Trump Admin Creates Reporting Tool for H-1B Abuse

The Trump Administration created a tool for Americans to report H-1B visa fraud in their workplace.

United States Citizenship and Immigration Services (USCIS) announced a tip-line for Americans who are the victims of foreign worker outsourcing through the H-1B visa in a news release.

“Information submitted to the email address will be used for investigations and referrals to law enforcement agencies for potential prosecution,” the release stated.

Every year, more than 85,000 Americans potentially lose their jobs to foreign labor through the H-1B visa program.

In addition, the Trump Administration is implementing stricter oversight over the current employers who hire H-1B visa workers instead of Americans.

Under the new guidelines, USCIS will visit worksites of where H-1B visas are used, looking for cases where the employer’s basic business information does not specifically validate why foreign workers are being used instead of American workers.

“Targeted site visits will allow USCIS to focus resources where fraud and abuse of the H-1B program may be more likely to occur, and determine whether H-1B dependent employers are evading their obligation to make a good faith effort to recruit U.S. workers,” the statement reads.

“Employers who abuse the H-1B visa program negatively affect U.S. workers, decreasing wages and job opportunities as they import more foreign workers” the news release continued.

The move by USCIS echoes a similar, more aggressive approach by the Department of Justice (DOJ) to the outsourcing and mass-laying off of American workers by American companies.

Under the direction of Attorney General Jeff Session, a longtime opponent of foreign replacement work visas, the DOJ demanded that American companies not use the H-1B visa program to replace American workers with foreigners, as Breitbart Texas reported.

“The Justice Department will not tolerate employers misusing the H-1B visa process to discriminate against U.S. workers,” Acting Assistant Attorney General Tom Wheeler of the Civil Rights Division said in the statement. “U.S. workers should not be placed in a disfavored status, and the department is wholeheartedly committed to investigating and vigorously prosecuting these claims.”

If the H-1B visa program had never been introduced and enacted, computer science job availability in the labor market would be up 11 percent and wages in the tech industry would have increased by five percent, Breitbart News reported.

Agency Creates Avenue for American Workers to Report Abuse

WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) today announced multiple measures to further deter and detect H-1B visa fraud and abuse. The H-1B visa program should help U.S. companies recruit highly-skilled foreign nationals when there is a shortage of qualified workers in the country. Yet, too many American workers who are as qualified, willing, and deserving to work in these fields have been ignored or unfairly disadvantaged. Protecting American workers by combating fraud in our employment-based immigration programs is a priority for USCIS.

Beginning today, USCIS will take a more targeted approach when making site visits across the country to H-1B petitioners and the worksites of H-1B employees. USCIS will focus on:

• Cases where USCIS cannot validate the employer’s basic business information through commercially available data;
• H-1B-dependent employers (those who have a high ratio of H-1B workers as compared to U.S. workers, as defined by statute); and
• Employers petitioning for H-1B workers who work off-site at another company or organization’s location.

Targeted site visits will allow USCIS to focus resources where fraud and abuse of the H-1B program may be more likely to occur, and determine whether H-1B dependent employers are evading their obligation to make a good faith effort to recruit U.S. workers. USCIS will continue random and unannounced visits nationwide. These site visits are not meant to target nonimmigrant employees for any kind of criminal or administrative action but rather to identify employers who are abusing the system.

Employers who abuse the H-1B visa program negatively affect U.S. workers, decreasing wages and job opportunities as they import more foreign workers. To further deter and detect abuse, USCIS has established an email address which will allow individuals (including both American workers and H-1B workers who suspect they or others may be the victim of H-1B fraud or abuse) to submit tips, alleged violations and other relevant information about potential H-1B fraud or abuse. Information submitted to the email address will be used for investigations and referrals to law enforcement agencies for potential prosecution.

Existing H-1B Fraud Measures

Since 2009, USCIS has conducted random administrative site visits to ensure that employers and foreign workers are complying with requirements of the H-1B nonimmigrant classification. USCIS refers many cases of suspected fraud or abuse to U.S. Immigration and Customs Enforcement (ICE) for further investigation.

Additionally, individuals can report allegations of employer fraud or abuse by submitting Form WH-4 to the Department of Labor’s (DOL) Wage and Hour Division or by completing ICE’s HSI Tip Form.

Outstanding! Very good. Now ask Congress to cut the program. At least by half. Then eventually phase it out altogether. Keep busiess worker visitor visas, those 6 month things where they're paid by their home country, but not hired by our companies or allowed employment under US laws.

I would say cut it in half - NOW. Phase it out,, altogether, in another 5 years.

Then put our labor department and all the 'brains' we have in congress and academia together to decide exactly what jobs are needed and begin educating our own people to do the work.

I really don't think it would take much brain power -

We're not lacking in brain power in the United States. We don't need to import labor, low-skilled or high-skilled. What we're lacking in the United States is being left alone to use it.

The brain power I was talking about was that of the people who make the decisions. We do seem to be lacking in brain power there - or in honor - or both.

I can remember when the labor department would report in the next 5/10 years, this country would be needing more workers in this field or that field. They would, supposedly, talk with industry and come up with such figures. People could then think about what field they would prepare to enter.

Also, industries used to announce scholarships to enter their field.

Our country has never been perfect - our politicians have always had the eye out for their own selves - it just seems it used to work better in many ways.

LOL!! Oh yes, you're absolutely right about that. They get to DC and it's like they go through a metal detector into their Congressional office buildings and ZAP, now they're stupid people. Honestly, someone should investigate this. Something happens to their brains in DC.
