    Suspect in fatal DUI faces murder charge

    VISTA — Prosecutors said this week they’ll seek a murder charge against a suspected drunken driver accused of plowing into a pedestrian in June and then driving for another mile with his body wedged in her car.

    The new charge was hailed by more than a dozen anti-immigration activists who attended a hearing Thursday for 29-year-old Esteysi “Stacy” Sanchez, who authorities have indicated may be in the country illegally.


    Sanchez had already been charged with felony DUI, gross vehicular manslaughter and driving without a license, and has pleaded not guilty. Prosecutor Bob Bruce declined to say Thursday why he added the murder charge.


    Police say Sanchez was driving east on Mission Avenue in Oceanside around 6:20 a.m. on June 27 when her car jumped the sidewalk and struck a homeless man, 69-year-old Jack Ray Tenhulzen.


    The impact sent the victim through the car’s front windshield and into the passenger seat. The female driver kept going for nearly a mile before ditching the vehicle. Witnesses said they watched as she got out of the car and stumbled down the street.


    Sanchez was arrested a short time later after her boyfriend called police to report the incident. At her arraignment in June, prosecutors said that two hours after the crash Sanchez’s blood alcohol level was about 0.18, or more than twice the legal limit.


    The gruesome nature of the case made headlines, but interest in it increased after it was revealed that Sanchez was driving without a license and is suspected of being an undocumented immigrant.


    Over the past year, illegal immigration has landed at the center of a national conversation, fueled in part by presidential candidate Donald Trump’s vow to build a wall along the U.S.-Mexican border.

    After Thursday’s hearing, protestors headed outside the Vista courthouse with hand-held signs decrying illegal immigration and banners depicting photos of people they said were killed by undocumented immigrants. Most of the protestors wore T-shirts with the same photos.

    “This was something we had to stand up about,” said Jeff Schwilk, who organized the gathering.


    Schwilk, long known for his leadership in the regional Minuteman movement, formed a group called San Diegans for Secure Borders in 2013.


    Also joining Thursday’s protest was Oceanside resident Brenda Sparks, whose son was fatally injured in a 2011 crash in Yucaipa when an undocumented immigrant crashed into his motorcycle.


    Sparks — a member of The Remembrance Project, which advocates for the families of people killed by an unauthorized immigrants — shared the stage with Trump in April at a rally in Orange County. She and other families had previously met with him in July 2015 to talk about illegal immigration.


    “I ask people to stand with the American people against illegals,” Sparks said outside the courthouse Thursday. She later said Sanchez “needs to go back to where she comes from — and out of my country.”


    Fatal drunken driving cases are usually charged as manslaughter, and when murder charges are added, it’s often because the defendant has a prior drunken driving conviction — but that’s not the case with Sanchez.


    To prove second-degree murder, prosecutors must show that the defendant had a conscious disregard for life.


    More details in the case should be revealed during Sanchez’s preliminary hearing, set for Oct. 26. She remains jailed in lieu of $1.5 million bail and faces a potential sentence of 15 years to life in prison if convicted.


    Anti-immigration activists often argue that jails are crowded with undocumented immigrants, but it’s difficult to track how many people arrested each year in San Diego County may be here illegally. Since late 2014, federal authorities no longer put an automatic “immigration hold” on such arrestees, but instead only ask jails to notify them when a suspected undocumented immigrant is convicted of specific crimes.


    According to the county Sheriff’s Department, which manages the region’s jails, at any given time roughly 3 to 4 percent of the jail population is under such a notification request from the U.S. Immigration and Custom’s Enforcement. This week, that number hovered around 214 people.

    Murder Charge Added Against DUI Suspect with ICE Immigration Hold

    VISTA, California — Murder charges have been added to those facing 29-year-old Esteysi Sanchez, the woman accused of killing Jack Ray Tenhulzen while driving with more than twice the legal limit of alcohol in her bloodstream and continuing about a mile down the road with the man lodged in the passenger side of the vehicle before she left.

    U.S. Immigration and Customs Enforcement (ICE) lodged an immigration hold for Sanchez upon news of the case. The hold “requests the receiving LEA maintain custody of the priority individual for a period not to exceed 48 hours beyond the time when he or she would have otherwise been released from custody.”

    During Thursday’s hearing, amended charges were filed against Sanchez to add the charge of murder to a six-charge indictment. The other five counts include: gross vehicular manslaughter while intoxicated, hit and run with death or permanent serious injury, driving under the influence of alcohol causing injury, driving with a measurable blood alcohol causing injury, and unlicensed driver. Sanchez’s blood alcohol level has been reported as hitting 0.18 when measured about two hours after the accident.

    Tenhulzen was killed in late June when, according to police, Sanchez drove her vehicle off the road and struck him on the sidewalk. The Oceanside Police Department described Tenhulzen being hurled through the windshield and lodged in the passenger seat. NBC7 local news cited a police report that described Tenhulzen’s leg being detached from his body on impact, and landing on the car’s trunk. According to the police report, Sanchez drove another mile before stopping the vehicle to exit and leave the scene. Law enforcement officers found her at her home about two blocks away. It is believed that she walked there from the vehicle.

    Sanchez faces 15 years to life in state prison if convicted. She pleaded not guilty to the six-count indictment on Thursday. She is being held on a $1,500,000 bail. If released, she could be subject to the ICE detainer request.

    Details revealed in today’s hearing with regards to a teen child linked to Sanchez suggested that there is a chance that the teen may possibly be a witness in the case. It has not been publicly revealed whether the teen child is a blood relative.

    A probable cause hearing in the case has been set for October 26.

    At the end of June, U.S. Immigration and Customs Enforcement issued the following statement regarding this case:

    Given the seriousness of the charges lodged against Ms. Sanchez, U.S. Immigration and Customs Enforcement (ICE) has designated this as an important federal interest case. To that end, the agency has submitted a notice of action (Form I-247-X – Request for Voluntary Transfer) to the Vista County Jail requesting to be alerted if or when Ms. Sanchez is slated for release so the agency can take custody to pursue further administrative enforcement action. Relevant databases indicate Sanchez has no prior criminal convictions or immigration enforcement encounters. However, based on a review of her history, ICE believes Ms. Sanchez is subject to removal from the U.S.

    A group of victim advocates attended the hearing and held up a Remembrance Project display of Americans who have lost their lives at the hands of foreign nationals who at the time of the deaths were illegally present in the United States.

    Also present at the hearing was mother Brenda Sparks, who lost her son Eric Zepeda when an illegal alien hit and killed the young man with a vehicle in September 2011. The illegal alien served no jail time — and, according to Sparks, was driving the day after hitting her son and is still believed to be driving in the U.S.

    Sparks had participated in a meeting that Republican Presidential candidate Donald Trump held in July 2015 with several families that have lost loved ones at the hands of illegal aliens. In a post-meeting press conference, she was among the family members of victims who were given the podium to tell the story of how she lost her son.

    It's just heart-breaking for the victim. He's already homeless, fighting to survive on the streets at 69 years of age, because he has no job or income or home, and to pour salt into the insult of that drastic situation we can't seem to solve in our country, he loses his life to a no good drunk illegal alien who isn't even supposed to be in the country let alone driving drunk on our roads that night.

    I mean ... the tragedy of illegal immigration in our country is of epic proportion.

    And probably right until she murdered this poor man, I'm sure she would have been considered "one of the good ones" with no serious crimes on her record.

    Illegal aliens already have serious crimes on their records, they're called unlawful entry and unlawful presence.
