    Australia joins US, Israel in refusing to sign UN migration pact

    By Joshua Berlinger, CNN
    Updated 9:54 PM ET, Tue November 20, 2018

    Thai Prime Minister Prayut Chan-O-Cha (left) looks on as Australia's Prime Minister Scott Morrison (center) talks with Japan's Prime Minister Shinzo Abe as they arrive to pose for a group photo in Singapore on November 14.

    (CNN) Australia will not join a United Nations-backed global pact on migration, Prime Minister Scott Morrison announced Wednesday, citing concerns that the deal would be used to "undermine Australia's strong border protection laws and practices."

    The Morrison government's decision comes as countries from around the world move to formally adopt the "Global Compact for Safe, Orderly and Regular Migration" pact next month.

    The UN made the decision to come up with a global compact on migration in 2016, in the wake of the crisis in the Mediterranean, which has seen thousands of migrants die while attempting to cross into Europe.

    A draft of the agreement, which is not legally binding, was finalized in July after more than a year of work.

    Morrison said in a statement that his government believes the pact, as currently written, is not in Australia's interest and will not "add anything to enhancing our capacity to control our borders and manage our successful immigration program."

    "The Compact fails to adequately distinguish between people who enter Australia illegally and those who come to Australia the right way, particularly with respect to the provision of welfare and other benefits," the statement read.

    "This is inconsistent with the management of Australia's strong and orderly migration program under the Liberal National Government."

    Australia has come under fire from international rights groups for its strict immigration laws.

    For years
    , asylum-seekers who were caught illegally entering Australia by boat were sent to processing centers on Nauru and Papua New Guinea's Manus island. Some have spent years there, and a 2016 UN report found cases of "attempted suicide, self-immolation, acts of self-harm and depression" among children detained on Nauru.

    Successive Australian governments have defended the practice of using offshore detention centers as a way to control immigration despite domestic and international criticism.

    Morrison said that adopting the compact would "directly conflict with important principles that have underpinned our successful approach."

    A handful of Western countries have also rejected the pact for similar reasons.

    Israeli Prime Minister Benjamin Netanyahu said Tuesday that his country would not sign up to the agreement. The United States also left the global compact last year, saying that while it supported international cooperation on migration, "it is the primary responsibility of sovereign states to help ensure that migration is safe, orderly, and legal."

    40 Per Cent of Germans Fear UN Migration Pact Will Result in More Migrants

    Excerpt.....
    Forty per cent of Germans say they fear the UN Migration Pact will give migrants additional asylum rights.

    The Insa Institute carried out a survey of 2,062 Germans between Friday and Monday, asking them to respond to the statement: “I fear that the signing of the UN Migration Pact could lead to additional claims for asylum.”

    Deutsche Presse-Agentur reports that 40 per cent responded they feared the UN declaration would give migrants greater rights to asylum in Germany and almost an equal number either responded “don’t know” or did not answer, while just 22.7 per cent said they did not perceive any risk of increased asylum seekers.

    The migration pact, due to be signed between the 10th and 11th of December in Marrakesh, Morocco, would require signatories to open up welfare systems to illegal aliens as well as “commit to eliminat[ing] all forms of discrimination” with measures including state promotion of “diversity” and the prevention of “hate speech.”

    While the United Nations claims the agreement is non-binding, legal experts have said that it is drafted in a way that creates a framework for asylum laws and occupies a “legal grey area.”

    Hungary Attacks UN Migration Compact for Attempting to ‘Legalise Illegal Immigration’

    2,008ANGELOS TZORTZINIS/AFP/Getty24 Nov 2018590
    3:14

    Hungary’s foreign minister Péter Szijjártó has condemned the UN Migration Pact for attempting to “legalise illegal immigration,” announcing his country will vote ‘no’ on the agreement in Marrakesh in December.

    Mr Szijjártó told media on Thursday that “The goal of the UN Global Compact for Migration is to legalise illegal immigration, which is totally unacceptable and violates the sovereignty of member states, including that of Hungary.”
    “The UN is making the same mistake as the European Union, which wants to base its own migration policy on mandatory resettlement quotas,” he continued.

    “The UN Compact is more dangerous, however, because it is a global initiative, meaning it will have a greater effect than [European] policy, and represents a risk to the whole world.”

    Confirming that Hungary will be voting “No” to the Global Compact for Safe and Orderly Migration in Marrakesh, Morocco, next month, the minister said the government’s main issue with the Compact is “whether or not it is mandatory, and in view of the fact that the document contains the word ‘obligation’ on eighty occasions, the claim that it only includes recommendations is a false one.”
    “A legally not binding document would not prescribe the establishment of national action plans, and accordingly it is ‘clearer than day’ that, just like the originally voluntary mandatory quota, the Global Compact for Migration will become a point of reference, mandatory, and the basis for international judicial decisions,” the minister of foreign affairs and trade explained.

    Hungary’s statement that the ‘non-binding’ Compact can, in fact, be ‘binding,’ came days after Dutch MEP and Co-President of the Europe of Nations and Freedom (ENF) group Marcel de Graaff said that “it is still the legal framework on which the participating countries commit themselves to build new legislation.”
    Calling it “a legalisation of mass migration,” the Dutch populist said: “It’s declaring migration a human right.”
    Belgian law professor Pierre d’Argent has argued the migration agreement, like other UN compacts, could be used by lawyers in interpreting laws, with German law professor Matthias Herdegen noting the UN compact occupied a “legal grey area” which “gives the impression of [state] liability.”

    Mr de Graaff also warned this week that the document could be used as a basis for making criticism of mass migration illegal, saying: “One basic element of this new agreement is the extension of the definition of hate speech… Criticism of migration will become a criminal offence. Media outlets that give room to criticism of migration can be shut down,” he claimed.
    “In fact, it will become impossible to criticise Merkel’s ‘welcome migrants’ politics without being at risk to be jailed for hate speech,” de Graaff added.

    On Wednesday, German Chancellor Angela Merkel, the architect of the European migrant crisis, made an impassioned defence of the UN Migration Compact, saying there should be “no compromise” on global mass migration and condemned opposition as “nationalism in its purest form.”
    Apart from Hungary, Australia, Israel and several other countries have said that they will not sign the document or have signalled that they will not, following the lead of U.S. President Donald Trump who rejected the compact in December 2017.

    Global compact for migration

    IOM Photo 2017

    The global compact for migration is the first, intergovernmentally negotiated agreement, prepared under the auspices of the United Nations, to cover all dimensions of international migration in a holistic and comprehensive manner.

    Today, there are over 258 million migrants around the world living outside their country of birth. This figure is expected to grow for a number of reasons including population growth, increasing connectivity, trade, rising inequality, demographic imbalances and climate change. Migration provides immense opportunity and benefits – for the migrants, host communities and communities of origin. However, when poorly regulated it can create significant challenges. These challenges include overwhelming social infrastructures with the unexpected arrival of large numbers of people and the deaths of migrants undertaking dangerous journeys.

    In September 2016 the General Assembly decided, through the adoption of the New York Declaration for Refugees and Migrants, to develop a global compact for safe, orderly and regular migration.

    The process to develop this global compact started in April 2017. The pages in this section detail 18 months of consultation and negotiation, and provide the relevant documentation for each of the events.

    On 13 July 2018 UN Member States finalized the text for the Global Compact for Safe, Orderly and Regular Migration (Text available in all official languages).

    The Intergovernmental Conference to Adopt the Global Compact for Safe, Orderly and Regular Migration will be held on 10 – 11 December in Marrakech, Morocco.

    Global Compact

    The Global Compact for Migration is the first-ever UN global agreement on a common approach to international migration in all its dimensions. The global compact is non-legally binding. It is grounded in values of state sovereignty, responsibility-sharing, non-discrimination, and human rights, and recognizes that a cooperative approach is needed to optimize the overall benefits of migration, while addressing its risks and challenges for individuals and communities in countries of origin, transit and destination.

    The global compact comprises 23 objectives for better managing migration at local, national, regional and global levels. The compact:

    • aims to mitigate the adverse drivers and structural factors that hinder people from building and maintaining sustainable livelihoods in their countries of origin;
    • intends to reduce the risks and vulnerabilities migrants face at different stages of migration by respecting, protecting and fulfilling their human rights and providing them with care and assistance;
    • seeks to address the legitimate concerns of states and communities, while recognizing that societies are undergoing demographic, economic, social and environmental changes at different scales that may have implications for and result from migration;
    • strives to create conducive conditions that enable all migrants to enrich our societies through their human, economic and social capacities, and thus facilitate their contributions to sustainable development at the local, national, regional and global levels.

    The list of the 23 objectives can be found in paragraph 16 of the Global Compact for Migration.

    Global Compact on Refugees

    UN Photo/UNHCR

    As part of the follow up to the 2016 New York Declaration, the High Commissioner for Refugees has proposed a Global Compact on Refugees in his annual report to the General Assembly in 2018.

    The United Nations High Commissioner for Refugees was given the task of developing and proposing a new global compact on refugees in consultation with States and other stakeholders, based on the comprehensive refugee response framework set out in the New York Declaration (Annex I). That process comprised a series of thematic discussions and meetings in 2017 followed by formal consultations on successive drafts between February and July 2018.

    The High Commissioner proposed a final text in his annual report to the UN General Assembly in 2018 and the compact will come before the General Assembly before the end of the year, in conjunction with the annual resolution of the Office of the United Nations High Commissioner for Refugees.

    The global compact on refugees is a unique opportunity to strengthen the international response to large movements of refugees and protracted refugee situations. It builds on existing international law and standards, including the 1951 Refugee Convention and human rights treaties, and seeks to better define cooperation to share responsibilities.

    Its four key objectives are to:

    - Ease the pressures on host countries;
    - Enhance refugee self-reliance;
    - Expand access to third-country solutions;
    - Support conditions in countries of origin for return in safety and dignity.
