US appeals court again throws out life sentence for driver in 2006 Ariz. crash that killed 10

PHOENIX — An appeals court has again thrown out the life sentence of a convicted illegal immigrant smuggler in a 2006 rollover crash that killed 10 in southwestern Arizona.
The 9th U.S. Circuit Court of Appeals in San Francisco ruled Monday that the U.S. District Court in Arizona "clearly erred" when it found that Adan Pineda-Doval acted with malice and remanded the case for a new sentencing.
He appealed his March 2011 life sentence.
The 26-year-old Pineda-Doval was found guilty by a federal jury in October 2007 of 10 counts of transportation of illegal immigrants resulting in death.
Pineda-Doval originally was sentenced to life in prison in May 2008. The appeals court remanded the case in August 2010 for specific findings regarding the defendant's mental state at the time of the offense.
