Post Suspected illegal immigrants in SWFL can now be detained for 48 hours

SOUTHWEST FLORIDA -A young man illegally residing in Southwest Florida is living in a constant state of fear.

The man, who asked not to be identified, fears U.S. Immigration and Customs Enforcement (ICE) agents now more than ever, especially after two Southwest Florida sheriff offices struck a deal with the federal government.

Lee and Charlotte Counties have agreed to hold people suspected of being here illegally.

In Collier County deputies can act as ICE agents. However, that's not the case in Lee or Charlotte counties.

ICE said un-documented or illegal immigrants are being arrested before they can pick them up.

This agreement requires Lee and Charlotte to hold them for 48-hours.

“All I have in America is my life and dreams,” the immigrant said.

The young immigrant fears deportation although he has been living in Southwest Florida illegally since his visa expired.

“I kind of see my dream sliding lately,” he said.

That's because if deputies stop him and discover he's foreign-born, they notify ICE who in-turn can ask he be held for questioning if they suspect he’s illegal.

“When I see a police officer on the street, yes, I’m nervous. But I try to keep it inside,” he described.

Immigration Attorney Indera DeMine has concerns with the new deal.

“Someone stopped with a broken tail light is treated the same way and can be detained and held for ICE as a person with a serious felony,” DeMine said.

ICE argued that the deal gets criminals off the streets.

“The reality is it's the dad driving to work without a license because he's unable to get a license legally in the U.S.,” DeMine claimed.

She fears more arrests will create a backlog in the immigration courts.

“The backlog is a problem that is almost insurmountable, at least in the near term,” said Anthony Rogers.

Rogers would know, he's a retired Federal Immigration Judge, and he said the new deal exempts Lee and Charlotte Counties from facing lawsuits for holding people.

“There is nothing that suggests so far that the local sheriff's office is doing anything more than holding folks when a request is made for more than 48 hours,” Rogers said.

That leaves many living here illegally always looking over their shoulder.

“I feel like God is keeping me away from trouble and gives me wisdom which everyone needs,” said the young immigrant
Lee County reported they're currently holding 30 people ICE wants to be detained.

They're holding nine others who have active warrants signed by a judge.

ICE is reimbursing the county for holding them.

The new agreement will likely see those numbers increase.

No lady Americans see this as ONE MORE CRIME being committed by an illegal! Not to mention he's got a job that rightly should be held by an American. I really hate immigration attorneys, they twist the law to apply them to people who have NO rights.

That leaves many living here illegally always looking over their shoulder. GOOD!
