Sued for letting children of illegals pay in-state tuition

Unruly children know the drill. When Mom says no, run to Dad. Play one off the other. Hope they don't confer and realize they are being punked.
The same theory is being tried by groups opposed to some immigrant children getting a college education.
Kansas is Mom. Texas is Dad.
Both states have addressed one of the saddest situations of our out-of-wack immigration policies; the children of illegal immigrants.

I sent her a note with a copy of Title 8 Section 1623 of the United States Code stating:
In general
Notwithstanding any other provision of law, an alien who is not
lawfully present in the United States shall not be eligible on the
basis of residence within a State (or a political subdivision) for
any postsecondary education benefit unless a citizen or national of
the United States is eligible for such a benefit (in no less an
amount, duration, and scope) without regard to whether the citizen
or national is such a resident.
Maybe she is smart enough to understand it. The judge in Kansas was wrong and his moronic decision will be reversed on appeal.

A three year residence requirement is a wink wink invitation. It says that even if your parents are paying little or no taxes and your family is residing here illegaly you can get benefits if you hide out for three years. A typical family of illegal immigrants may be making
$25,000 paying $2,500 with three children each getting $10,000 in free education through K-12. Now having stuffed on American taxpayerdollars they are seeking desert.
If a parent breaks into a home and steals a panel screen TV would you let that parent keep it in their house on the basis that
the child they stole it for would be deprived.I support enforcement and see its lack as bad for the 3rd World as well. Remittances are now mostly spent on consumption not production assets.
