(CNSNews.com) - Birthright citizenship has "constitutional underpinnings," but that doesn't mean Congress can't pass a law to end it, Rep. Steve King (R-Iowa) told CNN on Monday.
He was commenting on Donald Trump's recently released policy paper that says babies born to illegal immigrants should not automatically become U.S. citizens just because they were born in the United States.
"[W]ith regard to birthright citizenship, for example, it is -- it has constitutional underpinnings, yes," King said. "But the way you start that is as you pass the legislation that puts an end to birthright citizenship. I happen to be the author of that legislation. And then, it will be litigated, there isn't any doubt about it.
King said it would be "constitutionally sound" to pass such a bill. And he noted that "there aren't many countries in the world" that have birthright citizenship policies.
The 14th Amendment states: "All persons born or naturalized in the United States and subject to the jurisdiction thereof are citizens of the United States and of the state wherein they reside."
King also backs Trump's call to build a wall on the U.S. border with Mexico; and, as Trump does, he wants to away with sanctuary cities.
But King goes further than Trump when it comes to discouraging employers who hire illegal aliens. His New IDEA Act (Illegal Deduction Elimination Act) would make wages and benefits paid to illegal workersnondeductible for federal taxpurposes.
King said his plan would "clean up this work force."
Candidates respond
Campaigning in Iowa on Monday, Wisconsin Gov. Scott Walker said his immigration plan includes securing the border with a wall; eliminating sanctuary cities; and no amnesty. "To me, it's about enforcing the laws of this country," he said.
When a reporter asked him if he would eliminate birthright citizenship, Walker indicated that he would consider the idea. He noted that Sen. Harry Reid (D-Nev.) advocated the idea in the early 1990s, but later reversed himself.
Republican Carly Fiorina, also campaigning at the Iowa State Fair, noted that it would take a constitutional amendment to make such a change:
"This is part of our 14th Amendment," she said about birthright citizenship. "So honestly, I think we should put all of our energies and all of our pollitical will into getting the border secured and fixing the legal immigration system.
Donald Trump has part of it right. There's no question we should be defunding sanctuary cities if they won't enforce the laws; there's no question that we should be deporting illegals who have committed major crimes. There's no question that we should have an employee verification system that actually works, so we can make it mandatory."
Jeb Bush said on Monday he "appreciates the fact" that Trump now has a an immigration plan: "But I think that the better approach is to deal with the 11 million people who are here illegally and in a way that is realistic; and to have border security that is done in the right way to lessen the number of people crossing our border," he said.
