    The illegal immigrant who admitted to fleeing law enforcement in Nassau County, leading to the death of a Deputy who chased him, now faces a charge connected to that death.

    Francisco Portillo-Fuentes is already serving a two year federal prison sentence for illegally re-entering the country.

    He had previously been deported twice, and re-entered the U.S. again a short time before the November 2016 incident in Yulee. Portillo-Fuentes fled on foot across State Road 200, and Nassau County Deputy Eric Oliver chased him. Oliver was hit by a car, and later died.

    Portillo-Fuentes was later caught in Jacksonville.

    The Florida Highway Patrol now confirms that they’re finalizing paperwork, along with the State Attorney’s Office, to charge Portillo-Fuentes with aggravated manslaughter of a police officer.

    This charge is expected to be finalized on Friday, and Portillo-Fuentes has been brought to the Duval County Jail in the interim.

    Illegal immigrant in Nassau deputy’s death changes jails while new charge considered

    The undocumented El Salvadoran man, who was back in the United States for only a matter of days before being chased by a deputy who died during the foot chase, is serving some of his federal sentence in the county jail as state officials sort out whether state charges will follow.

    Francisco Portillo-Fuentes, 27, was transferred from a South Carolina federal penitentiary to Duval on Sunday. The 4th Judicial State Attorney’s Office said it wants to be able to keep tabs on the federal inmate while the case is reviewed.

    According to federal documents, in October 2016 Portillo-Fuentes bailed from a pickup truck that had been parked at a gas station in Yulee when a Border Patrol agent approached the truck. As Portillo-Fuentes ran toward Florida 200, two deputies from the Nassau County Sheriff’s Office who were in the same area for an unrelated call gave chase.

    The first deputy made it safely into the median, the Times-Union previously reported, the second deputy did not. Thirty-two year-old Eric Oliver died at the scene after being struck by a passing motorist in an SUV. Portillo-Fuentes, who had been living in Jacksonville with his wife and children, had been picked up earlier as part of a day-labor pool. After he ran off, he eluded authorities from the Nassau and Jacksonville sheriff’s offices, the Florida Highway Patrol and the U.S. Marshals Service for the next 11 hours until being caught in Jacksonville.

    Portillo-Fuentes, who also had twice been deported, was arrested on federal charges of re-entering the country illegally. Thirteen months ago he pleaded guilty to the charge. He was ordered to serve two years in federal prison (he was given credit for the roughly 100 days he was behind bars before the plea deal) with one year of supervised released.

    It’s been expected that Portillo-Fuentes would be deported after finishing his sentence — that is unless the State Attorney’s Office files charges that could keep Portillo-Fuentes in custody until there is a trial on state charges. The State Attorney’s Office said Tuesday that no state charges have been filed yet.

    When asked for a comment about possible manslaughter charges that could be forthcoming, Nassau County Sheriff Bill Leeper said, “If this person had not been in this country illegally, Eric would still be alive today.”

    That may be easy to say for some, said Bill White, the former public defender for the 4th Circuit, but proving that is an entirely different matter.

    “Obviously he didn’t intend for the deputy to die, but the question is going to be: Is he criminally culpable,” White said.

    In civil cases, one must determine if there are foreseeable consequences to an action. That too, to an extent, is applied to criminal cases.

    “In order to charge him with being a prominent cause of the deputy’s death, they are going to have to show a straight line of connection,” White said.

    Given the sheer emotion that comes when an officer is killed in the line of duty and add to it the atmosphere in the country right now because of the president’s distaste for illegal immigrants, the case is likely to get attention.

    “This makes it harder for the state attorney not to charge him,” White said. “But then again, they have the responsibility not to charge him unless they can provide due diligence. Any lay person’s first impression is there is a dead law enforcement officer and somebody has to pay for it.

    “There is a lot of emotion anytime a law enforcement officer is killed — they are there to protect us. It is terrible when anyone is killed,” he said ”... It’s hard to do the right thing sometimes. I cannot tell you I know the right thing for sure right now because I am not close to it, but I can tell you it is going to be a tough decision right away.”
