    (Reuters) - A Taiwanese exchange student who already pleaded guilty in state court to making shooting threats against the Catholic high school he was attending in Pennsylvania has now been hit with federal firearms charges, U.S. prosecutors said on Wednesday.

    An-Tso "Edward" Sun, 18, was charged in a federal criminal complaint issued on Tuesday with possessing ammunition while in the United States on a nonimmigrant visa, a spokesman for the U.S. Department of Justice said in a statement.


    Sun was sentenced earlier this week to between four and 23 months in jail followed by deportation after pleading guilty in Delaware County District court to making terroristic threats.


    He faces a maximum of 10 years in prison if convicted on the federal charges.


    An attorney for Sun could not be reached for comment by Reuters on Wednesday afternoon.


    Prosecutors say Sun, a Taiwanese national who was living with an American host family while studying at a high school in Upper Darby, Pennsylvania, told another student in March that he should stay home on May 1 because "I'm going to come here armed and shoot up the school. Just kidding."


    Sun's classmate, who has not been identified by authorities, reported the remark to school officials, who notified the Upper Darby Police Department.


    Investigators recovered a semiautomatic pistol, more than 1,000 rounds of ammunition, a crossbow and ballistic suit from Sun's bedroom and a duffel bag of his belongings given by his host mother to an attorney she retained for him.


    "Thanks to the tremendous work of our local, state, and federal partners, a potential school tragedy was prevented,” Marlon Miller, special agent in charge of the U.S. Department of Homeland Security Investigations Philadelphia Field Office.

    Really, only 4 to 23 months for planning to shoot up a school. That's less than Michael Flynn is facing for maybe lying to the FBI.

    PHILADELPHIA >> The 18-year-old foreign exhange student who jokingly threatened to shoot up Monsignor Bonner & Archbishop Prendergast Catholic High Schoo now faces federal gun charges.

    New charges were announced against An-Tso “Edward” Sun - who was just sentenced to probation and deportation in county court this week - at a press conference by U.S. Attorney William M. McSwain and Delaware County District Attorney Katayoun Copeland.

    Sun, who is from Taiwan, was charged yesterday by federal complaint with possessing ammunition while being in the United States on a nonimmigrant visa, which is a felony under federal law.

    Sun is a Taiwanese national who came to the United States to live with an American host family and study at the Catholic high school in the Drexel Hill section of Upper Darby, Pennsylvania.


    According to the complaint, on or about March 26, 2018, Sun told another student (identified in the Complaint as “Student 1”), “Hey, don’t come to school on May 1st ... I’m going to come here armed and shoot up the school. Just kidding.”


    “When someone makes an alleged threat of this kind, law enforcement must take it seriously and investigate all leads,” U.S. Attorney McSwain said. “Law enforcement is committed to doing everything in our power to stop an attack before it happens. We must keep our children and our community safe from harm.”


    Student 1 reported the incident to school officials, who then alerted law enforcement. According to the complaint, after the report of the threat, school officials and the Upper Darby Police called Sun’s host family to inform them of the alleged threat. Thereafter, Sun’s host-mother told police that she hired an attorney for Sun, returned home from work, and removed numerous items from Sun’s bedroom, placing them into a black duffel bag. She then allegedly brought this duffel bag to the attorney she had spoken with earlier in the day.

    According to the complaint, the duffel bag was later given to law enforcement and was found to contain the following:

    • One semiautomatic pistol, comprised of a Glock 19 9mm upper component (slide, recoil spring, and barrel) bearing serial number BESE280, and a Polymer80 brand lower component (frame) with no serial number;
    • 44 rounds of 9mm Aguila ammunition;
    • 615 rounds of 9mm Blazer Brass ammunition;
    • 225 rounds of 12 gauge Federal shotgun ammunition;
    • 280 rounds of 5.56mm IMI Systems ammunition; and
    • 423 rounds of 7.62 x 39mm TulAmmo ammunition.

    Upper Darby Police officers also executed a search warrant at Sun’s residence and seized from Sun’s bedroom: 20 rounds of 9mm Blazer Brass ammunition; one ballistic suit, including a vest, jacket and pants; one cross bow; seven arrows; and various firearm accessories and shooting equipment. Sun has been in custody in Delaware County since his arrest by Upper Darby police in March.


    If convicted, the defendant faces a maximum possible sentence of ten years’ imprisonment, a $250,000 fine, and three years’ supervised release.


    The case was investigated by Homeland Security Investigations, the Upper Darby Police Department and the Delaware County District Attorney’s Office, and is being prosecuted by Assistant United States Attorney Sarah M. Wolfe.


    Sun was initially charged with terroristic threats March 26.


    In county court Monday, Sun apologized for his actions, saying he had brought shame on his family and those who supported him.


    “During my time in prison, there was not one day where I was not regret what I did,” said Sun, who speaks English as a second language. “Now I cannot even graduate with my friends or go to the college I always wanted to, because of my own mistakes. I’m just really sorry. I’ll make sure this never happens again.”


    Defense attorney Robert Keller said his client had met with a psychiatrist who found he did not meet the criteria for any clinical diagnosis and does not pose any substantial risk to others.


    Sun had planned to enter Temple University and had hopes of joining law enforcement, according to Keller.

    He has instead agreed to be voluntarily deported after entering an open plea to terroristic threats, a misdemeanor of the third degree.

    Another foreigner who needs to serve time in FEDERAL TENT CITY on FEDERAL LAND with a panel of FEDERAL JUDGES!

    This goes for all foreign criminals who violate our Immigration and Visa laws. Put all refugees, illegal aliens, student visas, TPS, asylum and non-citizens IN Federal Tent City.

    No amenities and NO visitors except via Skype!

    ICE removes Taiwanese exchange student who threatened to shoot up school

    PHILADELPHIA — U.S. Immigration and Customs Enforcement’s (ICE) Enforcement and Removal Operations (ERO) officers removed a citizen of Taiwan who was sentenced after pleading guilty to one count of being an alien in possession of ammunition, following a Homeland Security Investigations Philadelphia, investigation with the assistance of the Upper Darby Police Department and the Delaware County District Attorney’s Office.

    “Returning individuals like Mr. Sun continues to be among ICE’s highest priorities,” said Simona L. Flores, field office director for ERO Philadelphia. “ICE continues our commitment to making our communities safer by removing threats to our public safety.”


    An Tso Sun, 18, also known as “Edward Sun,” a Taiwanese exchange student, came to the United States in Aug. 26, 2017, on an F-1 visa to be a student at a high school in Upper Darby, Pennsylvania. While attending school, he resided with a host family in Upper Darby. Beginning in October 2017, Sun visited a Philadelphia shooting range on multiple occasions, where he fired a variety of firearms, including semiautomatic rifles and shotguns. Over the next few months, Sun purchased hundreds of rounds of ammunition from online vendors and directed that they be shipped to his host family address. In January 2018, Sun purchased pistol components from multiple online vendors and assembled them to create a functioning homemade pistol.


    On March 26, 2018, after the school bell rang at the end of the day, Sun made the following statement to a fellow student: “Hey, don’t come to school on May 1st. . . . I’m going to come here armed and shoot up the school.

    Just kidding.” That student reported the incident to school officials, who then alerted law enforcement officials. Upper Darby Police officers executed a search warrant at Sun’s residence and seized from Sun’s bedroom 20 rounds of 9mm Blazer Brass ammunition; a ballistic suit, including a vest, jacket and pants; a crossbow; seven arrows; and various firearm accessories and shooting equipment. Sun’s host-mother, “V.H.,” was later interviewed and explained that, prior to the search, she had removed a number of items from Sun’s bedroom, including bullets and firearm-related items, and had given the items to an attorney.

    Law enforcement took possession of those items, which included, among other things, a homemade semiautomatic pistol, two AK-style 30-round magazines with ammunition, two AR-15-style 30-round magazines with ammunition, and numerous additional boxes of ammunition, totaling over 1,600 rounds.


    On Nov. 19, 2018, a United States District for the Eastern District of Pennsylvania sentenced Sun to time served (approximately five and a half months) and required him to forfeit the ammunition in his possession.

    Additionally, the Judge ordered that Sun be transferred to the custody of ICE ERO and removed from the United States. Under federal law, Sun’s conviction will operate as a permanent bar to re-entry to the United States.


    On Nov. 21, 2018, ERO Philadelphia arrested Sun upon his release from the Philadelphia Federal Detention Center and placed him in ICE Custody at the York County Prison, in York, Pennsylvania pending removal.


    ERO officers removed Sun from the United States and turned him over to Taiwanese authorities without incident.

    People come here on Student Visa's and are required to apply for those Visa's. This person needs to be deported.

    Illegal aliens come here and have NO Student Visa to attend our schools.

    It is discrimination against those waiting in line, applying to attend our schools.

    ALL ILLEGAL ALIENS NEED TO BE BOOTED OUT OF OUR TAXPAYER FUNDED SCHOOLS. THEY HAVE NO STUDENT VISA!

    THEY SHOULD NOT BE IN OUR COUNTRY, LET ALONE TAXPAYERS PAYING FOR THEIR SCHOOL!

    WE HAVE LAWS THAT APPLY TO EVERYBODY ELSE...AND THEY DO NOT APPLY TO CRIMINAL TRESPASSING ILLEGAL ALIENS!

    CLOSE THESE LOOPHOLES AND GET THEM OUT!
