Trump commutes sentence of Agriprocessors chief Sholom Rubashkin

WASHINGTON – President Donald Trump on Wednesday commuted the sentence of an Iowa kosher meatpacking executive who had been sentenced to 27 years in prison for money laundering, marking the first time he's used the presidential power.
The decision to intervene on behalf of Sholom Rubashkin, who ran the Iowa headquarters of a family business that was the country's largest kosher meat-processing company, came at the urging of numerous members of Congress and a long list of high-ranking law enforcement officials, who argued the sentence was far too harsh for a first-time, non-violent offender.
The action was "encouraged by bipartisan leaders from across the political spectrum, from Nancy Pelosi to Orrin Hatch," the White House said.
Rubashki was convicted in 2009 for submitting fake invoices to a bank that made Agriprocessors' finances appear healthier than they were so that it could borrow more. His prosecution came after federal authorities raided the plant and arrested 389 illegal immigrants in 2008.
The 57-year-old father of 10 has served more than eight years of his sentence, according to the White House, which stressed the action is not a presidential pardon and does not vacate Rubashkin's conviction.
Trump has used his pardon power just once so far: to spare former Arizona Sheriff Joe Arpaio the prospect of serving jail time by wiping away a federal conviction stemming from immigration patrols that focused on Latinos.
Rubashkin's long-time attorney Guy Cook praised Trump's decision, saying Rubashkin "has finally received justice."
"The sentence previously imposed was unfair, unjust and essential a life sentence," he said via email. "President Trump has done what is right and just. The unrelenting efforts on Rubashkin's behalf have finally paid off."
Rubashkin's attorneys last year accused prosecutors of improperly interfering with the sale of Agriprocessors and depressing its sale price by millions. The drop in value left Agriprocessors' bank with a $27 million loss -- a figure used to calculate Rubashkin's sentence under federal guidelines. The U.S. Attorney's Office denied the allegations.
The White House said the president's decision to review Rubashkin's sentence was driven by concerns raised by a bipartisan group of more than 100 former high-ranking law enforcement and Justice Department officials, including multiple former attorneys general, as well as prosecutors, judges, and legal scholars.
"Mr. Rubashkin is a devoted husband and father, a deeply religious man who simply doesn't deserve a sentence of this length, or anything remotely close to it," they wrote in a letter that urged Trump to use his "executive clemency power to commute the patently unjust and draconian 27-year sentence imposed upon Sholom Rubashkin--a first time, non-violent offender and father of 10, including an acutely autistic child."
More than 30 current members of Congress also submitted letters to the White House supporting a review of Rubashkin's case.
But former prosecutor Bob Teig, who retired in 2011 after serving as a prosecutor and spokesman for the U.S. Attorney's Office for the Northern District of Iowa, said Trump's decision to commute Rubashkin's sentence "makes no sense" given Trump's repeated promises to get tougher on illegal immigration.
Teig said that every court that looked at Rubashkin's sentence had concluded it was fair, and suggested that former Justice Department officials and lawmakers who supported leniency were unaware of the facts of the case.
"The outrage is backwards," he said.

DES MOINES, Iowa ”A former vice president of an Iowa kosher slaughterhouse will be sentenced to 27 years in prison and ordered to pay nearly $27 million restitution for his conviction on financial fraud charges, a federal judge said Monday.
Chief U.S. District Court Judge Linda R. Reade released the memorandum outlining the sentence she will hand down for Sholom Rubashkin during the former Agriprocessor's Inc. manager on Tuesday in federal court in Cedar Rapids.
A jury found Mr. Rubashkin guilty last fall on 86 federal financial fraud charges. Prosecutors had sought a 25-year sentence. Mr. Rubashkin's attorney, Guy Cook, said the sentence is longer than necessary and plans to appeal.

Federal authorities could have spared Postville a great deal of upheaval if they had gone ahead with a planned 2000 immigration raid there instead of waiting nearly eight years to deal with a blatant case of illegal hiring, a retired federal agent says.
Estela Biesemeyer said last week that she and other immigration agents were poised to raid the Agriprocessors meatpacking plant in late summer 2000, but their bosses canceled the action because of fears it might affect the presidential election.
Agency administrators were concerned about political blow-back from the raid, because they had heard the plant's owners were friends with U.S. Sen. Joe Lieberman, she said. Lieberman was the Democrats' vice presidential candidate that year.
The result of the cancellation, she said, was that the kosher meatpacking plant was allowed to expand dramatically, hiring hundreds more illegal immigrants. By the time authorities launched a huge raid there in 2008, the plant was Postville's dominant economic support, and its ensuing bankruptcy threw the town into a tailspin.

WASHINGTON - A well-connected kosher slaughterhouse king convicted of fraud at his Iowa plant has rustled up a herd of New York pols to try to win him a reduced sentence.
The prominent Lubavitcher from Brooklyn, Sholom Rubashkin, was sentenced last summer to 27 years in prison for 86 counts of financial crimes as well as lying on the witness stand.
Yet the disgraced businessman has friends in high places, including Reps. Anthony Weiner, Jerrold Nadler, Eliot Engel, Carolyn McCarthy, Edolphus Towns, Carolyn Maloney, Steve Israel and Yvette Clarke, who have lobbied for a review of his case.
Rubashkin has also enlisted more than 30 other lawmakers from New Jersey to California to voice outrage, along with several former U.S. attorneys general.
The head of the Democratic National Committee, Florida Rep. Were the 389 illegal aliens deported? We need some status on this. The last I heard was they weren't deporting them because they were keeping them in the country as witnesses in the case.

jarvanka probably pushed for this..daddy's little girl & hubby always get their way. Guess their rabbi told them to have this done like he did with daca amnesty.

It is disappointing to learn President Trump is giving a form of Amnesty to employers like Rubashkin who was arrested for fraud and knowingly hiring large numbers of illegal immigrants. This clemency reeks of the same abuse of power Obama exercised on immigration matters and contradicts Trump's campaign promises enforce our existing immigration laws just like his disappointing decision to pursue DACA Amnesty for millions of illegals. Giving millions of illegal aliens and an unscrupulous employer like Rubashkin executive level Amnesty from their crimes is not what Americans voted for in 2016 and makes Trump's campaign promises a type of fraud!

President Donald Trump commuted the sentence Wednesday of a meatpacking executive who was the subject of an immigration raid in 2007.
Sholom Rubashkin, an orthodox Jew, owned the Agriprocessors plant in Postville, Iowa and was sentenced in 2009 to 27 years in prison for bank fraud. Trump’s commutation is not a pardon and does not vacate Rubashkin’s conviction. Rubashkin will now be in a term of supervised release and have to pay restitution.
The kosher meatpacking plant was raided in 2007, and immigration agents reportedly found around 400 illegal immigrant workers, including many that were minors. The New York Times reported that immigration charges were dropped against Rubashkin, however, several managers were convicted of harboring illegal immigrants.
Rubashkin’s commutation was supported by many political leaders including three former attorney generals and former FBI Director Louis Freeh. The commutation was also backed by lawmakers ranging from Republican Iowa Rep. Steve King to House Minority Leader Nancy Pelosi.
Proponents of Rubashkin’s commutation argued that he faced an unduly harsh punishment.
Former President Barack Obama issued a record amount of commutations during his presidency most of which went towards drug dealers.

Yeah, but he wasn't convicted of hiring illegal aliens. His prison sentence is for something else, completely unrelated to illegal aliens.
