    The US government has opened an investigation against two of the biggest Indian outsourcing companies for possible violations of H1-B visa rules, according to a media report.

    The Department of Labour has opened the investigation against Tata Consultancy Services and Infosys for "possible violations of rules for visas for foreign technology workers under contracts they held with an electric utility Southern California Edison," the New York Times said.

    The power company had recently laid off more than 500 technology workers amid claims that many of those laid off were made to train their replacements who were immigrants on the temporary work visas brought in by the Indian firms senators Richard Durbin of Illinois and Jeff Sessions of Alabama announced the investigation after they were notified by the department, the report said.

    The move by the Labour Department comes days after the NYT had reported that hundreds of employees at entertainment giant Walt Disney were laid off and replaced with Indians holding H1-B visas.

    About 250 Disney employees were told in late October last year that they would be laid off and many of their jobs were transferred to immigrants on H1-B visas brought in by an outsourcing firm based in India, the report had said.

    It had also cited the layoffs at the Southern California Edison power utility, saying that the layoffs are "raising new questions about how businesses and outsourcing companies are using the temporary visas, known as H-1B, to place immigrants in technology jobs in the United States."

    Media reported that two of the biggest Indian outsourcing companies are under the radar of the US government for violating the H1-B visa rules.


    According to the reports, US federal government has initiated an investigation through the department of labour against Infosys and Tata Consultancy Services as they violated the existing rules of obtaining visas for foreign technology workers under contract with the electric company – Southern California Edison.


    Reports added that the power company had recently laid off more than 500 technology workers amid claims that many of those laid off were made to train their replacements who were immigrants on the temporary work visas brought in by the Indian firms.

    Fines are just another cost of doing business, but the corporate executives of those H-1B fraud perpetrators don't want to go to jail. So send them to jail.

    Won't make a difference without 1. Execs going to jail. 2. Those agencies like Tata and Infosys being banned from business in the US along with criminal charges against whoever is the top dog of the agency inside the US. 3. Removal of all the visa's for those companies and deportation of those workers.

    All I see ever happening is fines and that is a normal cost of doing business. The money saved by foreign workers is 10-100x greater then the fine that may be imposed. The foreign workers will keep their visa's and jobs, and infosys and tata will continue business as usual.

    I think that tide is turning and if they're not put down between now and 2016, it will be done in 2017. These thieves are going down, Americans will not tolerate this. It's not an easy fix because we need law enforcement to do it, and it takes time to replace the corrupt employees of these agencies that have allowed this to continue for so many years.

    We also need a simple little law that invalidates as null and void any provision of an otherwise legal corporate agreement that conceals through confidentiality clauses any immigration, labor or civil rights violations as a condition of payment or employment and prohibits all employers as part of an involuntary separation agreement to force the terminated employee to train foreign worker replacements as part of the agreement and their separation compensation.
