A motion was filed Friday to toss out a plea deal made earlier this week by former Miss Kentucky Latina Daniela Gaskie, who pleaded guilty in an assault case against her just one day before she was spotted inside the Lexington gun business owned by her husband that had earlier been burglarized.

LEX 18 cameras captured video of 22-year old Daniela Gaskie inside Sling Point Firearms after the burglary early Thursday morning. Gaskie once modeled for advertising for her husband's gun store.

On Wednesday, Gaskie pleaded guilty to two counts of misdemeanor assault for stabbing a gas station employee with a pen and beating up a 59-year-old pharmacist in September. Gaskie's plea deal included guidelines that she could not own a gun or work at a business that sold them. In court, judge Brandy Brown told Gaskie that she was also ordered to stay away from her husband's gun shop.

Madison County prosecutor Marc Robbins told LEX 18 that he has filed a motion to revoke the discharged order and force Gaskie to serve her two-year sentence in the Madison County Detention Center. The hearing on the new motion is set for next Wednesday.

Gaskie's attorney says the incident was a family emergency and that Gaskie was only there to make sure family members were not hurt and to help clean up the mess left in the bizarre burglary in which a car crashed into the business before suspects stole numerous guns.
