US to renew TPS for 6,900 Syrians but exclude new applicants

The Trump administration is expected to continue to grant 6,900 Syrian on US soil temporary protected status (TPS), while at the same time stopping short of allowing an estimated 2,000 new applicants of acquiring that designation.

Following weeks of deliberations between the Department for Homeland Security (DHS), the State Department and the White House, the decision according to the Associated Press will be announced today to extend TPS for another 18 months.

A US official confirmed to The National the administration’s intent to renew but not accept new applicants, while emphasising that the decision will be made official when announced by the DHS later on Wednesday. The deadline for making the decision was yesterday, 60 days before the current TPS expires on March 31. But the debate within the administration over the new applicants delayed the decision according to sources monitoring the issue.

The AP report quoting two DHS officials said the US government “will extend the protections, but won’t re-designate Syria as having conditions that prevent its citizens from returning safely.” That measure will block further applications already in place from obtaining a TPS, and will affect around 2,000 Syrian immigrant in the US since 2016.

“While the extension is the right decision given the facts on the ground and the intent behind the existence of TPS, a lack of re-designation will leave some 2,000 Syrians in the lurch - with no where to go and no way to remain here lawfully”, Muna Jondy, a legal consultant for Americans for a Free Syria told The National.

Syria earned a TPS designation in 2012 after the war broke out, and its status was routinely renewed under the Obama administration.

Today, it grants a temporary stay for 6,900 individuals due to the “violent conflict and the deteriorating humanitarian crisis continuing to pose significant risk throughout Syria.”

But the TPS program has not been popular with the Trump administration which has terminated it in the case of El Salvador, Nicaragua and Haiti, affecting nearly 300,000 individuals.

For Syrians, the continuation of the war across the country, means the TPS recipients in many cases don't have the option to return.

The United Nations has identified the number of registered Syrian refugees at five-and-a-half million since the conflict started in 2011.

Additionally Trump administration has put a cap of 45,000 for total number of refugees to be admitted to the US in 2018, but Syria is on the new list of countries whose citizens are restricted from acquiring visas into the United States.

Activists fear that by blocking new applicants, those Syrians already in the US applying TPS will have nowhere to go. “They are Syrians who entered lawfully and now will either have to leave to an almost certain death or remain here unlawfully in the shadows” said Ms Jundy.

Why aren't they sending back the MEN to clear rubble!!!

The people of Germany, Poland, many countries had to get off their ass and pick up their own rubble and rebuild.

They should be going back to clear rubble and get ready for their family to return and start rebuilding.

Send back their own Work Crews! And not one dime of our money to do it.

WE DO NOT NEED OR WANT ANY REFUGEES STAYING HERE FOR 17 YEARS LIKE THE EL SALVADORIAN'S!

That was almost a year ago, so .... about 6 to 8 months to go. Maybe Syria will be ready for them to return by that time. Should be, things are very good there now. Maybe not "hunky dory", but well enough for them to go home soon.

Trump administration automatically extending work authorizations for 335 Syrians with TPS: USCIS official

    by Anna Giaritelli
    | September 19, 2018 07:09 PM

Approximately 335 of the 7,000 Syrians in the United States with temporary protected status, known as TPS, who had already applied to retain their status will have their work authorizations automatically extended six months to March, according to a letter sent to recipients obtained exclusively by the Washington Examiner.

The Department of Homeland Security will give new work documents to all recipients from Syria who have pending applications to continue living and working in the U.S. though the end of the program in September 2019.

DHS Secretary Kirstjen Nielsen announced in January that the program — which offers protections from deportation and legal permission to work in the U.S. for Syrians and nationals of nine other countries who are in the U.S. — would end Sept. 30, 2019.

A U.S. Citizenship and Immigration Services official shared with the Washington Examiner on Wednesday a copy of the letter sent to 335 people who are in the program. The Automatic Employment Authorization Document Extension was announced in letters mailed Sept. 12. Recipients will be allowed to work through March 26.

USCIS said the extension is a technical correction that was made in order to align the final end date of work documents with the TPS program's potential cut-off: Sept. 30, 2019.

Beneficiaries had been told they could re-apply for an extension to remain here through that date. Those who had applied for an extension had not received an answer yet from the federal government and would have lost their ability to legally work in the country as of Sept. 27.

A Federal Register notice issued March 5 stated people would have six months to ask for an automatic extension to work in the U.S., known as an employment authorization document, or EAD.

Now those with pending applications who would have lost their ability to work will automatically be protected for the next 180 days.

Specifically, people whose work protections were supposed to end March 31 of this year who had applied for an extension after March 5, as well as those whose work papers expired Sept. 30, 2016, but who applied for an extension after Aug. 6, 2016, are eligible for the extension.

USCIS is in the process of sending new employment authorization documents to people but has already mailed letters to let them know of the extension, the official confirmed.

DHS originally granted temporary protected status to the group of Syrians due to continuing armed conflict and "extraordinary and temporary conditions" in the country.

The same courtesy extension was recently extended for recipients from Haiti and El Salvador, whose TPS programs were set to conclude in 2019.

Since the fall, DHS has said it will conclude temporary protected status programs for Nepal, Nicaragua, El Salvador, Sudan, Liberia, Haiti, Somalia, and Honduras.

However, Nielsen announced an 18-month extension for the temporary protected status program for Syria, South Sudan, and Yemen.
