    The 29-year-old Kenosha man charged in the West Allis crash that killed a 6-year-old girl Monday could face federal charges for re-entering the country illegally after being deported to Mexico in February, the U.S. Immigration and Customs Enforcement office said Wednesday.

    Gail Montenegro, spokeswoman for ICE’s Chicago region, said her agency expects to file federal re-entry charges against Jose A. Rodriguez, accused of striking Mackenzie J. Maddox and her 25-year-old mother, Andrea F. Maddox, both of West Allis as they crossed the street.

    Andrea Maddox remains in satisfactory condition at Froedtert Hospital.

    Rodriguez was charged Wednesday in Milwaukee County Circuit Court with driving with a revoked license, causing death, a misdemeanor punishable by a fine and up to nine months in jail. According to the complaint, he was driving a red dump truck north on S. 84th St. and crossed W. Cleveland Ave. under a green light when he struck the two pedestrians.

    Rodriguez, who waited for police at the scene, is being detained on an immigration hold at the Milwaukee County Jail. He faces from two to 20 years in prison if convicted, depending on the types of criminal offenses for which he was deported, Montenegro said.

    More than 100 friends and family of Mackenzie and her mother held a candlelight vigil Wednesday night near the scene of the collision.

    If he had been deported after the first offense, this little girl would still be alive. How many Americans have to be killed before this useless government does something about this epidemic of crime caused by illegal aliens. And yes, to me it's beginning to look like an epidemic because these illegal aliens are forcing their immmoral culture of drunk driving on unsuspecting citizens.

    According to police, Rodriguez has several traffic-related convictions, including one for driving while intoxicated. He was first identified by ICE while serving 30 days in the Kenosha County Jail on that charge, under the agency’s Criminal Alien Program that identifies individuals who are in the country illegally and serving time in jails and prisons, Montenegro said.
    First identified? Why wasn't he deported after being "identified?" You have a criminal illegal in your custody and yet that criminal illegal was never deported.

    Explain that "policy" to the mother of the deceased child!

    So with out a valid drivers license he was hired or re-hired to drive a huge dump truck on city streets, illegal to work,or drive and he gets hired
    to save a company some money. Its way past time to take to the streets after the illegal alien employers, they are killing our kids!

    An illegal immigrant convicted in a deadly crash has been sentenced.

    Jose Rodriguez was sentenced to nine months in prison, but will only be behind bars for five of them because of time served.

    He also faces federal charges for being in the United States illegally.

    Police say he hit a mother and daughter as they crossed the street in West Allis in June.

    The daughter was killed. Her mother, Andrea Maddox, was injured.

    Maddox says she has no sympathy for Rodriguez.

    "When things happen like to people who are innocent like me and my daughter, I don't feel sorry for him," said Maddox. "He put me and my family through an emotional hell.

    "Obviously his privilege was removed, and now understand his choice, and now look at the result from your poor choice."

    The victim's grandmother, Christine Maddox, is angry at the sentence.

    "He already sat in jail," said Christine. "It's credited to his time which I think is unfair."

    "I can not forgive my heart or my soul what happened that day," stated Rodriguez, though an interpreter, during the sentencing hearing.

    Rodriguez was driving with a revoked license. He had been deported, but returned illegally.
