole from US taxpayers. The law forces us to educate these children of criminals, with our tax dollars, while our American kids suffer the consequences.
Ironic, isn't it how these people like to cite our laws when in their favor, but scream and throw tantrums when we enforce the laws they don't like?

This story differs from many of the SOB stories we hear where the dream kids are concerned. His last crossed by himself at age 15. He knew exactly what he was doing and he knew it was illegal. He wasn't one of those kids that was smuggled over at the age of two by his parents.

Americans were cheated out of an opportunity and the money that should have gone to an American was used by this illegal alien.
We don't need more illegals like him.
