We Build the Wall to Hold Rally Today in Sunland Park, New Mexico, Where Liberal Mayor’s Cease and Desist Order Has Temporarily Halted Construction

We Build the Wall plans to hold a rally today for the wall it is building in New Mexico to gather support against the city that is trying to shut them down.


Meanwhile, construction is halted while the builders work on the fight with the city, Kris Kobach, general counsel for We Build the Wall, was quoted as saying by The Washington Times.

Registration for today’s 4 p.m. rally is here. The location is the headquarters of American Eagle Brick Company at 1000 Brickland Road in Sunland Park, New Mexico, which is about one mile north of the approximately three-quarters mile section of wall that was built in just five days on land the company owns. Another one-quarter mile section of the wall, which would have been almost completed by now, remains to be built after the City of Sunland Park’s Mayor Javier Perea, a 2016 Bernie Sanders, on Tuesday afternoon issued a cease-and-desist order on construction at the site, as Battleground State News and The Tennessee Star reported.


The city claimed We Build the Wall did not have a building permit and denied city officials access to the site. We Build the Wall strongly denied both charges.

In addition to Kolfage, the speakers will feature Sheriff David Clarke, Steve Bannon, Tom Tancredo, Gen. Robert Spalding and Angel Parents.

Also on Tuesday, the City Council passed a resolution announcing the week of June 3-7 as Amnesty Week.
Kolfage said the organization was ready for opposition and the only thing left to do in the section of wall that has been completed is to pave a road for the Border Patrol.


He tweeted, “@WeBuildtheWall planned for a battle, that’s why we finished the wall in 3 days when the corrupt city was partying over the holiday! Only thing left is to pave the road for border patrol! BOOM!”

Leahy asked McCabe to give Tennessee Star Report listeners the latest news on the efforts of the We Build The Wall team, which has put up about three-fourths of a mile of 18 foot high fencing on the southern border between New Mexico and Mexico in just five days, with another one-fourth of a mile left to close the gap between two existing 20 mile segments of existing border wall.


McCabe said that We Build the Wall did have the permits in process and verbal permission to proceed from by city inspectors, but the city caused a delay in issuing the final permit approvals.

Well today for One America News I will be reporting that the We Build the Wall has stopped working on that wall that’s filling a very critical gap between the Rio Grande River and the mountainside that is just on the New Mexico side of the Rio Grande River. So El Paso stops at the river. The city of El Paso stops at the river and then Sunland Park is the next town over in New Mexico and what happened is, We Build the Wall [went] to get all the proper permits and they filed their paperwork and they were told that the guy who how much this fee is is on vacation. So go ahead, you guys start. When that guy comes back from vacation we’ll give you a number and then you can just sort of pay, write the check and we’ll move on.

McCabe said We Build the Wall told him they planned to return to City Hall and would be ready to write the check but were prepared to defend their legal rights.

Kolfage called the cease-and-desist order political intimidation, WGNO said. His group met with city officials about the permit Tuesday night.

The city ultimately thought the site plan “wasn’t good enough,” Kolfage said. “We are redoing that. It’s engineering for the layout of the land. It shows topography.

“What we really think it is, we think it’s a political issue. People are raising a fit about this. People don’t like that it’s happening,” he said. “That’s why we waited as long as we did to file the paperwork.”

Kolfage is not backing down from the fight.

On Wednesday he tweeted, “It’s pretty bad when our legal team has to educate Sunland Park mayor on his own city ordinances. They don’t even understand their own laws.

We’re about to embarrass them in from of the nation who is watching!”

The Trump Administration has his back, he said.

He tweeted, “The International Boundary and Water Commission received a call direct from the Trump administration last week authorizing our build- WE ARE IN FULL COMPLIANCE! #Winning”

In his press conference on Tuesday announcing the issuance of the cease and desist order, Sunland Park Mayor Javier Perea said the next step would be taken in court. However, sources tell The Star that the local municipal court did not take up the matter on Wednesday, and it is unclear when it will address it.

Even as We Build the Wall fights the City of Sunland Park, it is seeing a surge in GoFundMe donations, which topped $23 million Wednesday.

Also according to the Washington Timesstory, American Eagle Brick, which owns the land where the wall is being built, has possessed the property since the 1880s – well before New Mexico was admitted as a state – which makes a difference in building the wall.

Mr. Kobach said because it was in private hands so early, it does not have a “Roosevelt Reservation,” which is a 60-foot easement running along much of the border that was put under federal jurisdiction by President Theodore Roosevelt in 1907.

The We Build the Wall construction crews were not on site working Wednesday, and it is uncertain when they will return.

Sources tell The Star that the portion of the wall built so far has already had the effect of deterring illegal immigrants from crossing, as at least one truck was seen entering a parking lot on the Mexico side of the wall which had previously been a jumping off point for an easy border crossing, was seen turning around after being confronted by the reality of the new 18 foot wall put up by the We Build the Wall team.
The one-quarter mile section of the proposed wall yet to be built is on very hilly and rough terrain, which cannot be easily crossed.

Leahy: Neil what’s going on this morning down in Sunland Park? Bring us up to speed. There was a cease and desist order yesterday afternoon. What’s happened since then. You are on the ground in Sunland Park, New Mexico and the sun is about to come up there and the work day about to begin. Tell us what happens next.

McCabe: I was on the ground. I’m not sure exactly what the mayor was saying.


Leahy: Ok.


McCabe: But I was talking with the We Build the Wall legal team last night.


Leahy: Ok.


McCabe: And what they told me is that they were given the go ahead by two officials and they’re going back to city hall today to have a meeting and they’re Plan A is to treat this thing like everybody’s being sincere. Everybody wants to make sure that everything is just right. That all the t’s are crossed and all the i’s are dotted. And they’ll write the check that they’re supposed to write and everything will be fine. If that doesn’t happen, well you know Kris Kolbach is a former federal prosecutor and he’s very very good attorney. And they’re are other attorneys working with We Build the Wall and Sunland Park won’t know what hit them if Sunland Park continues to obstruct We Build the Wall we’ll defend it’s rights. And I think they have a really good case.
Leahy: Neil, did you see our story last night that the Mayor Javier Perea was apparently a two thousand sixteen Bernie Sanders supporter. Do you think there is any ideological element of this here? We went to his Facebook page and he had a post on it. Bernie Sanders big image there June two thousand sixteen.


McCabe: Virtually every member of the government of this city is a Democrat.


Leahy: I’m shocked! I’m shocked!


McCabe: And roughly two or three years ago the state of New Mexico actually had conducted like an intervention where the police wrapped up every official they had and arrested them and they basically had to start from scratch. I don’t think the city was in actual receivership but it was very close just because of the corruption from the cartels.


What people don’t appreciate is all along the border you have people who when they’re interviewed by reporters say, “We hate all these coyotes. We hate all these migrants. We hate these people coming across our ranches. This is a travesty. Something must be done.” But in reality, they’re all taking bribes from the cartels. It’s crazy down here. The money that’s being spread around and these border towns are doing very well by selling out the rest of the country.


Gill: You know what would be interesting Neil is for the feds to start an investigation about what’s going on in these border towns. Looking at that corruption. Looking at the bribery. And again drawing attention to a community like Sunland Park maybe will put that spotlight on them that they’re going to wish they hadn’t drawn.


McCabe: Well the problem of course is that so much of the federal government who want this immigration and of course the US Chamber of Commerce is backing Republican candidates who are supporting open borders. And you have some of the closest advisers to the President off the United States who want open borders and so it’s really difficult to get something done when you have people in control who don’t want something done.


Gill: Yeah, the Chamber of Commerce wants open borders so they can continue to get cheap illegal labor. The Democrats want open borders because they can get cheap illegal voters. And the only people standing in the way of this are Donald Trump and Americans.


McCabe: Donald Trump and his voters are completely out of sync with what Washington wants. And that’s why you have so many Congressman, Senators I’m now calling from El Paso, but I work from Washington everyday. So many Republican Senators and Congressman are just waiting for Donald Trump to go away so they can go back to the good old days of taking Chamber of Commerce money. Taking Coke Brother money and pushing open borders. They want to deal with the dreamers so bad they can taste it. And Donald Trump is standing in the way.


Leahy: At his press conference yesterday, Javier Perea, the Bernie Sanders two thousand sixteen supporting mayor of Sunland Park New Mexico said that the next step would be to have the cease and desist order before city court. But you’re saying that the We Build the Wall folks are going to go to city hall to see if they can work it out. If not it goes to city court. What would happen then?


McCabe: The police did come to the premises yesterday to deliver that paperwork.


Leahy: Oh they did? What time did they come to deliver the cease and desist order? About five o’clock or so? End of day?


McCabe: Four or five. I’m not sure when we spoke Mike but yesterday.
Leahy: It was before that I think. It was before that.


McCabe: So I just had come from people that told me they got the cease and desist order when I was on the phone with you. And so that meeting tomorrow morning is supposed to smooth this thing out. We’re not sure who made a mistake here. But let’s just move forward and I don’t know what the number is but it would be a significant number that when this wall project is completed.
Remember it’s walls, fences, they’ve got lights that will turn this place into center field at Yankee stadium. (Leahy laughs)So there will be a significant, I don’t want to call it a tax, but a fee upon completion of a construction project that Sunland Park would receive a big check.


Gill: Yeah but that would be legal money rather than illegal money from the drug cartels which they seem to prefer.


Towards the end of the segment, McCabe disclosed an additional problem at the border wreaking of corruption and bribery by those that claim they want illegal immigration stopped but are actually selling out the rest of America by accepting big money from the cartels.


Leahy: Neil McCabe is in Sunland Park, New Mexico.
Gill: He may have a sense of the population down there. I think eight or ten thousand illegals dumped into the city might overwhelm them. Neil what do you think?


McCabe: Well the truth is if these illegals stay and they find a way to sanctuary cities all over our great lands.


Leahy: But you know Neil, next week this Mayor Javier Perea who yesterday afternoon held a big press conference issued a cease and desist order claiming that all the paperwork was not in order for building the wall down there. Next week they’re going to hold a one week long Amnesty week for illegal aliens in Sunland Park. So Steve’s idea was to send a convoy of illegal aliens there what do you think?


McCabe: (Scoffs) I think it’s more interesting that if the illegals are sent to places like Brookline, Massachusetts


Leahy: Yep.


McCabe: Or West Hollywood. Or Ann Arbor, Michigan.


Gill: See, I think it would be cruel and inhuman punishment to send them to San Francisco, Nancy Pelosi’s district, because of the drug needles and the poop on the streets. (McCabe chuckles)There would probably be a constitutional barrier to doing that. We ought to be dropping them off right in front of her house.

Pro-wall calls flood Sunland Park City Hall following cease-and-desist

Web-based campaign urges town to reconsider cease-and-desist order

SUNLAND PARK, New Mexico -- Officials in this Southern New Mexico town received thousands of calls on Wednesday in support of a privately funded border fence. This came the day after Mayor Javier Perea issued a cease and desist order stopping further work on the border barrier because it lacked a municipal construction permit.


"I got 800 calls on my answering machine in one hour. They're all calling from out of state. They are in favor of the wall," said a Sunland Park city official who declined to be named.
The official said the calls were the result of a web-based campaign from supporters of the structure being built on American Eagle Brick Co. property just east of Mt. Cristo Rey, in Sunland Park city limits. The steel-bollard fence was funded by a GoFundMe campaign spearheaded by We Build the Wall.


Members of the group said on Twitter they plan a "massive" rally in support of the structure this Thursday at the wall site. They also urged supporters to keep pressuring Sunland Park to capitulate.

"Please keep calling Sunland Park at 575-589-7585 and respectfully tell them to stop playing games with their bogus stop work order. Keep calling and keep the pressure on," said Dustin Stockton, vice president of We Build the Wall.


On Wednesday, the receptionist at Sunland Park City Hall answered non-stop telephone calls, writing down whether the caller was in favor or opposed to the border fence.


"OK, ma'am. I'll tell the mayor you support the wall," she said. "No ma'am, we're not in Mexico, we're in New Mexico".

Neither Mayor Perea nor members of City Council contacted by KTSM 9 News were available for comment. The City issued a statement late in the morning saying the town had too many press inquiries to handle and that it wouldn't be making a comment today. The City called for a press conference Thursday at 1:30 p.m.


Perea on Tuesday said the City issued the cease and desist order because the property owner didn't have a permit. He said Sunland Park officials said the application lacked a site survey, impact statement and other requirements. He also said city officials received contradictory information from the petitioner.

However, supporters of the wall said on Twitter that a Sunland Park official who visited the site last week gave the fence a green light. This assertion couldn't be verified on Wednesday because city officials made themselves unavailable for comment.

Border Wall on Private Land in New Mexico Reportedly Set to be Completed Despite Cease-and-Desist Order

A mayor in New Mexico issued a cease-and-desist order to a company building a border wall on private land between the United States and Mexico but the nonprofit behind the wall said the section was set to be completed on May 30.
Brian Kolfage, an Air Force veteran, raised more than $22 million to build portions of the border wall on private land. Construction work started on May 17 south of Sunland Park, New Mexico in the El Paso, Texas, metropolitan area.
Javier Perea, the mayor of the City of Sunland Park, told CBS 4 on May 28, that the wall was in violation of city ordinance. He said an application filed by the owner of the property was incomplete, prompting the cease-and-desist order, and that walls can only be up to six feet tall.
According to documents filed by the American Eagle Brick Company, the owner of the land, and obtained by KVIA, the half-mile of wall was said to cost $5.8 million. Sunland Park officials declined to say which part of the application was missing.

After the cease-and-desist order was issued on Tuesday, more than 2,500 phone calls came into the city from supporters of the wall.
The nonprofit behind the wall said the city did say it could build it.
“One official gave us the all-clear on Thursday. Another gave us the all-clear on Friday,” Chris Kobach, a representative for We Build the Wall, told CBS 4, referring to May 23 and May 24. “And that’s actually when they came down and examined the site and told us we could proceed.”
Kolfage described the order as “Liberals trying to intimidate us! SOUND THE ALARM” and said the city had given them the green light to build.

He said in an update on May 30 that the section of the wall was set to be completed by 10 a.m. on Thursday.
In a press release, We Build the Wall said the owner of the property was originally told by the U.S. Army Corps of Engineers that a wall would be too difficult to build on the mountainside, describing it as a “natural barrier,” but that his nonprofit and the contractor, Fisher Industries, was going to complete the wall by Thursday morning.
“My. Cristo Rey is an important shrine to thousands of Americans from southern New Mexico and west Texas, as well as visitors from northern Chihuahua, and it’s a beautiful site,” Kolfage stated in the release. “However, it’s not the ‘natural barrier’ that it’s alleged to be, as I was able to roll across the border in my wheelchair with ease.”
Tommy Fisher, the CEO of Fisher Industries, had told 3 TV on Wednesday night that it would take approximately three more days to finish the wall.
Kolfage also accused the city of being paid by cartels. Perea, the mayor, admitted there had been corruption in the past but said there is not at present.

In a statement, New Mexico Gov. Michelle Grisham, a Democrat, said the section of the wall was inconsequential.
“A multi-faceted and strategic approach is required for establishing and enhancing border security as well as dealing with the humanitarian crisis on our southern border. No president, no federal administration has done enough on these fronts in recent decades, and certainly not in recent months,” she said.
“But to act as though throwing up a small section of wall on private land does anything to effectively secure our southern border from human- and drug-trafficking or address the humanitarian needs of the asylum seekers and local communities receiving them—that’s nonsense. It takes us farther away from where we all need to be.”
