A 20-year-old man suspected of being in the country illegally is accused of sexually assaulting a 7-year-old girl while her mother cooked dinner in another room.

Eduardo Organista-Temich, of Wausau, appeared Monday in Marathon County Circuit Court to face two felony charges of first-degree sexual assault of a child under age 13. Marathon County Circuit Court Judge Jill Falstad ordered Organista-Temich held on a $5,000 cash bond. He faces 120 years in prison if convicted on both charges.

According to the criminal complaint:

An investigation began May 22 when the girl told her mother that Organista-Temich had “touched her privates” on two separate occasions at the girl’s home. The girl told investigators from the North Central Wisconsin Child Advocacy Center in Wausau that the first assault happened in 2011, when the girl was 5. The girl said she was lying on a bed watching television with Organista-Temich when the assault occurred. The girl’s mother was in the kitchen and the girl’s sisters were in the next room playing when the assault happened.

A second assault happened May 17 in a bathroom at the family’s home, the girl said. Organista-Temich was arrested Friday at a Rib Mountain restaurant where he works as a cook.

Organista-Temich, when he spoke with investigators from the Wausau Police Department, denied assaulting the girl.

An investigator was prepared to testify at Monday’s hearing that Organista-Temich is in the country illegally, but the investigator was not called to the stand. Marathon County Assistant District Attorney Lisa Gramer told Falstad that an Immigration and Customs Enforcement hold was expected to be placed on Organista-Temich Monday afternoon. An ICE hold requires state authorities to hold a person suspected of violating immigrations or customs laws until a federal investigation is completed.

Organista-Temich was ordered to have no contact with anyone younger than 18, even if he is supervised by another adult.

“These instances seemed to have happened even with family members right in the same house,” Gramer said. “I have a hard time believing another adult could prevent a problem.”

Organista-Temich has no prior criminal history, Gramer said.

A preliminary hearing is set for June 12.
