    Illegal Immigrants Charged With Trespass Seek Dismissal
    Men Arrested After Traffic Stop

    NASHUA, N.H. -- Attorneys for two illegal immigrants charged with trespassing asked a court to dismiss the charges on Thursday.

    Margarito Jaramillio Escobar and Sergio Ruiz-Robles were unable to provide police with any documentation when they were pulled over earlier this month. An investigation found that the two Mexican nationals were in the country illegally, and following the lead of a similar arrest in New Ipswich, N.H., police charged them with criminal trespassing.

    In court on Thursday the defense, aided by the Mexican consulate, filed a motion to dismiss the charges. Attorneys said that the state trespassing law doesn't apply to an immigration matter.

    Prosecutors and police said that they're sworn to uphold federal law.

    "If you're in the town of Hudson and you're not supposed to be in this country and you're remaining in the U.S. when you're not licensed or privileged to do so, we're going to take action in the town of Hudson," police Capt. Ray Mello said.

    If convicted, both men could be fined a maximum of $1,000. A hearing on the defense's motion to dismiss has been set for July 15.

    Well....lets see....the police arrested them and determined with relative ease they are illegal, i. e. here without papers. A hearing was set....to confirm the findings of the police. Now another hearing has been set....because the Mexican Consulate's Office showed up to ask that the trespassing charges be dropped. The charges were not dropped, but apparently more information is needed to determine whether or not these people have papers OR NOT.

    Now, I'm happy to see the Mexican Consulate involved in local municipal police matters in the United States. This CERTAINLY demonstrates that these are citizens of Mexico, not the United States. These Mexican Citizens have violated our right to enter laws, called US Immigration Law.

    So, what the Mexican Consulate should do is pay the $1,000 fine per person, all court costs, etc. and remove their citizens from our country at the expense of the Mexican Consulate.

    This would set a nice precedent, agreed?

    Two down, 11,999,998 to go!

    BUT, we have the courts involved, so we won't know the decision until July 15....and frankly, I'm rather confident, there will be some additional extensions after that. So, lets hope by fall that this simple matter of two guys here, citizens of Mexico, without papers can be resolved at some point in time by the local court of New Hampshire.

    They are of course, "buying time" awaiting the outcome of McCain Kennedy Secure America Orderly Immigration Act which will give these men Amnesty!
