A man charged in the fatal shooting Saturday of an 18-year-old Mexican immigrant is a member of a violent international gang called MS-13, Austin police said Friday.

It's the first violent crime attributed to a member of the gang in Austin. MS-13, formed in Los Angeles in the late 1980s by Salvadorans, is the only gang targeted by a national FBI task force.

On Thursday police arrested Christian Palacios, 36, and charged him with capital murder in the death of 18-year-old Gamaliel Jiménez Bohórquez, who was shot in front of his father during a robbery Saturday night near the Capital Plaza shopping center in Northeast Austin, police said.

Palacios, who is being held without bail at the Travis County Jail, could face life in prison or the death penalty if he is convicted. Police said they are still seeking an Hispanic woman with a blond hair and a ponytail who they say participated in the robbery.

Palacios, a native of Guatemala who is not a U.S. citizen, is also being held on an immigration charge.

Palacios had tattoos consistent with MS-13 members, said Cmdr. Harold Piatt of the Austin Police Department's violent crimes unit. But police said they do not believe Bohórquez's shooting was gang-related.

"(Palacios) is a gang member, but he is also a crook," Piatt said. "We don't believe this has to do with gangs."

MS-13, or Mara Salvatrucha, has an estimated 8,000 to 10,000 members in 33 states across the country, according to the FBI. Most are Salvadoran nationals or first-generation Salvadoran Americans, the FBI says, but the gang also includes Hondurans, Guatemalans, Mexicans and other Central and South American immigrants.

As the gang members were arrested for crimes in California, many were deported to El Salvador, where MS-13 grew into the country's most violent gang. In 2004, MS-13 was blamed for an attack on a bus in Honduras, which had passed laws to crack down on the gang, that killed 28 people.

In the United States, the FBI says MS-13 members have committed murders, rapes, robberies, thefts, extortion and money laundering. In December 2004, the FBI launched an MS-13 National Gang Task Force, the first effort of its kind, aimed at dismantling the gang.

In Texas, MS-13 has primarily operated in large cities such as Dallas, Houston and San Antonio.

Piatt said the gang does not have a significant presence in Austin. He said two MS-13 members have previously been identified in Austin and deported. He did not offer further details on those cases.

Bohórquez's father, Guillermo Jiménez, told police that he and his son were walking through an alley in the 1100 block of Reinli Street on their way home from church when they were approached by a man and a woman who demanded money, police have said.

One of them pressed a gun barrel to the younger man's cheek, and Guillermo Jiménez gave the men about $100, police said. According to an arrest affidavit, Jiménez said his son took out his money and threw it on the ground. The man then shot Bohórquez once in the chest, the affidavit said. Bohórquez later died at Brackenridge Hospital.

"We have no idea why he was shot, since they were cooperating," Piatt said.

The affidavit said police interviewed a man who witnessed the shooting and knew Palacios. The witness said he feared retaliation, so he called 911 from a pay phone, refused to give his name and said he would only speak to a detective if police sent someone in an unmarked car, the affidavit said.

The witness told detectives he saw a red car pull past Bohórquez and his father, then saw the driver and passenger get out and confront the pair, according to the affidavit.

The witness, who said he was hiding in some bushes, told police he wrote down the license plate number of the car and was "100 percent sure" Palacios fired the shot that killed Bohórquez, the affidavit said.

The witness led police to Palacios' apartment, where a red Dodge Neon was parked in front, the affidavit said.

Police said it's possible Bohórquez and his father were targeted because they were immigrants from Mexico. Guillermo Jiménez said he plans to bury his oldest son in Chiapas.

Detectives ask that anyone who might have witnessed the robbery or might have information about the woman call the homicide tip line at 477-3588 or CrimeStoppers at 472-8477.

This piece of living crap, Christian Palacios, is a poster boy for what happens to America when we do not control our borders. How many tens of thousands just like him are crawling around in our country at this very moment? Our elitist government representatives don't have to worry about their safety. They use our tax dollars to keep themselves well isolated from the scum and leave the rest of us to fend for ourselves.

Teen May Have Been Killed Because Of How He Handed Over His Money During A Robbery

    April 28, 2007 06:41 PM PDT

According to an arrest warrant, Christian Palacios of Guatemala may have killed Gamaliel Bohorquez because he threw his money to the ground, instead of handing it to Palacios.

Bohorquez was fatally shot in front of his father last Saturday as the two of them walked from a church service.

Police say Palacios is an MS-13 gang member known for mob style killings.

"This individual is probably a bona fide MS13 gang member from South America but we don't believe this crime had anything to do with a gang syndicate or gang activity. What we believe is this guy is just a crook," said Cmdr. Harold Piatt of Austin Police Department.

Investigators are still looking for a Hispanic woman with blonde hair seen with Palacios that night.
