    Suspect in Court for Murder of Baby Boy

    HOUSTON - An accused baby killer is ready to be transferred from Harris County to Galveston County where he is to face a capital murder charge after eight months on the run.

    Jose Herrera, a resident of League City, was found in Houston's Ingrando Park last week by Harris County Precinct 6 deputy constables.

    Herrera ran from the deputy constables and they charged him with evading arrest, which is why he appeared in Harris County court on Friday.

    Herrera's capital murder indictment was handed down on Dec. 28, 2008, in Galveston County. He is accused of beating his 6-week-old son to death on Oct. 27, 2008.

    Herrera is an undocumented immigrant and is on a hold order from the U.S. Immigration and Customs Enforcement.

    Galveston County authorities are expected to transfer Herrera to its jail within the next 48 hours.
