    U.S. Born Children Of Undocumented Immigrants Represented In Class Action Suit

    Attorneys representing more than 300 U.S. born children of undocumented immigrants, including 70 children from Chicago, have filed a national class action suit and are requesting an emergency hearing before the U.S. Supreme Court.

    WBBM's Debra Dale has the story.

    The approximately 300 plaintiffs are filing on behalf of approximately 4 million U.S. citizen children born to illegal immigrants.

    The suit claims the deportation of undocumented immigrant parents violates the constitutional rights of their U.S. citizen children. The suit says the law subjects the citizen children to de facto deportation.

    The suit asks for an end to deportation of undocumented immigrant parents of U.S. citizens.

    The suit names President Bush, U.S. Attorney General Alberto Gonzales, Secretary of Homeland Security among others

    Oh man, if this actually goes to the Supreme Court, we may be sunk!!

    Either that, or they may actually enforce the actual law, which states these kids should NOT be US Citizens to begin with!!!

    I'm a bit scared of this one!!!

    As far as I know there is no CONSTITUTIONAL right to have your illegal law-breaking parents with you in this country.

    They do however have the choice to be with their parents in their native countries. Tough choice, but they should blame their parents.

    Exactly. it brings to mind the old story about a person who killed his parents and then expected sympathy because he was an orphan.

    Oh yeah, their parents sneaked in and got them delivered in our hospitals for free in this country...free medical, all kinds of assistance, special programs (all in their own language of course). And they make no apologies they want MORE!!!! If I rob a bank and invest the money, are the dividends still mine?

    ANCHOR BABIES...that should be our next fight when we can eventually divert our attention and resources away from the immigration reform fiasco. We should insist that our Senators and Representatives pass legislation to negate citizenship for children born of illegal aliens in the U.S. This is another one of the "magnets" drawing illegals here. We must take down each and every one of the attractors that bring in the illegals. This would be a good place to start.

    The 14th Amendment doesn't give automatic citizenship to the parents.

    The suit asks for an end to deportation of undocumented immigrant parents of U.S. citizens.
    Roughly translated: "The suit asks for an end of enforcing the law because of the criminal parents."

    Children Of Illegal Immigrants Challenge Parents' Deportation In Supreme Court

    Chicago, IL (AHN) - A motion filed in the Supreme Court last week aims to halt the deportation of illegal immigrants who are parents in families where one or more of the children are legal U.S. citizens. The class-action motion was filed June 15 on behalf of Four Million Kids, a project of Centro Sin Fronteras, a Chicago-based immigrant rights group.

    The project's name is a reference to the estimated 4 million children whose citizenship derives from the 14th Amendment provision declaring anyone born on U.S. soil a citizen. The only current exception is for those whose parents are not subject to U.S. jurisdiction, such as the children of foreign diplomats.

    Some Republicans have been pushing for legislation that would deny citizenship rights to the children of illegal immigrants and people here on temporary visas.

    The motion is a response to a case thrown out of federal courts nine months ago, filed on behalf of Saul Arellano. Saul has been living in a church on Chicago's west-side with his mother, Elvira Arellano, ever since last September, when she was convicted of using a false social security number and faced deportation. The church's pastor granted her sanctuary in an effort to prevent her from having to make the tough choice of leaving her eight-year-old son or to move him to her native Mexico. Saul's case, which argued that his due process rights would be violated if he had to leave the country, was rejected on the basis that Saul would be allowed to stay if his mother turned over guardianship.

    The new motion challenges that decision, claiming that equal opportunity and "equal protection under the law.. implicitly means to be given a fair opportunity to have their parents stay in this country."

    Speaking at a press conference today, a representative of Four Million US Kids, teenager Maria Castellano echoed this argument. "I want to go to college," she said. "I won't be able to do that without my parents here."

    "If they did rule in favor of these children, it would resolve 90 percent of the cases in this country," Emma Lozano, Director of Centro Sin Fronteras, told AHN.

    This House is already addressing Immigration. Birthright Citizenship needs to be ended and it we need to call our Representatives and tell them this.
