    Peru officials meet with police in spraying case
    Allen: Man remains on life support after incident last week

    ALLEN – Peruvian government officials met Thursday with Allen police and the family of a man who is on life support after being pepper-sprayed last week by Allen officers.

    Edgar A. Vera, 45, a native of Peru, remained in critical condition Thursday at Medical Center of McKinney, a week after tussling with two Allen police officers, family members and police said. Officers used pepper spray, and Mr. Vera stopped breathing before being revived.

    The Texas Rangers, with monitoring from the FBI, are leading the investigation, officials said. The Allen department has begun an internal investigation.

    Eduardo Rivoldi, Peru's consul general based in Houston, said the case has generated much interest back home.

    "Yesterday, the minister of foreign affairs called a news conference to inform Peru the degree of concern and interest of the government of Peru in this case," Mr. Rivoldi said.


    Mr. Rivoldi said his role was to help establish a relationship between Allen police and Mr. Vera's family. He also is to gather information about the incident and forward it to his superiors in Lima. He declined to say whether Peruvian officials would or could take any action.

    "I'm not in a position to speculate on that," he said.

    Luis Pacchioni, Mr. Vera's cousin and a spokesman for the family, said he was encouraged after his meeting with Mr. Rivoldi and Police Chief Bill Rushing.

    "I wanted to have assurances that we were going to get to the truth," Mr. Pacchioni said. "The chief of police told the family that he is going to make sure that the investigation is transparent."

    Chief Rushing, citing a potential lawsuit, said after four hours of meetings in the afternoon that he couldn't release any more details.

    "We acknowledge that our officers used force, but it has to be determined if they used excessive force," he said.

    The officers responded to a call about a suspicious person in an Allen neighborhood and found Mr. Vera sitting in a parked car in the 1500 block of Mahogany Drive. Mr. Vera was waiting for a relative to return home, family members said.

    Police discovered that Mr. Vera had a warrant for his arrest and tried to take him into custody, police said. The warrant involved an unresolved 2003 ticket for not wearing a seatbelt. The officers said Mr. Vera resisted arrest and struggled with them. After they used the pepper spray, he stopped breathing. The officers performed CPR, and Mr. Vera was taken to the hospital.

    The officers, Laura Gilmore and Gino Ruatta, are on paid administrative leave.

    Bert Guerrero, one of the Vera family's attorneys, said Mr. Vera was on life support in McKinney.

    Mr. Pacchioni said the family is struggling to understand how a confrontation with police could have landed Mr. Vera unconscious and in the hospital.

    "You shouldn't be left brain dead for a minor offense," he said.

    DALLAS -- The Texas Rangers are investigating two Allen police officers in a case that is drawing protests in two countries because a man who police say resisted arrest is now in a coma.

    Last Thursday, two police officers were arresting Edgar Vera on a traffic warrant.

    At the time, police said officers used pepper spray when he resisted arrest.

    Vera, who immigrated here from Peru in 1982, ended up in the hospital and is now in a coma.

    "We acknowledge that our officers used force but it's to be determined if they used excessive force," Chief Bill Rushing said.

    Allen's police chief met Thursday with a Peruvian diplomat and with Vera's family.

    He promises a full investigation.

    More details on Peru's meddling! For gosh sake's, the guy came here in 1982 and is a legal resident, according to the report.

    It is also advisable that if you have an outstanding warrant for not wearing a seatbelt that you pay the ticket and if police find you and want to haul you down to the station to get their money, then WELCOME TO AMERICA!!

    If you resist arrest, you will get sprayed. I'm sure they would spray anyone resisting arrest. Personally I think the use of pepper spray by police needs to be investigated.

    The man may be allergic to the spray; that's the only thing that could have put the man in a coma....to much inhalation of the "substance" which I'm sure is toxic to begin with...I'm sure manufactured by Globalists without "human trials" just like their GMO food.

    This is VERY VERY unfortunate and uncalled for. But if this man is a Legal Resident, driving a delivery truck, why is he a Legal Resident? Did we need people from Peru to drive delivery trucks in Tyler Texas in 1982?



    I do wonder why he resisted arrest? There is more to this story. What happens to someone when they resist arrest in PERU?

    3rd world country I expect you will not find them carring OC spray, they probable just start out with beating you with pistol or rifle butts and move up shooting you in the head= real brain dead.

    Here there is a thing called: Continuum of Force, verbal command, soft hand tactics etc.

    I don't think that we've heard all of the story yet. I don't blame the officers, once they've asked someone to surrender, no matter what the offense, then they have to follow up until they get the job done. Not to do so would encourage total disrespect for the law...which is little enough as it is.

    To hell with Peru, if they'd been all that interested in him, they'd have kept him HOME.

    We are now one with Peru, thatnks to CAFTA. Wait until the FTAA passes. Does anyone know how to salute a UN Soldier? Afterall, they will become our new law enforcement.

    I've got to weigh in on this one. I live in a neighboring town and count as friends a few cops here. Cops in this area deal with immigrants, legal and illegal, every day in petty and major crimes. They did not single this scofflaw out for some personal form of punishment. They were called to enforce the law.

    The police don't want a relationship with this scofflaw's family and the family isn't entitled to one. The police just want them to obey the laws of our country.

    I'd remind Mr. Pacchioni that he's been ill-advised. His scofflaw relative was not sprayed for a minor offense. He was sprayed because he resisted arrest. In this country, due to the violence and fear caused by Nine-Eleven and illegal aliens, everyone knows you don't resist arrest without attracting overwhelming force.

    Police spray scofflaws every day for minor offenses avoiding harm to everyone. Before they had spray, the first option was a billy-club. This unfortunate accident would not have happened but for two things. First, if the scofflaw had obeyed the laws of our country, it wouldn't have happened because the police would not have had "reasonable cause," the warrant. Secondly, if this scofflaw had not resisted arrest, they would not have used the spray. He's lucky the cops' spray cannisters weren't empty.
