Alert!! Federal Court Rules Against Arizona Immigration Law

Court rules against Arizona immigration law.

    April 11, 2011

SAN FRANCISCO (Reuters) – A U.S. appeals court upheld a preliminary injunction against parts of Arizona's controversial immigration law in a ruling released on Monday.

The 9th U.S. Circuit Court of Appeals ruled that a lower court did not abuse its authority by enjoining key sections of the state law that were challenged by the Obama administration.

Arizona's law would require police to determine the immigration status of a person they have detained and suspect is in the country illegally.

Republican Governor Jan Brewer's office had no immediate comment on the ruling.

A Justice Department spokesman also had no immediate comment on the ruling.

The case in the 9th Circuit is United States of America v. State of Arizona, 10-16645.

OK, now I am really confused. The question is, will other States be sued as well, since the States have enacted tougher immigration laws than Arizona An example, Utah, which has written into law a guest workers program and laws that requires "police to determine the immigration status of a person they have detained and suspect is in the country illegally." Which only the Federal Government has a lawful right to legislate such laws

Arizona immigration law: Court refuses to lift stay

    Apr. 11, 2011 10:08 AM
    Associated Press

A federal appeals court is refusing to lift a stay blocking major parts of a tough Arizona law targeting illegal immigrants from taking effect.

The 9th U.S. Circuit Court of Appeals on Monday turned down an appeal filed by Gov. Jan Brewer. Brewer asked them to lift an injunction imposed by a federal judge in Phoenix the day before the law was to take effect on July 29, 2010.

Ruling from 9th U.S. Circuit Court of Appeals

The U.S Justice Department sued to block the law. It argued it violates the constitution because enforcing immigration law is a federal issue.

Brewer's lawyers said the federal government hasn't effectively enforced immigration law and that the state law will assist federal authorities.

The law would require police to check immigration status when enforcing other laws, among other provisions.

Not surprised one bit! I knew this was coming.

One thing to think about though, The Supreme Court historically reverses the majority of all cases it reviews from the ninth circuit so there is still hope.

They are not called 9th CIRCUS for nothing. They legislate from the bench, and their political beliefs affect their decisions. Why even bother with these left wing judges Just skip the appeal and go to the Supreme court and quit wasting everyones time
