    TN:BUILDERS don't have to be concerned with illegal aliens

    Susan Ritter of the Home Builders Association of Tennessee is applauding what she says is fact that builders in Tennessee do not have to worry about immigration status or the use of illegal aliens.

    What good is a law passed Jan 2008 that says you can have your business license suspended, revoked for employing illegal aliens?

    She mentions a 2007 law.

    Her comments were amusing about posting a "No Trespassing" sign to warn those who steal copper, etc. that there will be penalties for doing so and yet the NO TRESPASSING across the border or violation of immigration law does not warrant fines or penalties for builders or illegal aliens.

    Susan Ritter, executive vice president of Home Builders Association of Tennessee, was the guest speaker.

    She talked to approximately 100 ORBA members. There is a stable statewide membership of 6,400 in building trades, real estate and mortgage lenders.

    She gave updates on immigration legislation that would hold builders responsible for illegal immigrants.

    An immigration law passed in 2007 holds builders harmless if a W-2 Form is not issued.

    "You should not be held liable for determining whether or not a person is legal to work in the state of Tennessee or not," she said.

    Legislation against metal theft is designed to discourage theft of copper in wiring, tubing, air conditioners and selling it to scrap metal dealers. She said the best part of the legislation is if a job site is posted "no trespassing" and a theft occurs, the offense increases from a misdemeanor to aggravated criminal trespassing. The offense carries a minimum fine of $2,500 and up to one year in jail.

    As I see this pair of laws. There is a limit on the number of hours that someone can work for an employer without a W2.


    To hire someone an employer might reasonably expect to be illegal more than those hours in order to avoid following laws on immigration would make any business subject to laws against evasion or structuring.


    The state of Tennessee can still get these deviants. The most that it protects against is their ocassional use of day laborers
