Might have been a civil case, since it was destruction of property and not really theft.

I have been looking at the history and the conclusion i come to is that in the eyes of England it was surely Criminal. it did spark the Civil war.

but history views it as An Act of protest I find that Telling.

It was only illegal in the eyes of England. And it was the Revolutionary war that the tea party lead to.

According to the laws on the books at the time, it was theft of property (unless it was paid for later, history really does not say)

But the question asked here is for my opinion. Do I think it was Criminal? nope

Only because the Americans won the Revolutionary War. If they had lost our British Empire history books would call it a treasonous act, and the perps were caught and hanged. Remember, the winner writes the history books.
